Conditions of entry

   1. Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
   2. Entry is open only to Australian residents aged 18 or over who are able to take the major prize between 07/03/11 – 31/03/11 (inclusive) except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this competition.
   3. The competition begins at 9am (AEDT) on 15/11/10 and closes at 4.59pm (AEDT) on 28/02/11 (Competition Period).
   4. Entrants must, during the Competition Period, log onto www.carltondry.com.au (Website) and submit their entry to the Website either by:
         1. text only (limit 3,500 characters including spaces);
         2. uploading an image and text (max size 2Mb) in the format specified on the Website (Image); OR
         3. uploading a video (which can be done via Webcam if entrants wish) (max size 10Mb) up to 10 minutes long, text optional (Video),
      depicting their 'best story' (Entry), and by fully completing and submitting the online entry form including their full name, date of birth, email address, postal address, contact phone number, Entry title and any other details as required by the Promoter.

   5. Once the Promoter has viewed the Entry and deemed it acceptable (in its absolute discretion), the Entry will be placed on the Website (along with, in some instances depending on the Entry type, the entrant's name and Entry title). The Promoter is not liable for any technical difficulty or error that results in any Entry being wholly or partly unavailable for online access, for any period of time.
   6. By entering, entrants acknowledge that their Entry and their name may be made available online by the Promoter (in its absolute discretion) in which case they will be accessible to the general public. The Promoter may copy, in part or in its entirety, the Entry, cause the Entry to be seen and heard in public, and communicate the Entry to the public. It may also allow third parties to do these things.
   7. Subject to paragraph 9, entrants may enter as many times as they wish provided that each Entry is based on a separate Entry containing a different text, Image or Video and a different depiction of a 'best story'. Each Entry must be received during the Competition Period/Minor Prize Entry Period (as applicable). The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses or aliases may be disqualified.
   8. Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter's discretion. This competition is a game of skill; chance plays no part in determining the winners. Each valid Entry (including minor prize Entries) will be individually judged (by representatives of the Promoter) based on, among other things, originality, creative merit, brand suitability and commercial feasibility of prize fulfilment (in the Promoter's absolute discretion). The judges' decisions are final and no correspondence will be entered into.
   9. Minor prizes:
      Entrants who submit an Entry between 9am (AEDT) 01/02/11 and 4.59pm (AEDT) 28/02/11 (Minor Prize Entry Period) who have:
         1. during the Minor Prize Entry Period also purchased a specially marked carton of Carlton Dry, (Eligible Purchase) from a liquor licensed outlet (Outlet); and
         2. entered the unique code (found on the specially marked carton ) as part of their minor prize Entry and their minor prize Entry is deemed by the Promoter (in its absolute discretion) to be acceptable and compliant with these conditions of entry and is made available on the Website pursuant to paragraph 5,
      will have the chance to win a minor prize
. There is a limit one Entry per person per day. All minor prize Entries will be considered for the major prize. Each minor prize Entry must be based on a separate Eligible Purchase. Entrants must retain their original Eligible Purchase receipt to verify each minor prize Entry. Failure to provide this/these to the Promoter upon request may, at the Promoter's discretion, result in an invalid Entry (and, at the Promoter's discretion, in all of the entrant's Entries being invalid).
  10. The entrant assigns all rights (including copyright) in each Entry to the Promoter at the time of submitting an Entry. By entering this competition entrants:
         1. consent to the Promoter making copies of or publishing the whole or any part of their Entry and otherwise exploiting the Entry and any rights in relation to the Entry, to publicise this competition or the Promoter's products or for any other purposes;
         2. undertake to the Promoter that their Entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights; and
         3. consent to any act by the Promoter in relation to their Entry which would otherwise infringe their moral rights in the content of the Entry.
  11. Once submitted, entrants cannot alter or delete their Entry.
  12. The Promoter, in its absolute discretion, may edit any part of an entrant's Entry. By entering, entrants agree to the Promoter editing, amending, making an adaptation of or otherwise varying the whole or any part of their Entry.
  13. By entering this promotion, the entrant warrants that each Entry:
         1. is original and not copied, and was created by the entrant;
         2. does not include any image of, or voice of, any other person in the Video or Image without that person's express consent;
         3. does not include any content that contravenes any law, infringes the rights of any person or is obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate. Without limitation, entrants must not include any content that involves nudity, malice or swearing or which may be defamatory or in contempt of court;
         4. is consistent with the Alcohol Beverages Advertising Code, including that it does not feature persons under 25 years old or associate drinking with sports or driving;
         5. does not include any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists (Copyright Content), unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any Copyright Content (for example, recorded music) in their Entry, they must not include it. By including any Copyright Content in their Entry, the entrant warrants that they are entitled to do so; and
         6. contains no viruses or other computer code or material embedded in it which may have a negative impact on the Website, this competition or any network or third party computer systems.
  14. The Promoter may (but is not obliged to) at any time reject and/or remove from access by the public or disqualify or invalidate any Entry that it considers (in its sole judgment) infringes these terms and conditions. The Promoter will have no liability to entrants in that regard.
