Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian businesses ("Entrants". Notwithstanding any other provision within these Terms and Conditions, any entrant that has overdue money owed to the Promoter, or its account with the Promoter is in arrears, as at the date of the draw, will be deemed invalid and will not be eligible to win the prize.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter' discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Promotion commences on 25/10/10 and closes 10:00pm AEST on 31/08/11 ("Promotional Period").

www.sagemybusiness.com.au during the Promotional Period, follow the prompts to register for a free 90 day trial to 'Sage My Business' ("the 90 Day Trial") and input the requested details to receive one (1) entry in the draw. Entrants are only able to register for the 90 Day Trial on one (1) occasion. Any individual who enters on behalf of an entrant warrants that they are authorised do so by the entrant and act as the entrant's authorised representative for the purpose of this promotion. Entrants acknowledge that the 90 Day Trial is subject to additional terms and conditions, which will be available at
www.sagemybusiness.com.au.
Selected entrants that are existing clients of the Promoter, i.e. selected clients of the Promoter as at the commencement of the Promotional Period ("Existing Businesses"), may be sent a promotional email inviting them to enter with a unique referral code.
Existing Businesses can receive additional entries for referring the promotion to other businesses in Australia in accordance with these Terms and Conditions. An Existing Business can receive one (1) additional entry for every five (5) eligible businesses that agree to register for the 90 Day Trial and quote the Existing Business' unique referral code at the time of registration. To refer, the authorised representative of the Existing Business must, once the entry is completed in accordance with Clause 6, provide the details of the 90 Day Trial to a contact at another business that resides in Australia by contacting their contact at the other business ("the Referred Business") and providing the unique referral code provided in the promotional email sent to the Existing Business by the Promoter. In contacting the other business, the authorised representative must not infringe any law, including the Spam Act (Cth) or Do Not Call laws. Only Existing Businesses can receive additional entries for referring businesses. A Referred Business may only be referred by the same Existing Business once. The Existing Business will only receive an additional entry in the draw, once five (5) eligible businesses, which the Existing Business referred, registers to the 90 Day Trial in accordance with the process set out in these Terms and Conditions.
Referred Business: To enter, the Referred Business, must during the Promotional Period, undertake the steps outlined in Clause 6. In addition, it can supply the unique referral code supplied by the Existing Business to it, and if the Referred Business does so, this will count towards the number of businesses referred by the Existing Business for the purpose of this promotion. A Referred Business may only sign up to receive the 90 Day Trial on one (1) occasion. The Referred Business will receive (1) entry in the draw for registering to the 90 Day Trial in accordance with the above process.
The Promoter accepts no responsibility if a Referred Business does not register to the 90 Day Trial during the Promotional Period, or does not enter the unique referral code supplied to it by an Existing Business, or inputs an incorrect or invalid unique referral code. Incomplete or indecipherable entries and referral codes will be deemed invalid.
The draw will take place at Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street, St Leonards NSW 2065 on 07/09/11 at 11:00am AEST. The winning business will be notified in writing and the winning business' name will be published in The Australian on 21/09/11. The Promoter's decision is final and no correspondence will be entered into.
The first valid entry drawn will win a $4,500 Flight Centre voucher. Any ancillary costs associated with redeeming the Flight Centre voucher are not included and any additional cost above $4,500 is the responsibility of the winner. Any unused balance of the Flight Centre voucher will not be awarded as cash. Redemption of the Flight Centre voucher is subject to any terms and conditions of the issuer including those specified on the Flight Centre voucher.
The prize will be awarded to the winning business, which it may transfer to any of its employees.
If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is $4,500. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
A draw for the prize, if unclaimed, may take place on 08/12/11 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if any, will be notified in writing and the winner's name will be published in The Australian on 22/12/11.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the
promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant?s responsibility and is dependent on the Internet service provider used.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or business; or
(f) use of the prize.
It is a condition of accepting the prize that the winning business and the person from the winning business who ultimately receives the prize, signs a legal release in a form determined by the Promoter.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning individuals who act as authorised representatives. Authorised representatives should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
