TERMS & CONDITIONS

HOW TO ENTER

I.To be eligible to enter, individuals must purchase any Hungry Jack's® Value Meal from a participating Hungry Jack's® outlet in NSW, ACT, VIC, TAS, SA, QLD or WA, between 07/12/2010 and close of business on 03/01/2011 (the "Promotional Period").


II.To enter, individuals must then fully complete the official entry form (provided at the point of purchase), including their first name, last name, valid email address, full residential address (including the street number and street name, suburb, state and postcode), home phone number, consent to be contacted by telephone, email or letter by the Promoter (and any 3rd parties and their agents) and place the completed entry form in the entry box provided in the outlet during the Promotional Period

TERMS AND CONDITIONS

1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, participating outlets and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4.Incomplete, indecipherable or illegible entries will be deemed invalid.

5.Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per qualifying purchase; and (b) each entry must be submitted separately and in accordance with entry requirements.

6.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

7.Promotion commences on 07/12/2010 and ends at close of business in each participating Hungry Jack's® outlet on 03/01/2011. Entries will close at midnight (local time) on 03/01/2011 in those outlets open 24 hours.

Outlet Prize Draws

8.An Outlet Prize draw will be conducted in each participating Hungry Jack's® outlet from all entries received in that outlet during the Promotional Period. The draw will take place in that outlet on 04/01/2011 at 11am (local time).

9.The first valid entry drawn in each Outlet Prize Draw in NSW, ACT, VIC and TAS will each win a double Sydney Harbour BridgeClimb Pass for two adults valued at $416.

10.The first valid entry drawn in each Outlet Prize Draw in SA will each win a double 6 month Movie Gold Pass from Wallis Cinemas valued at $1,000. Pass is not valid for films marked "No Free List" or after 6pm on Saturdays.

11.The first valid entry drawn in each Outlet Prize Draw in WA and QLD will each win a pre-paid BoostDroid K16 by Hauwei mobile phone handset from Boost Mobile including a $100 credit. Each prize is valued at $250. The winner will be responsible for the purchase of all additional credit/phone cards. Prize is subject to Boost Mobile standard terms and conditions

State/Territory Prize Draws

12.All entries received during the Promotional Period will be entered into a State/Territory Prize Draw, as follows:

•NSW/ACT Draw (for entries from outlets in NSW and ACT);
•VIC/TAS Draw (for entries from outlets in VIC and TAS);
•SA (for entries from outlets in SA)
•WA (for entries from outlets in WA); and
•QLD (for entries from outlets in QLD).

13.The State/Territory Prize Draws will be held at 12noon (local time) on 28/01/2011 at each Hungry Jack's® State Group Head Office as follows:

•WA - Hungry Jack's® State Office, 355 Scarborough Beach Road, Osborne Park, WA 6017;
•NSW/ACT -Hungry Jack's® State Office, Level 1, 160 Church Street, Parramatta, NSW 2150;
•QLD - Hungry Jack's® State Office, Unit 4, 16 Theodore Street, Eagle Farm, QLD 4009;
•SA - Hungry Jack's® State Office, 86 Richmond Road, Keswick, SA 5035; and
•VIC/TAS - Hungry Jack's® State Office, 1183 Toorak Road, Camberwell, VIC 3124.

14.The first valid entry drawn in each State/Territory Prize Draw will each win a trip for two (2) adults and two (2) children (15 years or under) to Sydney. Prize includes:

•two (2) nights accommodation in a family room at the three (3) star Travelodge Wynyard;
•a Sydney Harbour BridgeClimb Pass. The Pass will be redeemable for two (2) adults and two (2) children who are between the ages of 10 and 15 only.

Winners from VIC/TAS Draw, SA Draw, WA Draw and QLD Draw will also each receive return economy airfares with Jetstar for two (2) adults and two (2) children (15 years or under) from the winner's nearest capital city to Sydney. The winner (and his/her companions) of the NSW/ACT Draw must make their own way to the accommodation venue.

Spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. All bookings must be made at least 30 days prior to departure date (with final bookings made by 30/05/2011) and are subject to booking and flight availability. Bookings will not be extended under any circumstances. Prize must be taken within 12 months of the State/Territory Prize Draw and cannot be taken between 20/12/2011 and 10/01/2012 or during Australian school holidays, on national public holidays or selected black-out dates. All elements of the State/Territory prize must be taken together.

The State/Territory prize in VIC/TAS Draw, SA Draw, WA Draw and QLD Draw is valued at up to $3,592, depending on the winner's date and point of departure. The State/Territory prize in the NSW/ACT draw is valued at $1,592
.

General

15.The Promoter's decision is final and no correspondence will be entered into.

