'WIN A TRIP TO LORD HOWE ISLAND' PROMOTION

1) Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

2) The promoters are Eastern Australia Airlines Pty Limited (ABN 77 001 599 024) of Level 10, Airport Central Building (APC10), Corner O'Riordan & Robey Street, Mascot, NSW 2020 phone number: 02 9691 3636 and Sunstate Airlines (QLD) Pty Limited (ABN 82 009 734 703) of 153 Campbell Street, Lobby 3, Level 3, Bowen Hills, QLD 4006 phone number: 02 9691 3636 (Promoters).

3) The promotion commences at 12.00am (Sydney time) on 5 April 2010 and closes at 11.59pm (Sydney time) on 31 March 2011 (Promotion Period).

4) Entry is open only to residents of Tasmania, Victoria, South Australia, New South Wales, Queensland and the Australian Capital Territory (Eligible Entrants), excluding officers, management, employees and their immediate families of the Promoters, their related bodies corporate, agencies associated with this promotion, and the registered travel companions of employees of the Promoters and their related bodies corporate.

5) To enter, Eligible Entrants must, during the Promotion Period:

a) fly on a QantasLink route operated by one of the Promoters;
b) receive a Survey Invitation Card; and
c) visit www.qantaslinksurvey.com.au within 14 days of their flight to:

    1. Enter their flight number (printed on their boarding pass); and
    2. complete the customer survey (conducted by DBM Consultants).

(Eligible Process)

6) Eligible Entrants will receive one entry for completing each Eligible Process.

7) The Promoters are not responsible for any lost, late or misdirected entries, including entries which were not received by the Promoters due to technical limitations or malfunction.

Cool The Promoters reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these terms and conditions.

9) There will be 4 prizes drawn at quarterly intervals throughout the Promotion Period. The first valid entry drawn in each draw will win the prize for that draw.

10) The prize winners will each receive 2 return economy class QantasLink airfares to Lord Howe Island from the winner's nearest airport serviced by QantasLink (operated by Eastern Australia Airlines or Sunstate Airlines) to the value of AUD$5,600.00 (Prize Flight). A list of ports operated by Eastern Australia Airlines and Sunstate Airlines is at clause 29 of these Terms and Conditions.

11) The valid entry periods for the prizes are:
      a)     from 12.00am 5 April 2010 to 11:59pm 30 June 2010 (Sydney time) for Draw 1;
      b)     from 12:00am 1 July 2010 to 11:59pm 30 September 2010 (Sydney time) for Draw 2;
      c)     from 12:00am 1 October 2010 to11:59pm 31 December 2010 (Sydney time) for Draw 3; and

      d)     from 12:00am 1 January 2011 to 11:59pm 31 March 2011 (Sydney time) for Draw 4.

12) The draws will take place at 12.00pm (Sydney time) following the close of each draw period. Draw 1 will take place on 7 July 2010, Draw 2 will take place on 6 October 2010, Draw 3 will take place on 5 January 2011 and Draw 4 will take place on 2 April 2011 at 15 Grosvenor Street, Neutral Bay, NSW 2089, and will be conducted by Mike Da Silva and Associates (Aust) Pty Ltd (ABN 50 003 894 022).

13)The result of each draw is final and no correspondence will be entered into.

14) The maximum total prize value is AUD$22,400.00 depending on the departure point of the prize winners and based on the recommended retail value at the time of printing. The Promoters accept no responsibility for any variation in the value of the prizes.

15) Prize Flights must be completed before 4 April 2012. The winners and their nominated travel companions must travel together on the same flights. The Prize Flights do not include accommodation, travel insurance, passports, visas, meals, taxes not included in the cost of the ticket, ground transportation or any other costs not specifically stated. Compliance with any health or other government requirements is the responsibility of the winners and their travel companions.

16) The Prize Flights must be booked no later than 4 weeks before departure. All prize travel is subject to Qantas' General Conditions of Carriage and fare rules, including in relation to any limitation or exclusion of liability contained in those conditions.

