Terms and Conditions - TRAVELEX "INTERNATIONAL MILLIONNAIRE III"
1. The Promoter of "Travelex International Millionaire III" is Travelex Limited (ABN 36 004 179 953) of Level 12, 1 Margaret Street, Sydney NSW 2000 Australia. Telephone: (02) 8585 7300.
2. Information on HOW TO ENTER & PRIZES form part of these Terms and Conditions. Any entry not complying with these Terms and Conditions is invalid. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3. The Promotion commences 12.01am Australian Eastern Standard Time ("AEDST") 4th October 2010 in NSW, ACT, NT, SA, WA, QLD, VIC and TAS. All entries close 5.00 pm (AEDST) on 23rd December 2010 ("Promotion Period").
4. There will be two (2) components to this promotion as follows: (a) a consumer component ("Consumer Component"); and (b) a trade component ("Trade Component").
5. Entry into the Consumer Component is open to Australian residents and any visitors to Australia aged 18 years and over during the Promotional Period ("Eligible Consumers"). The Terms and Conditions of entry are based on Australian laws and there will be no consideration of the law in the visitors' usual place of residence. Employees of the Promoter, the Promoter's associated companies, the Promoter's agencies associated with this promotion and their immediate families are ineligible to enter the Consumer Component.
6. Entry into the Trade Component is open to employees of Participating Stores (excluding Australia Post agents and selected Harvey World Travel agents who work in a Harvey World Travel store that also has a Travelex implant) who are aged 18 years and over ("Eligible Employees"). A Participating Store is defined as a Travelex store and any other store listed on
www.travelexpromos.com.au as participating in this promotion.
7. Employees of the promoter who were responsible for preparing or approving these Terms and Conditions and or any employee responsible for organising or overseeing any draw, or exercising discretion of the Promoter over these terms and conditions, are ineligible to enter the Trade Component.
HOW TO ENTER
8. To enter the Consumer Component draw, Eligible Consumers must purchase a Travelex Cash Passport Card (available in AUD, NZD, GBP, EUR, SGD, HKD and USD) during the Promotional Period from any Participating Store in Australia; ("Transaction"). An Eligible Consumer must contact the Promoter at marketing@travelex.com.au if he or she wishes to decline to participate in this promotion.
9. Eligible Consumers will automatically be entered into the Consumer Component draw as follows when they meet the purchase criteria below:
a) Eligible Consumers whose Transaction totals between $100 and $2499.99 (AUD or foreign equivalent) receive one (1) entry into the Consumer Component draw.
b) Eligible Consumers whose Transaction totals between $2500 and $4999.99 (AUD or foreign equivalent) receive two (2) entries into the Consumer Component draw.
c) Eligible Consumers whose Transaction totals $5000 or more (AUD or foreign equivalent) receive three (3) entries into the Consumer Component draw. 10. Eligible Employees will receive automatic entry (or entries as applicable) into the Trade Component when they process a Travelex Cash Passport Transaction. The automatic entry will be determined by the Transaction total as set out above. Each Eligible Employee must use their own unique User Name to process the Transaction. Any Eligible Employee who uses a shared User Name will not be eligible for entry. 11. All Eligible Consumers must keep their receipt or purchased Cash Passport card for validation of their Transaction to claim a Prize (defined below) if they are selected as being the Consumer Winner (defined below). Failure to produce proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Consumer's entries into the Consumer Component draw and forfeiture of any right to a Prize. The Eligible Consumer's Purchase receipt(s) or Cash Passport card must clearly specify the store of purchase and that the purchase was made during the Promotional Period. 12. Eligible Consumers may enter the "Consumer Component" draw as many times as they like provided each entry is from a separate Transaction ("Entry Criteria"). The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Eligible Consumer or Eligible Employee for tampering with the entry process, or for submitting an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
13. Entries that, at Promoter's absolute discretion, are incomplete, defaced, damaged or incomprehensible will be deemed invalid.
DRAWS
14. The Consumer Component draw will take place at Midday AEST at Prime Focus, Suite 104/55 Beach Street Port Melbourne 3207 on 17th January, 2011. The first valid entry drawn in the Consumer Component will be awarded the Prize ("Consumer Winner").The Consumer Winner will be notified by telephone and mail and their name and postcode (if applicable) will be published in The Australian on 28th January, 2011. The Consumer Winner agrees that their image may also appear at
www.travelexpromos.com.au as determined by the Promoter in its absolute discretion.
