2.The Contest commences on 1 November 2010 12:01am (AEST) and concludes on 3 December 11:59pm 2009 (AEST) ('the Contest Period')3.To enter, entrants must create a piñata at http://www.footlocker.com.au/pinatasmash, register via Facebook Connect and then pass the piñata on to individuals via Facebook and other social tools. No purchase is necessary. The person with the highest number of Facebook users who pass their piñata will win the Major Prize. All other entrants who receive a Piñata, logs into Facebook and then passes it to another person via the game's social tools is automatically entered into the draw. An individual can smash as many piñatas as he or she likes.4.The Promoter (Vice Australia Pty Ltd) Vice Australia Pty Ltd ABN 61 561 494 211, Level 1, 230 Smith St, Collingwood, VIC 3066 and Sponsors (adidas Australia Pty Limited, adidas New Zealand and Foot Locker Australia Inc) are not responsible for any lost, delayed, illegible, incomplete, misdirected, damaged, destroyed entries.
5.Entry is only open to Internet users who are Australian or New Zealand residents.
Entrants must be thirteen years of age or over. By entering this Contest, any minor warrants that they have the consent of their parent or legal guardian to participate in the contest in accordance with the terms and conditions.
6.Employees, officers, and directors (including immediate family members and members of the same household) of the Promoter and Sponsor and their respective affiliates and advertising agencies, media partners for the promotion of the Contest, featured celebrities who agree to promote the Contest, and any other organisations associated with this Contest are not eligible to participate.
7.PRIZES:
The winner of the 'Major Prize': Will win 1x Sony PlayStation 3 (AUD$486), 1x Nintendo Wii (AUD$298),1x Xbox 360 Slim (AUD$398),1x Nintendo DSI XL (AUD$278), And 1x AUD$1,000 gift voucher at EB Games.
First Prize Total Value AUD$2,460.
Five additional prize draws will be awarded. Each includes a Foot Locker store voucher valued at AUD$150 each and pair of adidas mini pair of shoes valued at AUD$15 each.
Total Minor Prize Value AUD$825.
Total Prize Pool Value AUD$3285.8.The Promoter and Sponsor reserve the right to substitute the Prizes in whole or in part for something of equal or greater value in the event that any component of the Prize is unavailable. Prizes are not transferable, deferrable, exchangeable or redeemable for product and cannot be taken in cash.
9.The Prize will be drawn on the 6/12/10 at 10.00 AM AEST at Vice Australia Pty Ltd ABN 61 561 494 211, Level 1, 230 Smith St, Collingwood, VIC 3066. Winners will be notified via Facebook, as well as in writing within two working days and winners will be published in the Public Notices section of The Australian newspaper on 8/12/10.
10.Subject to any written direction by State Gaming Authorities, should prizes remain unclaimed an unclaimed prize draw from all non-winning entries will take place at 10:00 am AEST 08/03/11 at Vice Australia Pty Ltd, Level 1, 230 Smith St, Collingwood, VIC 3066 with Winners notified in writing within two days and published in the Australian on 10/03/11.
11.The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The Promoter's decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the Promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way. The Promoter reserves the right to disqualify any entrant deemed to be cheating. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Contest terms and conditions may be disqualified. 12.Subject to any applicable law which cannot be excluded, the Promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.
13.INTERNET If for any reason the Internet entry portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Promoter or Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.
14.The Promoter and Sponsor reserve the right, at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest.
15.The Promoter and The Sponsor assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, the entries. The Promoter and The Sponsor are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter and Sponsors as a result of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to the entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest. In the event of a dispute, entries made by Internet will be declared made by the authorised Facebook account holder submitted at time of entry.
16.INFORMATION PROVIDED. The Promoter will collect personal information about persons who enter this Contest so that those persons can participate in the Contest and the Promoter can administer the Contest. The Promoter will disclose that personal information to organisations associated with this Contest (including the Sponsors). This information will not be disclosed to any other third parties. By entering this Contest, the entrant consents to the publication of their name on the web site should they win the contest in accordance with all clauses. Entrants can contact the Promoter if they wish to access the personal information that the Promoter holds about them.
17.DISCLAIMER. The Promoter and Sponsors reserve the right to withdraw, amend or terminate this Contest at any time without prior notice. The Promoter and Sponsors also reserve the right to cancel this contest at any time because of any printing or other error, or if it either of them suspects or finds evidence of tampering with any part of the Contest. Neither the Promoter nor The Sponsors shall not be liable for any errors or negligence that may arise or occur in connection with the Contest. Neither the Promoter nor the Sponsors are liable for injuries, death, damages or losses of any kind resulting from acceptance or use of the Prizes.
18.SUBJECT TO APPLICABLE LAWS. This Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
