Terms and Conditions 1. All information published by the Promoter concerning entry into the Competition and Competition prizes forms part of these terms and conditions of entry. Entry into the draw is deemed acceptance of these terms and conditions of entry. Entry is via
www.zucompetitions.com.au.
2. The promoter of the Competition is Zu Pty Ltd (ABN 83 008 903 642) of Level 2, 43 Stephenson St, Richmond, Victoria (the Promoter).
3. It is a condition of the Competition that the participant is an Australian resident and aged 18 years and over. Employees and relatives (as defined by the Corporations Act 2001 (the Act)) of employees of:
3.1. the Promoter;
3.2. service providers associated with the Competition; and
3.3. a related party or associated entity (as defined in the Act) of the persons specified in paragraph
3.1 and 3.2 above, are not eligible to enter the Competition.
4. To successfully enter the Competition, participants are required to:
4.1. log onto www.zucompetitions.com.au, and correctly answer the two questions asked. 4.2. Choose one (1) of the four (4) prize options; and 4.3. provide their details including name, date of birth, address, phone number and e-mail address. Once complete and valid, online registration will provide the participant one entry in the draw. Incomplete, incorrect and incomprehensible answers and details will, at the sole and absolute discretion of the Promoter, invalidate the participant’s entry into the Competition.

Each participant may only enter the Competition once. Multiple registrations will not provide multiple entries. Any participant who completes more than one online registration form per person will have all entries, apart from their original entry, deemed invalid.
6. After successfully completing an online registration and confirming that they have read, accepted and understood these terms and conditions, participants will then be given the opportunity to "Refer A Friend" by sending their friend an e-mail that contains a hyperlink to the Competition. The participant will automatically receive one (1) entry into the Competition for each referred friend who successfully enters the Competition in accordance with paragraph 3 above via the hyperlink. A limit applies of one (1) entry into the draw per friend referred. Incomplete, incorrect or incomprehensible answers and details will, at the sole and absolute discretion of the Promoter, invalidate the participant’s entry into the Competition. The referred friend must be a person that the participant has an existing relationship with and any spam or sham referrals (by the participant using an alias or different details) will be disqualified.
7. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
7.1. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control).
7 .2. Any theft, unauthorised access or third party interference.
7.3. Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.
7.4. Any variation in prize value to that stated in these Terms and Conditions.
7.5. Any tax liability incurred by a winner or entrant.
7.6. Use of a prize.
8. The cost of accessing the Competition website will be dependent on the participant’s individual Internet Service Provider and is the responsibility of the participant. The Promoter accepts no liability for a participant’s failure or inability to access the Competition website.
9. The Competition commences on Monday 4 October 2010 at 12:00 pm (AEST) and online registration commences at this time. All online registrations must be received by 11:59 pm (AEST) on Sunday 5 December 2010. All online registrations are deemed to be received at the time of receipt into the Promoter’s database, and not at the time of transmission by the participant.
10. The Major Prize draw will take place at the premises of Anisimoff Legal, Advertising, Marketing + Media Lawyers, Level 4, 448 St Kilda Rd, Melbourne VIC 3004 at 11:30 am (AEST) on Tuesday 7 December 2010. The draw will take place via an electronic drawing system and the winner will be determined by chance. All entrants will have equal chance of winning the competition. The Electronic Approval Number is AE17/2007. Winners will be notified in writing and by telephone and will have their details published in the Public Notices section of The Australian newspaper and on
www.zucompetitions.com.au on Monday 13 December 2010.
11. The major prize must be claimed by 11:00 am (AEST) on Wednesday 22 December 2010 and if the major prize remains unallocated or unclaimed, a further draw will be conducted on Thursday 23 December 2010 at the same time and place as the original draw (subject to any directions given under all State Regulations). In the event of a re-drawn winner, they will be notified in writing and by telephone and will have their details published in the Public Notices section of The Australian newspaper and on
www.zucompetitions.com.au on Wednesday 29 December 2010.
12. The total prize pool is valued at a maximum of AU$8,000.00. 13. There are 4 prize options, of which 1 prize will be won. At the time entering, participants will need to choose which of the 4 options they would like to win. The winning participant will win the prize options that they chose. The four (4) prize options are:
13.1. Escape Reality and Party in Las Vegas. This prize includes:
13.1.1. 2 x economy return airfares to Las Vegas from one of the following cities:

13.4.6. AU$1,000 spending money. All service providers shall be chosen by, and be at the absolute discretion of, the Promoter. The major prize is valued at a maximum of AU$8,000.
14. Travel must be taken at the time specified by the Promoter. Travel dates will be in February or March 2011. If the winner and travelling companion are, for whatever reason, unable to travel on the date nominated by the Promoter, or do not claim an element of the major prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the major prize or any element thereof.
15. The winner (and their travelling companion) are (unless specified otherwise) responsible for all other expenses including additional spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
16. The winner and their travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to the airport in the Departure City.
17. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos, booking and availability. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. The winner and their companion may not claim any Frequent Flyer points in relation to the provided flights.
18. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
19. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize and blogging about their experience (the Publications).
20. In consideration for the Promoter awarding the prize to the winner, the winner hereby agrees:
20.1. that he or she has no right of attribution or integrity of authorship with respect to the Publications; and
20.2. to assign to the Promoter all right, title and interest in and to all copyright in any material created by the winner and their companion pursuant to the winner’s participation in any aspect of the prize (Works); and
20.3. that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
21. The Promoter’s decision is final and binding and no correspondence will be entered into.
22. Prizes are not exchangeable or transferable and cannot be taken for cash (excluding the spending money).
23. All prize values are the recommended retail value as provided to the Promoter by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize of similar value subject to any written directions from a regulatory authority.
24. The Promoter and each of their related bodies corporate, associated agencies and companies associated with the Competition will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
25. Should a participant’s contact details change during the Competition period, it is the participant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
26. The Promoter, companies associated with the Competition and related parties and associated entities (as defined in the Act) thereof take no responsibility for any delays caused by airlines, natural disasters, acts of God, civil unrest, strikes and will not provide compensation for any such delays.
27. The Promoter reserves the right to request winners to provide proof of identity, Australian residency, residency at the nominated residential address and/or entry validity. Proof of identification, residency and entry considered suitable for verification is at the sole and absolute discretion of the Promoter. In the event that a winner cannot provide suitable proof of identity, the winner will forfeit their prize in whole and no substitute will be offered.
28. All entries become the property of the Promoter. The Promoter collects personal information about participants to enable participants to participate in this Competition (which may include disclosure to third parties for the purpose of processing and conducting the competition) but no further use of this information will be made without the participant’s prior consent. Each participant agrees to his or her personal information being disclosed to State and Territory Lottery Departments and being published (if he or she wins a prize) as required under the relevant lottery legislation.
29. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any written directions from the a regulatory authority.
30. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions subject to any written directions from a regulatory authority.
31. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in the Competition by any person who tampers with or benefits from any tampering with the entry process or with the operation of the Competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
32. The laws of the State of Victoria Australia, State regulatory bodies (and where applicable the Commonwealth of Australia) shall apply to the Competition.
