1) Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

 

2) Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

3) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

4) Promotion commences 12:01pm (AEST) October 8 2010 and ends 12:01pm (AEST) October 18 2010 (Promotion Period). Any entries received after this time will not be considered and are not eligible for the prize.

 

5) To enter the Promotion, entrants must, during the Promotional Period:

 

i.  Logon to the NOMIN8 custom tab on the Nokia Australia Facebook platform at http://www.facebook.com/NokiaAustralia;

ii.    Provide their full name, current and valid email address and postal code of current residence.

iii. Answer in 25 words or less in the field provided on the custom tab: "Why should David LaChapelle shoot you and your friend on the Nokia N8?"

 

6) Incomplete, indecipherable or illegible entries will be deemed invalid.

 

7) Multiple entries are permitted, subject to the following:  (a) each entry must be submitted separately and in accordance with entry requirements (b) entrants can enter multiple times by submitting a substantially unique and new text entry.

 

Cool Any entries that contain content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any Intellectual Property Rights or other rights of any person, corporation or entity, will not be considered eligible entries into the promotion. Without limiting any of the provisions of these Conditions of Entry, the Promoter requires that any entry not include or make reference to any visible logos, drawings, cartoons, phrases, trade marks or other third party materials (including but not limited to any copyrighted material, trade mark, logo or mark that identifies a brand) as it could result in a third party subjecting the entrant and/or the Promoter to legal liability. The decision to accept or reject an entry as an eligible entry is in the Promoter's sole discretion and no correspondence will be entered into.

 

9) Entries that contain content that the Promoter, in its sole discretion, considered to be one or more of the following content types will not be considered eligible Entries into the promotion:

 

a) content that depicts, alludes to or promotes offensive or illegal behaviour;

b) Content that does not depict the personages that have been declared as appearing in it;

c) harm of any kind against any group or individual;

d) content that harasses or advocates harassment of another person;

e) content that exploits people in a sexual or violent manner;

f) content that contains nudity, violence, or offensive subject matter or contains a link to an adult website;

g) content that solicits personal information from anyone under 18;

h) content that provides any telephone numbers, street addresses, last names, URLs or email addresses;

i) content that promotes information that entrants know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

j) content that promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

k) content that involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spamming";

l) content that furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

m) content that solicits passwords or personal identifying information for commercial or unlawful purposes from other users;

n) content that involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;

o) content that contains any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;

p) content that has been used in previous marketing materials or promotions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes;

q) content that includes an image or reference to another person that has been submitted without that person's consent; orr) content that uses sexually suggestive imagery or any other unfair, misleading or deceptive content.

 

10) There will be a total of four (4) winners for this Promotion.  All entries completed and submitted in accordance with these Terms and Conditions will be assessed by a panel of judges, appointed by the Promoter at its sole discretion, in order to determine the winners.  Judging will take place at 1 Butt Street Surry Hills, NSW 2010 on 19/09/2010, and all winners will be notified in writing (mail or email) and will have their names and winning photographs posted on the Facebook Wall within the Nokia Facebook Page (http://www.facebook.com/NokiaAustralia). The Promoter's decision is final and no correspondence will be entered into.

 

11) The winning entries will be selected based on criteria which includes but is not limited to: i) the creativity of the entry  ii) the originality of the entry iii) the level of descriptive content employed in the entry to convince the judges that the entrant and their friend would be an excellent subjects for a photograph. This is a game of skill. There is no element of chance in the judging and determination of the Winners. All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.

 

12) Each winner will receive :: air transfer* from their nearest capital city (departure Friday 22nd October) or vehicle transfers* from their residential address (as stated by the postcode declared in their entry) for two (2) to attend at the Nokia Melbourne event site at the Queensbridge Square, Melbourne to have their photograph taken by David LaChapelle or any other photographer appointed by the Promoter at its sole discretion on Saturday 23rd  October 2010; 1 night's accommodation for two (2) in a twin or double room at the Promoter's choice of 3 star hotel on the night of Friday 22nd October, including breakfast for two (2); transfers from the hotel to the Nokia Melbourne event site. All taxes, insurances, transfers, spending money and other expenses (including meals or personal expenses, upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner. Prize includes a digital copy of the photograph that can be downloaded from the Nokia Facebook Page (http://www.facebook.com/NokiaAustralia). The total recommended retail value of the prize is up to $2,000.

 

*The air and/or vehicle transfers and hotel accommodation described above to be provided is solely for the purpose of facilitating the winners to have their photograph taken at the said event venue on the date stated ("the photography session"), and this offer is not transferable, exchangeable nor refundable for cash or for value. In the event that a winner and/or his/her accompanying traveller fail or is for any reason unable to attend the photography session, the air and/or vehicle transfers and hotel accommodation shall be forfeited.

 

* Winner and accompanying traveller must be of legal age (in accordance with the legislation of the relevant participant's country/territory). If winner is below the relevant legal age, he/she must be accompanied by one of his parent/legal guardian for the trip, in which event the Promoter reserves its right to request for documentary proof of the relationship. Both the winner and accompanying traveller/parent/legal guardian must have valid travel documents.

 

* The winner and his/her accompanying traveller must travel together at all times. For avoidance of doubt, they shall all travel on the same arrival and departure flights or in the same vehicle between the winner's residence and the Melbourne event site.

 

* Any winner residing within a reasonable driving distance of the Melbourne event site will be provided with return chauffeur driven transport up to the value of $500. Any winner residing beyond a reasonable driving distance will be provided with return economy class and airport transfers to and from their hotel accommodation up to a total value of $2,000. It is the winner's own responsibility to arrange transportation between their own residence and the airport. Should the winner miss the scheduled flight for any reason whatsoever, replacement tickets will not be issued by the Promoter. Any additional elements of the trip that are affected will also not be rescheduled or replaced. The Promoter, in its absolute discretion, will determine what distance from the winner's residence is classed as reasonable.

 

All the above prize values are based on the Australian Dollar. The prize is valued up to $2,000.

 

13) Prizes are non-transferable and cannot be assigned, redeemed for cash, and no substitutions are permitted, except by Promoter who reserves the right, in its sole discretion, to substitute a prize of equal or greater value if advertised prize is unavailable.

 

14) Any taxes (including income and withholding taxes) on a prize awarded directly to a winner are the responsibility of each winner.

 

15) Total prize pool value is AUD$8,000.00. The Promoter accepts no responsibility for any variation in the prize values.  Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

 

16) If the Promoter is unable to contact the winner by 18/10/10 to claim fulfilment of the prize, that winner will forfeit the prize in its entirety. The prize shall then be awarded to another entrant whose answer is judged based on the same criteria stated above.  The Promoter will not be liable for a Winner who cannot be contacted and therefore forfeits their prize and following this no further correspondence will be entered to.

 

17) Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

 

18) If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

 

19) Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

 

20) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) if the Nokia Melbourne Event and/or the photography session are/is cancelled for any reason beyond the reasonable control of the Promoter or (g) use of a prize.

 

21) The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. The personal information may be transferred across international borders to server locations overseas Entry is conditional on providing this personal information. The Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

 

22) This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

24) The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