15. Subject to clause 16 below, the Eligible Employee who performed the winning Eligible Consumer's Transaction (as per the Transaction records) will be deemed the winner of the Trade Component ("Trade Winner"). The Trade Winner will be notified by telephone and mail and their name and postcode (if applicable) will be published in The Australian on 28th January, 2011. The Trade Winner agrees that their image may also appear at
www.travelexpromos.com.au as determined by the Promoter in its absolute discretion.
16. If the Consumer Winner conducted their Transaction at an Australia Post outlet, all Eligible Employees (refer to clause 6) will be entered into a draw, which will take place at 1pm AEDST at Prime Focus, Suite 104/55 Beach Street, Port Melbourne 3207 on 17th January, 2011 to determine the Trade Winner. In the instance that the Consumer Winner conducted their Transaction at a Travelex implant within a Harvey World Travel store, the Travelex employee who performed that Transaction will be deemed the Trade Winner.
17. The Consumer Winner and Trade Winner (together referred to as "Winners") will each win the prize ("Prize") being the opportunity to attend an event held at Sydney, NSW at 1.00pm AEDST for the Consumer Winner and 2.00pm AEDST for the Trade Winner on 30th March 2011 ("Event"). If the Consumer Winner or Trade Winner resides in Australia:
The Promoter will provide necessary return economy flights for two (2) people between the relevant Consumer Winner or Trade Winner's nearest state capital and the Event and one (1) nights three (3) star accommodation for two (2) people (twin share) located near the Event. The travel and accommodation is valued at up to AUD$2,000 depending upon the residential location of the Consumer Winner or Trade Winner. If the Consumer Winner or Trade Winner resides within 200kms of the Event, then transport and accommodation may be provided at the Promoter's absolute discretion.
If the Consumer Winner resides in any other country:
If the Consumer Winner resides in any country outside of Australia the Promoter will reimburse the Consumer Winner, for an amount of up to but no greater than AUD$2,000, for the cost of return economy flights for the Consumer Winner (and their companion if applicable) between the Consumer Winner's nearest International airport and the Event and one (1) nights three (3) star accommodation for two (2) people (twin share) located near the Event. Additional spending money, accommodation, meals, transfers, ground transportation, taxes, travel insurance, visas, passports, travel or related insurance, gratuities, merchandise and all other ancillary and incidental costs associated with attendance of the Event are the responsibility of the Consumer Winner and Trade Winner. The Promoter may require the Consumer Winner and Trade Winners to sign a waiver of liability and an indemnity in the form determined by the Promoter in its absolute discretion. If for whatever reason the Consumer Winner or Trade Winner does not agree to sign such documentation, then that Consumer Winner or Trade Winner will forfeit the Prize.
PRIZE/S
18. At 1.00pm AEDST at the Event the Consumer Winner will be invited first to choose and open one (1) envelope from a selection of 300 envelopes. Once the Consumer Winner has selected and opened their envelope, at 2.00pm AEDST the Trade Winner will then be invited to choose and open one (1) envelope from the remaining 299 envelopes. One (1) of the selection of 300 envelopes will contain a message awarding a cheque for AUD$1,000,000 and the remaining 299 envelopes will contain a message awarding a cheque in Australian Dollars for the Australian Dollar equivalent of one (1) of either: one (1) million rupees, one (1) million forints, one (1) million yen, or one (1) million rubles as relevant, (in accordance with the exchange rate based on the rates set out in the table below). If any Winner is detained, delayed or unable to attend the Event for any reason, they may nominate a proxy to attend the Event on their behalf to choose an envelope. In the event that a Winner or their proxy is unable to attend the Event, the Promoter may in its absolute discretion nominate a proxy to attend the Event on the Winner's behalf to choose an envelope. The amount stipulated in the envelope will be awarded to the initially drawn Consumer Winner or Trade Winner (which ever is applicable). The nominated proxy must be appointed in writing by the Consumer Winner or Trade Winner and must provide valid proof of identification at the Event.

Total 300 Envelopes 19. The odds of the Consumer Winner selecting the envelope containing the AUD$1,000,000 prize are 1 in 300. If the envelope containing the AUD$1,000,000 prize is not selected by the Consumer Winner, the odds of the Trade Winner selecting the envelope containing the AUD$1,000,000 prize will be 1 in 299. The odds of being drawn as a Winner may be significantly higher than the odds of the drawn Winner selecting the envelope containing the AUD$1,000,000 prize, and will depend upon the number of entries received.
