Terms and Conditions
Escape to Fiji Promotion – Conditions of Entry1. Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the Escape to Fiji Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
2. The Promotion commences 15 November 2010 at 00:00am AEST and closes 31 January 2011 at 11.59pm AEST (Promotion Period).
3. Entry is only open to Australian residents who are members of Kleenex Mums. If you are not a member of Kleenex Mums you can join online at
www.kleenexmums.com.au. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
Entry
4. To enter (Entry) the entrant must:
(1) purchase any Kleenex Cottonelle for Kids Flushable Wipes product (42 sheet tub or 84 sheet refill) (Purchased Product) from a supermarket during the Promotion Period;
(2) retain the barcode from the Purchased Product (Purchase Barcode) and the receipt from the supermarket showing the qualifying Purchased Product and the date and time of the purchase (Purchase Receipt), as proof of purchase;
(3) log onto www.poopooisland.com.au (PooPoo Island Promotional Website);
(4) click on the competition link on the PooPoo Island Promotional Website to enter the Promotion;
(5) complete all the information requested for Entry into the Promotion including:
(a) personal contact information;
(b) Purchase Barcode number; and
© Purchase Receipt number;
(6) follow the link in the email sent by the Promoter to confirm Entry into the Promotion prior to the end of the Promotion Period.5. Entries are deemed to be received by the Promoter at the time the entrant confirms the Entry by following the link in the email sent by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
6. An entrant may enter more than once. However, the Purchase Barcode and the associated Purchase Receipt may be used for one (1) entry only.
7. All claims and entries are the property of the Promoter.
8. The Promoter takes no responsibility for any lost, stolen, damaged, late or misdirected entries or for any delays or failures in any delivery service or equipment.
9. The Promoter reserves the right to validate and check the authenticity of entries. The Promoter may disqualify any entrant for tampering with the entry process, or who submits an entry that is not in accordance with these Conditions of Entry. Any entry made with a stolen, forged, mutilated, unrecognised or tampered with Purchase Barcode or Purchase Receipt is void. The entrant must retain his or her original Purchase Barcode and Purchase Receipt to claim the Prize.
10. Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will void all the entrant’s entries.
11. The entrant MUST, within seven (7) days of being asked, provide to the Promoter documents requested by the Promoter to establish eligibility to enter, including original Purchase Barcode, original Purchase Receipt, evidence of residence or identity. If the entrant does not do so, the Promoter may, in its absolute discretion, declare any or all of the entrant’s entries invalid
Draws
12. All valid entries received during the Promotion Period will be placed into the draw to be drawn via electronic draw tool at 10.00am at Kimberly-Clark Australia, 52 Alfred Street, Milsons Point NSW 2061 on 1 February 2011.
13. The first valid entry drawn electronically at random will win the Prize (Prize Winner).
14. The Prize Winner will be notified in writing by e-mail on 3 February 2011. The name of the Prize Winner will be published on the PooPoo Island Promotional Website by 4 February 2011 and published in The Australian on 8 February 2011.
15. The Promoter may conduct such further draws as are necessary for an unclaimed prize at Kimberly-Clark Australia, 52 Alfred Street, Milsons Point NSW 2061 on 2 May 2011 at 10.00am AEST, subject however to any directions given by any applicable gaming authorities. The winner of any unclaimed prize will be notified in writing by e-mail within two (2) days of the relevant draw and details of the winner of any unclaimed prize will be published on the PooPoo Island Promotional Website on 4 May 2011 and in The Australian on 4 May 2011.
Prizes
16. The Prize consists of:
(1) 1 return economy flight on Pacific Blue for 2 adults and 2 children under the age of 12 years from Sydney International Airport to Nadi, Fiji Airport;
(2) 1 transfer for 2 adults and 2 children from Nadi, Fiji Airport by private car and then helicopter to Castaway Island Resort (Accommodation);
(3) 7 nights quad share accommodation for 2 adults and 2 children in a Beach Front Bure at the Accommodation;
(4) Breakfast, lunch and dinner for 2 adults and 2 children for seven (7) days at the Accommodation;
(5) Welcome drinks on arrival at the Accommodation for 2 adults and 2 children;
(6) Complimentary use of the snorkelling equipment at the Accommodation for 2 adults and 2 children (refundable deposit for use of the equipment applies);
(7) Complimentary use of all non-motorised water sports equipment including catamarans, windsurfers, glass bottom boat, paddleboards and spy boards for 2 adults and 2 children at the Accommodation;
(
Complimentary use of championship sized tennis court for 2 adults and 2 children at the Accommodation;
(9) Invitation to weekly poolside party for 2 adults and 2 children at the Accommodation;
(10) 1 transfer for 2 adults and 2 children from the Accommodation by helicopter and then private car to Nadi, Fiji Airport; and
(11) AUD$2,000 spending money.17. The Prize does not (except as expressly stated) include:
(1) any airport departure taxes;
(2) any transport between the traveller’s residence and Sydney International Airport;
(3) any overnight accommodation or other expenses prior to departure from or after return to Sydney International Airport;
(4) any other transport or accommodation;
(5) any incidental Accommodation charges (such as telephone calls, food and beverages);
(6) any additional spending money;
(7) any insurance (including travel or health insurance);
(
any costs associated with any passport, visa or other requirements for entry into Fiji and return to Australia;
(9) any vaccinations or other medical or health related services; and
(10) any other ancillary costs which may be incurred by the Prize Winner or the Prize Winner’s Guests in relation to the Prize.
