1. General
(a) MTV Networks Australia Pty Ltd ACN 107 601 418 of Ground Floor, 4-16 Yurong St East Sydney, Australia NSW 2010 (MTVNA) is the promoter of this competition.
(b) Information on how to enter forms part of these Terms and Conditions. (c) By entering any competition promoted by MTVNA you agree to these Terms and Conditions and any other applicable terms as advised by MTVNA.
(d) For the purposes of these Terms and Conditions, MTVNA includes its parents, related and subsidiary companies, past present and future officers, agents, representatives, employees, and assigns.
(e) The Arrested Development concert (“Event”) will be held as part of the Sydney Festival Sydney Festival on Monday 10 January 2011 at the Hyde Park Barracks Museum, Corner Macquarie Street and Prince Albert Road, Sydney (“Venue”).
2. Entry requirements
(a) Entrants must be residents of Australia and 18 years of age or older.
(b) The employees, agents and contractors of MTVNA, any of its affiliate, parent or subsidiary companies are not eligible to enter the competition. (c) Direct family members of any person included in 2(b) are not eligible to enter.
(d) The competition can be entered online via
www.mtv.com.au.
(e) To enter entrants must answer the following question: “In 25 words or less tell us who you’d like to see play at Beck’s Festival Bar, Sydney in 2012”.
(f) All entries must include full contact details: name, postal address, telephone number, email address and date of birth.
(g) Any person who fails to provide the full information in the manner requested as part of the entry process will not be eligible for any competition prize.
(h) Any information, photographs, audio-visual or other material provided to MTVNA by an entrant as part on an entry to this competition will not be returned to entrants. Entrants are advised to not send original material.
(i) Entries to this competition open on Thursday 23 December, 2010 at 10:01am (AEDST) and close on Sunday 2 January, 2011 at 23:59pm (AEDST). Entries received after the closing date will not be eligible.
(j) MTVNA assumes no responsibility for failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the promotion.
(k) Unless otherwise agreed, any personal or confidential information submitted to MTVNA by any person in the course of entering or being otherwise involved in this competition such as name, address, telephone number will be treated in accordance with MTVNA’s Privacy Policy, available at
http://www.mtv.com.au/info/mtv-com-au-terms-andconditions. 3. Judging
(a) Entries will be judged at the MTV office at Ground Floor, 4-16 Yurong St East Sydney NSW 2010 on Tuesday 4 January, 2011 at 2:00pm (AEDST). The best entry, as determined by the judges, will receive the major prize.
(b) This competition is a game of skill and the winner will be selected by appropriately qualified judges on the quality and creativity of their entry. Chance plays no part in determining the winners.
(c) Prize winner will be notified on Tuesday 4 January, 2011 by 5:00pm (AEDST).
(d) Prize winner will be notified by email and telephone at the details provided in their entry. All reasonable efforts will be made to contact the prize winner. MTVNA will not be liable to any prize winner who cannot be contacted at the details provided in their entry.
(e) If MTVNA is unable to contact the prize winner after reasonable efforts, MTVNA may assign the prize to the entry judged the next best entry in the competition.
(f) The decision of the judges is final and MTVNA will not enter into correspondence or communication regarding the judges’ decisions even where MTVNA may not have acted reasonably or where MTVNA is shown to have made a decision in error.
4. Prizes
(a) The major prize winner will receive:
Return economy flights for the winner and a guest from the winner’s nearest capital city to Sydney on Sunday 9 January, 2011 and returning on Tuesday 11 January, 2011 (RRP $1,800).
2 nights accommodation for two people at the Observatory Hotel (RRP $1300)
2 x VIP Tickets to the Arrested Development concert at the Sydney Festival on Monday 10 January 2011 (RRP $150).
Fast Festival Feast Dinner for two at Steel Bar and Grill on Monday 10 January 2011 (RRP $60).
(b) The total prize pool is valued at up to $3,310.
(c) The flight component of the major prize may not be available for winners who reside in the major metropolitan area of Sydney.
(d) The major prize does not include transfers to or from airport and hotel, and any costs associated with this must be met by the major prize winner and their guest.
(e) Air travel must be taken by the winner and guest from the same departure and arrival point.
(f) Frequent Flyer points may not available for any of the flights included in the Major Prize.
(g) A credit card imprint maybe required upon check in to the hotel.
(h) The prize does not include hotel meals, hotel incidentals, taxes (excluding GST), insurance and any other expense and fees connected with the prize that are not included in the prize description.
(i) Hotel accommodation is 2 nights, based on two people sharing a twin or double room.
(j) The winner and guest may be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws, codes or policies including those of the relevant liquor licensee relating to the responsible service of alcohol. MTVNA supports the responsible service of alcohol.
(k) The prize winners and their guest must carry valid photo identification with them at all times during the Event.
(l) The Venue may require the prize winner and their guest to present photograph identification on entry to the Event. The Venue may refuse entry at its own discretion where such identification is not presented.
MTVNA is not responsible for any refusal of entry made by the Venue because of failure to present identification.
(m) The Venue may also impose its own conditions of entry to the Venue and may refuse entry in its own discretion. MTVNA is not responsible for any refusal of entry made by the Venue.
(n) MTVNA may require any person collecting or receiving a prize to show photograph identification and/or sign a deed declaring that they have collected or received the prize before MTVNA gives the prize over.
(o) MTVNA may require any person collecting a prize to sign a copy of these Terms and Conditions.
(p) Once a prize has been collected MTVNA is not responsible for the use or distribution of any prize.
(q) MTVNA will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this competition.
(r) If a prize referred to in this competition becomes unavailable for any reason MTVNA reserves the right to substitute that prize for a similar item of similar value.
(s) Prizes are not transferable or redeemable for cash. MTVNA accepts no responsibility for any variation in the value of the prizes.
(t) Prize winners agree to participate in any promotional activity promoting MTVNA, prize sponsors and/or the competition at the reasonable request of MTVNA.
5. Intellectual Property
(a) MTVNA may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or prize winners’ performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.
(b) Any material, including without limitation competition entries and images and/or audio-visual material included in competition entries, submitted or provided by a competition entrant, and/or prize winner in association with any competition will become the property of MTVNA and MTVNA may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.
(c) MTVNA may require an entrant or prize winner to execute any document necessary to give effect to 5(a) and/or (b).
6. Warranties
(a) Entrants warrant and represent to MTVNA that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law.
(b) Entrants indemnify MTVNA against any claim, loss or damager suffered by MTVNA as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Terms and Conditions.
(c) If MTVNA becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to MTVNA, MTVNA may deem that prize winner ineligible.
7. Governing Law
These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