20. Travel components are subject to the standard terms and conditions of individual service providers. The Consumer Winner or Trade Winner may be required to present his or her credit card at time of accommodation check in. If for any reason a Consumer Winner or Trade Winner does not take the travel component of the Prize or an element of the travel component at the time stipulated by the Promoter, then that component will be forfeited and will not be redeemable for cash.
21. All travel is subject to availability at all times and maybe dependent on select seat class with airlines or specific room category availability with accommodation partner. Blockout periods apply. All bookings must be made 60 days in advance of travel. If the Consumer Winner resides outside of Australia, the Consumer Winner and any companion (if applicable) must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure. The Consumer Winner and Trade Winner are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. Visas, valid passports, additional spending money, additional accommodation, meals (other than those included) and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the travel component of the Prize as described above are the responsibility of the Consumer Winner and Trade Winner and his/her nominated travelling companions (if applicable) as incurred. It is the Consumer Winner and Trade Winner's responsibility to organise transport to/from the airport departure/return point. The Consumer Winner and Trade Winner and travel companions (if applicable) must have valid travel insurance for their period of travel.
22. If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
23. Total Prize pool is valued at up to AUD$1,040,607.98 (depending on the message in the envelopes selected from the 300 envelopes by the Consumer Winner and Trade Winner or the Consumer Winner or Trade Winner's proxy at the Event and the travel arrangements necessary for the Consumer Winner and Trade Winner to attend the Event).
24. The Prize is not transferable and cannot be taken as cash, unless otherwise stipulated.
GENERAL
25. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Consumer Winner or Trade Winner or Eligible Consumer or Eligible Employee; or (f) a Prize (or any part of any Prize).
26. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Consumer or Eligible Employee; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
27. Any cost associated with accessing the promotional website is the Eligible Consumer or Eligible Employee's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Consumer or Eligible Employee to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Consumer or Eligible Employee invalid.
28. As a condition of accepting a Prize (or any part of any Prize), the Consumer Winner or Trade Winner (and any companion/s) must sign any legal documentation as and in the form required by the Promoter / Prize supplier / organisers in their absolute discretion including but not limited to a legal release and indemnity form. If for whatever reason the Consumer Winner or Trade Winner does not agree to sign such documentation, then he or she will forfeit the Prize.
29. The Promoter is not responsible for any tax consequences to an Eligible Consumer or Eligible Employee for accepting a Prize (or any part of a Prize) included in this promotion.
30. All entries become the property of the Promoter. Eligible Consumers' and Eligible Employees' personal information will be collected for the purposes relating to the administering of the draw. The Promoter may also give its service providers located locally and/or overseas access to this information for related purposes. All personal information will be held in accordance with the Travelex Privacy Policy available at

31. The Travelex Cash Passport Card is subject to the Travelex Cash Passport Terms and Conditions or Product Disclosure Statement (as relevant). Fees and charges apply to the use of the Travelex Cash Passport Card and these are set out in the Travelex Cash Passport Terms and Conditions or Product Disclosure Statement (as relevant).
32. Promoter's decision is final and no correspondence will be entered into.
33. In the event that the original Consumer Winner and Trade Winner cannot be contacted, and the selected Prize remains unclaimed by close of business on 1st July 2011, the Promoter may conduct an unclaimed Prize draw at the same time and place as the original draw on 4th July, 2011 to award the Prize, subject to any written directions from any regulatory authority. In the case of an unclaimed Prize in the Consumer Component, the first valid entry drawn in the unclaimed Prize draw will win the amount shown on the message in the envelope selected by the Consumer Winner (or proxy) at the Event. In the case of an unclaimed Prize in the Trade Component, the first valid entry drawn in the unclaimed Prize draw will win the amount shown on the message in the envelope selected by the Trade Winner (or proxy) at the Event. The winner of any unclaimed Prize will be notified in writing and have their name and postcode published in The Australian on 13th July, 2011 and also appear at
www.travelexpromos.com.au.
34. If the Consumer Winner or Trade Winner is an Australian or New Zealand resident, all Prizes which are a monetary amount will be paid within 28 days of being won, by means of a crossed cheque payable to the Consumer Winner or Trade Winner in Australian Dollars, or if the Consumer Winner or Trade Winner so requests, by means of electronic transfer of funds to any nominated account.
35. If the Consumer Winner is a visitor to Australia or New Zealand, all Prizes to which are a monetary amount will be paid within 35 days of being won, by means of a crossed cheque payable to the Consumer Winner in Australian Dollars, or if the Consumer Winner so requests, by means of electronic transfer of funds in Australian Dollars to any nominated account.
36. By entering the Promotion, the Consumer Winner and Trade Winner agree to the use of their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