18. The Prize must be taken between March 2011 and March 2012. All the components of the Prize except for the AUD$2,000 spending money (Travel Component) will be provided by Fiji Island Tours (who is a division of Lamil Pty Ltd). Fiji Island Tours will liaise directly with the Prize Winner to organise the Travel Component.
19. The Prize Winner’s nominated dates must be provided to Fiji Island Tours, who will make all bookings and issue tickets and vouchers. The Prize Winner and the Prize Winner’s Guests must travel on the same flight and stay in the same room at the Accommodation.
20. The Travel Component (and each part of the Travel Component) is subject to booking and availability at the time of booking. The Promoter accepts no responsibility for the cancellation or rescheduling of flights. The Promoter reserves the right to substitute the Travel Component with a prize of equal or greater value (including where the Travel Component is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
21. The total Prize pool is up to a maximum of $13,100.00. The value of the Prize is accurate and based upon the recommended retail price(s) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.
22. The AUD$2,000 spending money component of the Prize will be awarded in the form of a crossed cheque made out to the Prize Winner, or if the Prize Winner requests, in the form of an electronic funds transfer to an account nominated by the Prize Winner. It is the responsibility of the Prize Winner to advise the Promoter of their correct details for payment. The Promoter will not be responsible for any funds transmitted to an incorrectly nominated account.
23. The Travel Component must be taken by the Prize Winner and 1 adult and 2 children 12 years of age or under nominated by the Prize Winner as the Prize Winner’s Guests. If the Prize Winner wants to change the family configuration of the Prize Winner’s Guests, the Prize Winner must liaise directly with Fiji Island Tours and pay any additional costs associated. The ability of the Prize Winner to change the family configuration of the Prize Winner’s Guests is at the absolute discretion of Fiji Island Tours.
24. To take the Travel Component, the Prize Winner and the Prize Winner’s Guests must, if requested by the Promoter, agree to and sign:
(1) an eligibility form confirming their compliance with these Conditions of Entry, eligibility to accept the Trave Component and participate in the Travel Component; and
(2) a liability release and/or indemnity in favour of the Promoter and/or any entity associated with this Promotion in a form to be determined in the absolute discretion of the Promoter.
25. For those of the Prize Winner’s Guests who are under 18 years of age, the Prize Winner must ensure that a parent or guardian of the Prize Winner’s Guests agrees to and signs the documents referred to in paragraphs 24(1) and 24(2) above. If the Prize Winner or the Prize Winner’s Guests do not comply with this condition the Prize Winner will forfeit the Travel Component.
26. The Promoter may require each of the Prize Winner’s Guests or, for those of the Prize Winner’s Guests who are under 18 years of age his or her parent or guardian, to confirm in writing that he or she agrees to comply with these Conditions of Entry. If a Prize Winner’s Guests do not agree to comply with any of these Conditions of Entry, the Prize Winner will forfeit his or her Prize.
27. The Travel Component includes vouchers redeemable through Fiji Island Tours. The Promoter excludes any liability for any voucher or ticket that has been lost, stolen, damaged or tampered with in any way. Redemption of each voucher is subject to the terms and conditions imposed by Fiji Island Tours from time to time.
28. If for any reason the Prize Winner and the Prize Winner’s Guests are unable to travel on their nominated dates, then the Travel Component will be forfeited by the Prize Winner.
29. All components of the Travel Component must be taken together as a single trip to be booked by Fiji Island Tours. Any part of the Travel Component that is not taken for any reason is forfeited.
30. If the Promoter determines, in its absolute discretion, that the Prize Winner is not in the necessary condition to safely participate in the Travel Component, the Promoter reserves the right to refuse to award to the winner any part of the Travel Component.
31. It is the Prize Winner’s and the Prize Winner’s Guests’ personal responsibility to ensure that they have valid documentation, including but not limited to valid passport and visas, which meet the requirements of immigration and other government authorities in Fiji. Any fines, penalties, payment or expenditure incurred as a result of such document not meeting the requirement of these authorities will be the sole responsibility of the Prize Winner and the Prize Winner’s Guests.
32. The Prize is not transferable or exchangeable and cannot be redeemed for cash (except as expressly stated in the Conditions of Entry). The Prize must be taken as offered and cannot be varied (except as expressly stated in the Conditions of Entry).
33. The Promoter accepts no liability or responsibility for any loss incurred by the Prize Winner or any other person as a result or in connection with the Prize or part of the Prize being unavailable for any reason.
General
34. The Promoter has no control over internet or mobile telephone communications, network lines, bugs/ viruses and server problems and accepts no responsibility for any problems associated with them, for whatever reason.
35. All tax liability arising as a result of accepting the Prize is the responsibility of the Prize Winner.
36. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of the Promotion or receiving, taking or using the Prize except for any liability which cannot be excluded by law.
37. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the Conditions of Entry.
38. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
39. The Prize Winner and the Prize Winner’s Guests agree to participate in any news media activities surrounding the Promotion. The Promoter reserves the right to use the Prize Winner’s and the Prize Winner’s Guests’ names, voices, images and likenesses for advertising and publicity purposes in any media in perpetuity without additional compensation.
40. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion, and to third parties as required by law. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request). By entering into this Promotion, each entrant also consents to the Promoter using his or her personal information for future marketing purposes, unless otherwise advised by the entrant. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