17) The Prize Flights are subject to availability at the time of booking and cannot be taken in peak periods or public holidays (as determined by the Promoters). The winners and any travel companions will not accrue Qantas Frequent Flyer points on Prize Flights and cannot use cash or Qantas Frequent Flyer points to upgrade Prize Flights.

18) If a Prize Flight or any part of a Prize Flight cannot, in the opinion of the Promoters, be provided for any reason, then the Promoters reserve the right to provide an alternative travel prize or part of a prize (including to an alternative destination) to the same value as that part of the Prize Flight being replaced.

19) Prize Flights must be taken as stated and no compensation will be payable if a winner is unable to use their Prize Flight as stated. The Prize Flight is not exchangeable or redeemable for cash or other goods or services. A Prize Flight cannot be transferred to any other person without the consent of the Promoters. There can be no changes made to travel arrangements once tickets are issued. If a winner is unable to satisfy these terms and conditions or the Prize Flight is not completed before 4 April 2012, it will be forfeited by the winner and cash will not be awarded in lieu.

20) The Promoters, their related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these Terms and Conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

21) The exclusion of liability in clause 21 does not apply to limit or exclude liability:

      a)         for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt, third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; or
 
      b)         to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the minimum allowable by law).

22) The winners will be notified by phone and in writing within 2 days of each draw and the winners' names will be published in The Australian newspaper as follows: Draw 1 - 14 July 2010, Draw 2 - 13 October 2010, Draw 3 - 12 January 2011 and Draw 4 - 13 April 2011.

23) The Promoters reserve the right to redraw in the event of an entrant being unable to satisfy these terms and conditions or not claiming a prize. If a prize remains unclaimed as at 5pm (Sydney time) on 6 July 2011, a second chance draw will be conducted by Mike Da Silva and Associates (Aust) Pty Ltd (ABN 50 003 894 022) at the same place as the original draw at 12.00pm (Sydney time) on 20 July 2011, subject to any written direction given under applicable law. The unclaimed prize draw winner will be notified by phone and in writing within 2 days and their name will be published in The Australian newspaper on 27 July 2011.

24) In the event that a winner is under the age of 18 years, the winner must be accompanied by a parent or guardian on all aspects of the Prize Flight and the parent or guardian must accept these terms and conditions on behalf of the winner.

25) If for any reason the promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoters which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoters reserve the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.

26) If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoters and which prevents the Promoters from complying with these terms and conditions, the Promoters will not be liable for any failure to perform or delay in performing their obligations and the Promoters reserve the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

27) The prize winners must, on request by the Promoters, be able to provide evidence which, to the reasonable satisfaction of the Promoters, demonstrates that the winner is an Eligible Entrant and has complied with these Terms and Conditions.

28) Entry details remain the property of the Promoters. The name and photograph of each of the winners may be used for promotional purposes by the Promoters, unless the winner otherwise notifies the Promoters at the time of accepting the prize. The Promoters will provide the name and address of the winners to State and Territory gaming authorities as required by law. Entrants consent to the Promoters using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding of prizes. Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Qantas Airways Limited Privacy Statement, a copy of which is available at http://www.qantas.com.au/info/privacy for further information.

29) Airports serviced by Eastern Australia Airlines and Sunstate Airlines include: Adelaide, Albury, Armidale, Barcaldine, Biloela, Blackall, Blackwater, Brisbane, Bundaberg, Canberra, Cloncurry, Coffs Harbour, Cairns, Charleville, Dubbo, Devonport, Emerald, Gladstone, Hamilton Island, Hervey Bay, Horn Island, Launceston, Lord Howe Island, Longreach, Mackay, Melbourne, Moranbah, Mount Hotham, Mount Isa, Mildura, Moree, Newcastle, Port Lincoln, Port Macquarie, Roma, Rockhampton, Sydney, Tamworth, Townsville, Weipa and Wagga Wagga.