16.Winners will be notified by telephone and mail. All State/Territory Prize Draw winners and the Outlet Prize Draw winners from VIC and SA will have their names published on 03/02/2011 in the following publications:

•Herald Sun (VIC winners)
•The Mercury (TAS winner)
•Daily Telegraph (NSW/ACT winners)
•The Advertiser (SA winners)
•Courier Mail (QLD winner)
•West Australian (WA winner).

17.During the entire duration of all prizes, a parent/guardian must accompany any person under 18 years of age.

18.Each State/Territory Prize Draw winner must depart from and return to the same departure point and travel together with his/her companions. Itinerary to be determined by the Promoter in agreement with the winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. There can be no changes made to travel arrangements once itineraries are issued. Any changes to flight bookings once made by Jetstar will be subject to charges payable by the winner. The winner and their nominated travel companions must have proof of I.D. Frequent flyer points will not form part of the State/Territory Prize Draw prize. Each State/Territory Prize Draw winner may be required to present credit card at time of accommodation check in.

19.All prizes are subject to the standard terms and conditions of individual prize and service providers.

20.Any ancillary costs associated with redeeming the BridgeClimb and the Movie Gold Passes are not included. Any unused balance of any of the Passes will not be awarded as cash. Redemption of the Passes is subject to any terms and conditions of the issuer including those specified on the Passes.

21.BridgeClimb Passes will be issued to each winner in the form of a BridgeClimb prize letter. Each prize letter is valid for 12 months from the relevant draw date. The BridgeClimb Pass entitles two adults to experience either The Bridge Climb, The Discovery Climb or The Express Climb on a Day or Night Climb only (i.e. not applicable for a Dawn Climb or Twilight Climb), between 28/01/2011 and 28/01/2012 (State/Territory Prize Draw Passes) and 04/01/2011 and 04/01/2012 (Outlet Prize Draw Passes), outside exclusion periods (i.e. between 20/12/2011 and 10/01/2012 inclusive, or during Australian school holidays or on national public holidays). To participate in The Bridge Climb, The Discovery Climb or The Express Climb, the winner and his/her companion/s ("Climbers") must meet BridgeClimb's standard health and safety conditions that are available at the following website: http://www.bridgeclimb.com/theClimb/safety.htm. Climbers will need to take into account any medical conditions they may have that may impact on their ability to climb vertical ladders and steep slopes safely. All Climbers must be over 10 years of age and be physically fit. All 10 to 15 year-old Climbers must be accompanied by a paying adult Climber. The level of exertion and exhilaration is dependent on the Climb experience chosen by the Climber. The experience is between 2 and 3 hours long depending on the climb chosen and may exposes participants to all weather conditions. All Climbers must submit to an alcohol breath test and must register a blood alcohol content reading of less than 0.05% to be eligible to climb. Climbers who fail this test will not be permitted to Climb and this element of the prize will not be replaced or an alternative offered. Climbers must complete a declaration form and satisfy BridgeClimb's terms of trade available at either http://www.bridgeclimb.com/BridgeClimbDeclarationForm.pdf or alternatively at http://www.bridgeclimb.com/terms_trade.htm. Any ancillary expenses incurred will be the responsibility of each winner. The full Terms and Conditions regarding the BridgeClimb Pass and the various climbs can be accessed at BridgeClimb's website on the page references provided above or by calling (02) 8274 7777. Experiences offered under the BridgeClimb Pass cannot be varied or extended.

22.Each winner of the BridgeClimb prize ("Activity") acknowledges that the Activity is a dangerous activity that may result in injury or death, and participate at their own risk. Winners must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) comply with all directions of the Promoter and Activity organisers at all times; and (d) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner from participating in the Activity if, at any time, they reasonably believe that the winner poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

23.If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.

24.Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem a prize or an element of a prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

25.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

26.Total potential prize pool value that can be won by entrants in each outlet in NSW and ACT is $2,008. Total potential prize pool value that can be won by entrants in each outlet in VIC and TAS is up to $4,008. Total potential prize pool value that can be won by entrants in each outlet in SA is up to $4,592. Total potential prize pool value that can be won by entrants in each outlet in WA and QLD is up to $3,842.

27.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

28.A draw for any unclaimed prizes may take place on 29/04/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing. All State/Territory prize winners and the Outlet prize winners from VIC and SA will be published in the publication specified in clause 16 above on 06/05/2011.

29.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

30.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

31.The use of any mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

32.Except for any liability that cannot be excluded by law, the Promoter and prize suppliers (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of and/or taking of a prize.

33.As a condition of accepting any prize, each winner (and any companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

34.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

35.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
