Conditions of entry
Information on how to enter and information on prizes forms part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these conditions of entry.

Entry is only open to individuals aged 18 years or older of Australian residency residing in New South Wales, Australian Capital Territory, Victoria, Tasmania, Queensland, South Australia, Northern Territory and Western Australia, who are the Primary Account Holder of a CPA Australia American Express Card ('Eligible Entrant').
Employees of the Promoter and American Express, their licensees, their agencies associated with this promotion, and their immediate families, are ineligible to enter.
Promotion commences 00.01 (AEDT) Friday 1 November 2010 and closes at 23.59 (AEDT) Friday 31 December 2010 ('Promotional Period').

Eligible Entrants must use their CPA Australia American Express Card to pay for their member renewal or subscription during the Promotional Period ONLY. The member renewal / subscription must be purchased from CPA Australia. A valid member renewal or subscription will equal one entry into the draw. There is a limit of one entry per Eligible Entrant. All valid member renewals or subscriptions will be placed in a barrel and the winning entries will be the first three to be randomly selected by the Promoter from the barrel.
An Eligible Entrant will only be eligible to win one (1) prize. An Eligible Entrant, who is a South Australian resident, is entitled to win more than one prize, subject to state regulation.
The draw will take place at CPA Australia Ltd, Level 20, 28 Freshwater Place, Southbank 3006 at 3.00 pm (15.00 AEDT) on Thursday 3 March 2011. The winners will be notified by phone and email within two days of each draw and their names will be published in The Australian on Tuesday 15 March 2011 and in the April 2011 issue of INTHEBLACK and on the Promoter’s website. Winners will also be notified in writing at their nominated address.
It is a condition of acceptance of the prize that the winning entrant’s credit account must be current (during the Promotional Period and at the time of the draws) and the winning entrant must not be in default under their credit contract.
There will be three prizes drawn. The total maximum prize pool for the promotion is valued at up to AU$8500 based on the total amount of Credits on Cards (inclusive of GST).
The first valid entry drawn will win a $5000 credit on an eligible American Express Card, which will be credited to the winner's American Express Account. This prize is valued at AU$5000.
The second valid entry drawn will win $2500 Credit on eligible American Express Card, which will be credited to the winner's American Express Account. This prize is valued at AU$2500.
The third valid entry drawn will win a $1000 Credit on an eligible American Express Card, which will be credited to the winner's American Express Account. This prize is valued at AU$1000.
The Promoter’s decision is final and no correspondence will be entered into.
The Promoter accepts no responsibility for any variation in any prize value. Prizes are not transferable or exchangeable and cannot be taken as cash in part and / or in full.
No responsibility is accepted for late, lost or misdirected entries.
All prizes must be claimed by 5.00 pm (AEDT) on Monday 6 June 2011. If any prizes remain unclaimed by this time, the Promoter will conduct such further draws at 3.00 pm (AEDT) on Thursday 16 June 2011 (”Unclaimed Prize Draw”) and the second chance winners will be notified by phone and email within two days of each draw and their names will be published in The Australian on Wednesday 29 June 2011, and in the August 2011 issue of INTHEBLACK and on the Promoter’s website. Winners will also be notified in writing at their nominated address.. This Unclaimed Prize Draw is subject to any written directions given under the various state and territory Department of Gaming regulations, including, but not limited to, Regulation 46 of the Lottery and Gaming Regulations 2008 (SA).
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking or using any of the prize, except for any liability which cannot be excluded by law.
The Promoter and the licensees are not liable for any tax implications (including any Fringe Benefits or Personal Income Tax) and Cardholders should seek their own independent financial advice.
If for any reason this competition is not capable of running as planned for reasons including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right (subject to any directions given under relevant lottery legislation) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the competition.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including but not limited to any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading any materials in this competition.
The Promoter reserves the right to request the winner to provide proof of identity and residency prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter.
In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any directions under relevant lottery legislation) to cancel, terminate, modify or suspend the promotion.
Privacy Consent. To provide this competition, the Promoter needs to collect personal information about the entrant. If the entrant does not provide the information requested, the Promoter may not be able to provide the entrant with the competition entry.
The Promoter is committed to protecting the privacy and security of the entrants’ information which it holds. The personal information provided in the entry email will be used by the Promoter to conduct the promotion / competition. If the information requested is not provided, the entrant may not participate in the promotion / competition. There is a right to access any personal information which the Promoter holds about the entrant, subject to any relevant Privacy legislation. Requests can be made for the correction of information which is inaccurate. Access and / or correction requests can be made to the Privacy Officer, CPA Australia Ltd, Level 20, 28 Freshwater Place Southbank 3006.
The entrant agrees that subject to the Privacy Act, the Promoter or their agents may do the following:
*Transfer or disclose personal information confidentially to the Promoter, its related companies or external organisations that provide services in relation to this competition. This includes transferring personal information to the USA or other countries for data processing and servicing.
*Request verification of Entrants’ account status and / or personal information from the Promoter’s Licensed Network Partners.
*Disclose entrants' personal information to State and Territory lottery departments.
*Publish winners' names as required under the relevant lottery legislation.
*Use the winner's personal information in any media for publicity purposes associated with the competition without any further payment or other compensation, unless the winner otherwise notifies the Promoter at time of accepting the prize.
This trade promotion is being conducted in accordance with the requirements of the departments of Gaming in each State in Australia and is authorised under NSW permit no: LTPS/10/09166, VIC permit no: 10/3355, ACT permit no: TP10/04238.1, SA permit no: T10/2323. States not mentioned do not require a permit for this type of promotion under the guidelines of those states.
