Terms and Conditions
1. Instructions on 'how to enter' and prizes form part of conditions of entry. Participation in this promotion is deemed acceptance of these conditions of entry.
2. Entry is open to residents of Australia, 18 years and over only.
3. Employees of the Promoter, and their immediate families and agencies associated with this promotion are ineligible to enter.
Only one (1) entry per person permitted.
4. The promotion commences November 1, 2010 and closes at 11:59pm (AEDST) on November 28, 2010. The judging will take place at the Promoterfs premises and will begin on November 29, 2010. The prize winner will be notified by email and/or mail using contact details provided in their entry. Notification will occur within 14 days of the judgesf decision. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit and originality.
5. To enter, entrants must during the promotional period, purchase issue 45 of TV WEEK magazine (cover date 06 November, 2010). Entry can then be made online only. To enter, simply visit www.tvweek.com.au and follow the prompts on the competition entry page, including your full name, address, daytime phone number, email address, and an answer in 25 words or less to the question eWhat is your favourite animal and why?h
6. Entrants must retain issue 45 of TV WEEK magazine as proof of purchase. Multiple entries are not permitted. The Promoters reserve the right to verify the validity of entries and entrants (including but not limited to an entrants identity, age, place of residence and proof of purchase) and to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. The judges' decision in relation to any aspect of the competition is final and binding on every person who enters. No correspondence will be entered into. By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant. A request to access, update or correct any information should be directed to the Promoter.
8. The best entry as determined by the judges will be deemed the winner and will win the major prize pack valued at up to $5701.25. The prize will include economy flights for the winner and their family (2 adults and 2 children 12 years and under) from the winnerfs nearest capital city (if required) to Melbourne, two daysf car hire, two nightsf accommodation on Phillip Island, VIP Penguin Parade experience, Phillip Island attractions passes which include access to Churchill Island Heritage Farm, Koala Conservation Centre, Nobbies Marine Centre, A Mazefn Things, Phillip Island Chocolate Factory and Wildlife Coast Cruises and a $500 ABC DVD pack which consists of a variety of ABD DVDs including Penguin Island. The next best 25 entries will each win a copy of Penguin Island on DVD, valued at $29.95 each.
9. Winners would need to make their own way from home to the airport and back. Prize excludes taxes and any other ancillary costs. Any cancellations or changes to travel plans may incur a cancellation and/or rebooking fee. This prize is not valid with any other offer, and must be taken intact. The promoter, may, without notice to the prize-winner, substitute any services. The prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present credit card or cash deposit at time of accommodation check-in.
10. Total prize pool is valued at up to $6,450.00 11. Prizes valued in Australian dollars. Prize values are the recommended retail value and are correct at the time of printing. Prizes are not transferable, exchangeable or redeemable for cash or other goods and services.
12. In the event that any prize becomes unavailable for reasons beyond the Promoterfs control, the Promoter may substitute a prize of equal or greater value.
13. The Promoter accepts no responsibility for any loss incurred in the event that the scheduled performances are cancelled, postponed or rescheduled for any reason whatsoever.
14. Where the prize is awarded in the form of a ticket/pass/ voucher, the Promoter shall not be liable for any ticket/pass/voucher that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the pass/ticket/voucher is subject to the terms and conditions specified on the voucher/ ticket/ pass. In the event that the winner is requested to provide proof of age or consent to attend, redemption of the ticket/ pass/ voucher will be subject to presentation of such proof. What constitutes identification and/or proof of consent is at the complete discretion of the promoter.
15. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to all relevant state and territory regulations) to either provide an alternative prize to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.
16. In the event that for any reason whatsoever the winner does not take all elements of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
17. Entries not completed in accordance with the terms and conditions or received after the closing date will not be considered. Indecipherable or incomplete entries will be deemed invalid.
18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulty or equipment malfunction (whether or not under the Promoterfs control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; and (f) use of a prize.
19. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to (a) disqualify any entrant; and/or (b) to modify, suspend, cancel or terminate the promotion, as appropriate. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries. By entering the promotion, the entrant consent to receipt of any email regarding the promotion, from the Promoter and other emails which inform the entrant of the Promoters other publications, products, services and events and to promote third party goods and services it may be interested in.

21. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this competition is governed by The Privacy Notice (see contents page for location in this issue).
