CONDITIONS OF ENTRY
1. Information on how to enter and the prize form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via Internet only.
2. Any costs associated with accessing the promotional website remain the responsibility of each entrant and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.

Entry is only open to Australian residents aged 18 years or over who have not previously held a paid subscription to the Eureka Report and who have (or can obtain) a passport which is valid for at least 6 months from 01/02/2011, who are able to take the major prize on the dates specified by the Promoter and who are permitted entry into Hong Kong and Macau. Employees (and their immediate families) of the Promoter, its sponsors, related businesses, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter. The promotional period commences at 12:01am (AEST) on 01/12/2010 and closes 11:59pm (AEST) on 17/01/2011.
4. To enter the promotion, eligible entrants must, during the promotional period take out a new annual membership to the Eureka Report by completing and submitting the online subscription form at
www.strikegoldwitheureka.com.au and paying the annual membership fee of $A385 (including GST) upfront in full using a valid credit card Eligible entrants will be required to provide all mandatory information required for the promotion in order to complete their entry. Such information may include their name, address, current and valid email address and telephone number.

Eligible entrants may only enter the promotion once. Any subsequent entry after the first valid entry received from an entrant will be deemed invalid. Internet entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the promotional period.
6. One valid entrant will be drawn at random to become the winner. The draw will take place at RDI Marketing, Unit 1, 2 Bromham Place Richmond VIC 3121 at 12:00pm (AEST) on 21/01/2011. The Promoter’s decision is final and no correspondence will be entered into.
7. The prize winner for the draw will be notified by telephone and email and the winner of prize will have their name suburb and State published in The Australian on 28/01/2011. All reasonable steps to notify winners will be taken by RDI Marketing.
8. Second Chance Draw
(a) Should the major prize be unclaimed by 21/04/2011, a second chance draw will take place at RDI Marketing, Unit 1, 2 Bromham Place Richmond VIC 3121 at 12:00pm (AEST) on 22/04/2011. The Promoter’s decision is final and no correspondence will be entered into.
(b) The second chance draw prize winner for the draw will be notified by telephone and email and the winner of prize will have their name, suburb and state published in The Australian on 29/04/2011. All reasonable steps to notify winners will be taken by RDI Marketing.

Entrants can only enter in their own name. The Promoter reserves the right to request entrants produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm an entrant’s identity, age, residential or email address, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion before issuing the prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will be deemed invalid. All prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
10. The total prize value of the major prize is valued up to RRP$6,703.40.
11. There will be one major prize which consists of:
(a) Return flights economy class on Qantas International Services from Sydney (inclusive of Qantas domestic flights if necessary from the winner’s nearest domestic airport in Australia) to Hong Kong for two (2), consisting of two (2) adults flying.
(b) Return transfers from Hong Kong International Airport (Skypier) to Macau travelling Super Class on Turbojet Sea Express.
(c) Three (3) nights accommodation at the Venetian Resort Hotel, Macau for two (2), consisting of two (2) adults. Room style is Royal Suite with breakfasts included.
(d) Two (2) nights accommodation at the Mandarin Oriental, Hong Kong for two (2), consisting of two (2) adults. Room style is Deluxe Suite with breakfasts included.
(e) A guided tour for two (2) adults to the prestigious Hong Kong Stock Exchange.
12. The major prize is subject to booking, visa and flight availability and must be taken between start of Feb 2011 through to end of Nov 2011. No extension will be permitted and any prize not taken by the end date will be forfeited. (The winner must advise the Promoter) at least 2 months in advance when they wish to take the major prize. The winner and their guest must allow time for issuing of visas if required prior to travel. Any alterations to confirmed major prize details will be at the expense of the winner and will only be permitted with the Promoter’s consent. The winner and their guest must depart and return at the same time using the same carrier.
13. All prize values advertised are the Recommended Retail Price inclusive of taxes. The prize, or any unused portion of the prize, is not exchangeable or transferable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in prize value.. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
14. The winner will be responsible for any expenses incurred in travelling to and from the departure point in Australia. The prize does not include, and the Promoter takes no responsibility for, any ancillary costs, including travel insurance, visas, baggage, taxes, travel money, additional transfers, additional meals, personal expenses or tipping. The Promoter strongly recommends the winner and their guest take out adequate travel insurance and acquaint themselves with the information provided on the Australian Government Smart Traveller website before travelling.
15. It is a condition of accepting the major prize that the winner and their guest may be required to sign a legal release and indemnity in a form determined by the Promoter in its absolute discretion.
16. The Promoter reserves the right to refuse to allow the winner and/or their guest to take part in all or aspects of the major prize if the Promoter determines in its absolute discretion, that the winner and/or their guest are not in the mental or physical condition necessary to be able safely to participate in the major prize.
17. If for any reason the prize or any element of the prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the winner in lieu, subject to any written directions made under applicable State or Territory legislation.
18. The Promoter and its associated agencies and companies and their respective officers shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
19. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for:
(a) tampering with the entry process; or
(b) for submitting an entry which is not in accordance with these Conditions of Entry; or
(c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
20. Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the promotion’s website or the information on the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.
21. The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
22. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.
23. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
24. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
25. As a condition of entering this promotion, an entrant consents to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
