TERMS AND CONDITIONS OF ENTRY

1. Information on how to enter and prizes form part of these conditions of entry. By entering this competition, entrants agree to abide by these terms and conditions.

2. Entry is only open to Australian residents (excluding NT) over 18 years of age who reside in Australia. Employees and their immediate families of the Promoter and its agencies associated with this promotion are ineligible to enter.

3. These terms and conditions will be posted on the Emeri website www.emeri.com.au for the duration of the competition.

4. Promotion commences at 12.01am, AEST on 1 November 2010. Entries close at 11.59pm AEST on 31 December 2010 (the “Promotional Period”). No late entries will be eligible.

5. To enter, you must, during the Competition Period:

(a) go to www.emeri.com.au;

(b) complete the online entry form by filling in all fields required including your first and last name, your full mailing and email address and your telephone and other contact details; and

(c) provide a statement, in 25 words or less, telling us “why you love celebrating with Emeri Sparkling”.

6. Incomplete, indecipherable or illegible entries will be deemed invalid. Neither De Bortoli Wines nor any of its associated companies or personnel are liable or responsible for late, lost or misdirected entries.

7. Only one entry per person permitted. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

8. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit. Judges’ decision is final and no correspondence will be entered into.

9. The best entry, as determined by the judges’, will win a Mecca Cosmetica voucher valued at $500 and a six pack of Emeri Sparkling Wine valued at $78. 10 runner up entrants will each receive a twin pack of Emeri Sparkling Wine valued at $26. Total prize value is $838. Prizes are not transferable or exchangeable and cannot be taken as cash.

9. The entries will be judged by a nominated representative of De Bortoli Wines on 21 January 2011 at 6-8 Research Drive Croydon VIC 3136.

10. De Bortoli Wines will bear the reasonable cost of freight to the winner’s nominated delivery address within Australia.

11. All other costs and expenses associated with the prize beyond the specified prize components will be the responsibility of the competition winner.

12. Winner/s will be notified by mail.

13. Neither De Bortoli Wines nor any of its associated companies or personnel will be responsible or liable if for any reason beyond their reasonable control any element of any prize is not provided.

14. De Bortoli Wines reserves the right to exclude any person from this competition for any reason whatsoever.

15. In all matters all decisions of De Bortoli Wines will be final and cannot be contested. No correspondence or discussions will be entered into.

16. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. The Promoter may use the entrants’ names, addresses and literary pieces for any commercial purpose.

17. The promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol guidelines that are available at www.nhmrc.gov.au