  15. Major prize: The best valid Entry (from all valid Entries received, including minor prize Entries), as determined by the judges by 01/03/11 in accordance with paragraph 8, will win the major prize. The major prize is a trip for the winner and 3 companions (who must be aged 18 or over) to Los Angeles, USA where the major prize winner will have their 'best story', as depicted in their Entry, recorded as a mini movie (as determined by the Promoter in its discretion) starring Steven Seagal. The major prize also includes return economy airfares for the major prize winner and their 3 companions from the major prize winner's nearest Australian capital city to Los Angeles, USA, airport transfers in Los Angeles between airport and hotel, the opportunity (subject to availability and confirmation with Steven Seagal's management) for the major prize winner (and his/her 3 companions) to attend the mini movie set in Los Angeles (or other location as determined by the Promoter), up to 5 nights' accommodation in Los Angeles, an internal flight to Phoenix or Vancouver (if required for the mini movie shoot), a day trip to Knott's Berry Farm (theme park) for the major prize winner and their companions, 4 tickets to a Dodgers game in Los Angeles and AUD$4,000 spending money for the major prize winner only. The major prize is valued at up to $26,300 (inc GST), depending on the major prize winner's point of departure.
  16. Minor prizes: The Entry deemed to be the best valid minor prize Entry received each day during the Minor Prize Entry Period, as determined by the judges, will win $1,000. There are 28 minor prizes to be won (one for each day of the Minor Prize Entry Period). The total minor prize pool is valued at $28,000 (inc GST).
  17. Flights, accommodation and all other major prize inclusions are subject to booking and availability. The major prize must be taken between 07/03/11 and 31/03/11 (as determined by the Promoter). All other costs associated with the major prize that are not specified, including but not limited to any additional meals, additional transfer costs, taxes, insurances, additional spending money and other ancillary costs are the responsibility of the major prize winner and their companions as incurred. The major prize winner and their companions are responsible for ensuring that they have all necessary documents to travel to Los Angeles, USA (including a current passport and any visas that may be required).
  18. All elements of the major prize are subject to any additional terms and conditions specified by the prize supplier/s. The major prize winner and their companions must comply with all directions of the Promoter or any prize supplier. The Promoter will not be liable if, for any reason whatsoever, Steven Seagal does not star in the mini movie as part of the major prize or if the major prize winner and their companions do not get to visit the mini movie set/s. The major prize winner and their companions will not obtain any rights in the mini movie scenes that are shot – as between them and the Promoter, the Promoter will own all rights (including intellectual property rights) in relation to the mini movie scenes and associated scripts and other materials.
  19. The major prize and minor prize winners will be notified by telephone and by email.
  20. The major prize winner must claim their prize by 4.00pm (AEDT) 02/03/11. The minor prize winners must claim their prize within 7 days of being notified by the Promoter that they are a winner. If the major prize or a minor prize is not claimed within the time specified, the relevant winner's Entry will be deemed invalid and the Promoter will distribute the relevant prize to the next best valid Entry in accordance with paragraph 15 or 16 as applicable.
  21. If a winning Entry is deemed not to comply with these conditions of entry (including because the entrant is unable to take the major prize between 07/03/11 and 31/03/11) that Entry will be discarded and the Promoter will distribute the relevant prize to the next best valid Entry in accordance with paragraph 15 or 16 as applicable.
  22. The winners must, at the Promoter's request, participate in all promotional activity (such as publicity, photography and in the case of the major prize, the mini movie) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material. The Promoter may use and communicate the mini movie or any part or version of it, and allow others to do so, for any purpose.
  23. The major prize winner and their companions may be required to sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the major prize prior to undertaking any activities included in the major prize. If the major prize winner and their companions do not sign the indemnity form provided by the Promoter within the time requested by the Promoter, the major prize winner's Entry or claim may be deemed invalid.
  24. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  25. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
  26. The Promoter may require the winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter's discretion.
  27. The Promoter may, in its sole discretion, disqualify all Entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. The Promoter may in its absolute discretion cancel the major prize or otherwise cease to provide any benefit of the major prize to the major prize winner and their companions if the major prize winner or their companions, in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this promotion, is contrary to law or is otherwise inappropriate, or if the major prize winner or any of their companions fails to follow any directions of the Promoter or any prize supplier.
  28. The prizes are not transferable or exchangeable and, with the exception of the minor prizes, cannot be redeemed for cash. In the event for any reason the major prize winner does not take an element of the major prize at the time stipulated by the Promoter then that element of the major prize will be forfeited by the major prize winner and cash will not be supplied in lieu of that element of the major prize. The Promoter accepts no responsibility for any variation in prize value. If a prize or any element of a prize is unavailable for any reason the Promoter may substitute for that prize or element of a prize another item of equal or higher value as determined by the Promoter.
  29. If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
  30. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
  31. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. A full version of these Guidelines is available at http://www.nhmrc.gov.au/_files_nhmrc/file/publications/synopses/ds10-alcohol.pdf.
  32. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on the Promoter's database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
