TERMS AND CONDITIONS

“CHERRIES WIN $1,000 EVERY WEEK FOR 10 WEEKS” PROMOTION

1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.Entry is only open to Australian residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this promotion.

3.Employees (and their immediate families) of the Promoter, participating stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4.Promotion commences 22/11/2010 and ends 11:59pm AEDST on 30/01/2011 (“Promotional Period”)

5.To be eligible to enter, individuals must, during the Promotional Period, purchase 250g or more of cherries in a single transaction from any participating store. For the sake of clarity, a “participating store” is any grocery store that is displaying promotional material advertising the promotion.  (I found it at my local IGA store)

6.To enter, eligible entrants must then, during the Promotional Period, either:

a.visit www.lovesummerlovecherries.com.au, follow the prompts to the competition entry page, complete the requested details including store of purchase and receipt number, and submit the fully completed online entry form; or

b.(b) send an SMS to 1997 7666 containing their full name, state of residence, store of purchase and receipt number. Premium SMS cost is 55c. Entrants must have premium service access. SMS entrants under 18 years old must obtain account holder's consent. SMS helpline: 1800 205 596.

7.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

8.Incomplete or indecipherable entries will be deemed invalid. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.

9.Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per transaction; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of one (1) entry per household/mobile account per day is permitted.

10.Entrants must retain their original purchase receipt(s) (or in the case of Woolworths customers, a photocopy of their original purchase receipts) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.

11.There will be one (1) Instant Prize, randomly awarded during each week of Promotional Period (10 in total) and one (1) Daily Prize Draw conducted for each day of the Promotional Period (70 in total). There will also be two (2) Woolworths Bonus Draws conducted for the promotion, for customers of Woolworths only.

Consumers who purchase 250g or more of Cherries through a participating Woolworths store will automatically be entered into the exclusive Woolworths Bonus Prize Draw for the chance to win 1 of 3 $1,000 Woolworths WISH Gift Cards in 2 monthly draws.

12.Entrants will be notified immediately in writing (via return SMS or online, depending on method of entry) whether or not they are a winner of an Instant Prize. Entrants who are not winners of Instant Prizes will be entered into the next available Daily Prize Draw. Entrants who purchased their products from a participating Woolworths store will also be entered into the next available Woolworths Bonus Draw.

13.Entries for each Daily Prize Draw close at 11:59pm AEDST on each day of the Promotional Period. Daily Prize Draws will be conducted at 10am AEDST on each business day from 23/11/2010 to 31/01/2011 inclusive. Draws for entries received on Fridays, Saturdays and VIC public holidays will be conducted the following business day.

14.Entries into Woolworths Bonus Draws close at 11:59pm AEDST on 31/12/2010 and 30/01/2011. Woolworths Bonus Draws will be conducted at 10am AEDST on 07/01/2011 and 04/02/2011.

15.All draws will be conducted at MessageMedia Interactive, Level 22, 385 Bourke Street, Melbourne VIC 3000. Non-winning entries in each Daily Prize Draw will be entered into any subsequent Daily Prize Draws. Non-winning entries in the first Woolworths Bonus Draw will NOT be entered into the subsequent Woolworths Bonus Draw. In the event no entries are received in a particular draw, the prize will be awarded in the unclaimed prize draw.

16.All winners will be notified in writing. SMS winners will be contacted by SMS and phone and the Promoter will record their address details so that the prize may be awarded. Winners of prizes valued at over $250 will be published in The Australian on 23/12/2010, 21/01/2011 and 11/02/2011.

17.The Promoter's decision is final and no correspondence will be entered into.

18.Instant Prizes: 10 x $1,000 branded pre-loaded EFTPOS cards.

19.Daily Prizes: The first valid entry drawn in each Daily Prize Draw will each win a $100 branded pre-loaded EFTPOS card.

20.Any ancillary costs associated with redeeming any EFTPOS card are not included. Any unused balance of an EFTPOS card will not be awarded as cash. Redemption of an EFTPOS card is subject to any terms and conditions of the issuer including those specified on any EFTPOS card.

21.Bonus Woolworths Prizes: The first three (3) valid entries drawn in each Bonus Woolworths Draw will each win a $1,000 Woolworths WISH Gift Card. Woolworths Limited is the issuer of the WISH Gift Card but is not the promoter of the promotion and is therefore not responsible for the prizes, products, or services under the offer or the fulfilment of the offer terms. Woolworths Limited is responsible for the fulfilment of the terms and conditions of the WISH Gift Card. WISH Gift Cards are redeemable at participating stores only. 22.If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner's behalf.

23.If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

24.Total prize pool value is $23,000. Prizes, or any unused portion, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

25.A draw for any unclaimed Instant Prizes or Daily Draw Prizes may take place on 04/05/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. In the event there are any unclaimed Woolworths Bonus Draw prizes, a separate unclaimed prize draw will also be conducted at the same time, utilising Woolworths customer entries only. Winners (if any) will be notified in writing and winners' names (for prizes valued at over $250) will be published in The Australian on 18/05/2011.

26.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

27.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

28.Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

29.Quality control errors will not invalidate an otherwise valid Instant Prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all Instant Prize claims in excess of the advertised Instant Prize pool will be honoured. Any Instant Prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.

30.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

31.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
