1. Information on how to enter and prizes forms part of these terms and conditions.
2. Any entry, which does not comply with these terms and conditions, is invalid.
3. Entry is open to Australian residents 18 years and over. Employees of the Promoter or its associated companies, employees of any agencies associated with this Promotion and the immediate families of any such employees are not eligible to enter.
4. The Promotion commences at 9am on 29 December 2010 AEDT and concludes at midnight on 30 January 2011 AEDT (“Promotional Period”).
5. To enter, during the Promotional Period spend at least $10.00 in any one transaction on any of the following products in the Darrell Lea Summer Paradise range from any participating Darrell Lea store or stockist which is advertising this promotion in-store:
(i) New Limited Edition Cherry Paradise bar (50g);

6. Entrants may enter as many times as they like provided that each entry is associated with a separate purchase of Promotional Products to the value of at least $10.00 in accordance with these terms and conditions. Any form of automated entry using any other devices or software is invalid. The Promoter will require prize winners to provide proof of purchase of the Promotional Products in order to receive a prize.
7. Entries are deemed to be received at the time of receipt by the Promoter. The Promoter is not responsible for failure to receive any entry for any cause beyond its control.
8. The Promoter may verify the validity of entries and may disqualify any entrant, including any entrant who uses techniques designed to facilitate multiple entries that are not associated with a separate Promotional Product purchase in accordance with these terms and conditions.
9. The first valid entry randomly selected will win the Major Prize. The Major Prize is the winner’s choice of either:
(a) a trip for 4 people (2 adults & 2 children 11 years and under) to tropical north Queensland valued at up to $7,000 (GST, travel taxes and charges inclusive) and includes: return economy airfares from the winner's nearest capital city (if required); 5 nights accommodation in 5-star accommodation; or
(b) a trip for 2 adults to tropical north Queensland valued at up to $7,000 (GST inclusive) and includes: return economy airfares from the winner's nearest capital city (if required); 5 nights accommodation in 5-star accommodation.
Flights, accommodation and room type are subject to availability at the time of booking. Block out periods may apply. Additional spending money, meals, taxes, transport to and from departure point, additional transfers, insurance and all other ancillary costs are the responsibility of the winner. It is a condition of accepting this prize that all components of the prize be taken during the trip and all persons taking the trip depart from and return to the winner's nearest capital city at the same time unless otherwise agreed by the Promoter and that all persons taking the trip sign a waiver of liability and an indemnity in the form determined by the Promoter in its absolute discretion. 11. The prize draw will take place at midday AEST on 7 February 2011 at Darrell Lea Chocolate Shops Pty Limited, 200 Rocky Point Road, Kogarah, New South Wales 2217 and the winners will be notified by mail. Winners of prizes over the value of $100 will have their names and postcodes published in The Australian on 14 February 2011 and details may also appear on

12. Entrants agree to the use of their image and name for publicity regarding the Promotion and acknowledge that it is a condition of taking the prize that all persons taking the trip agree to publicity regarding the Promotion including the use of their names and images without additional compensation.
13. The total prize pool is valued at up to $8,800 (GST inclusive). Prizes are not transferable and cannot be taken as cash. Prize values are correct at the time of printing but no responsibility is accepted for any variation in the value of any prizes.
14. The Promoter may conduct an unclaimed prize draw at the same place as the original draw at midday AEST on 21 May 2011 to distribute any prizes unclaimed by that date. The first valid entry drawn will win the prize of the highest value and so on until all prizes have been distributed. Winners of prizes over the value of $100 will be notified by mail, have their names and postcodes published in The Australian on 28 May 2011 and may also appear on

15. The Promoter is not liable for any loss or damage, including indirect or consequential loss or damage, or personal injury suffered during the course of accepting or using the prize, except for any liability that cannot be excluded by law.

17. If a winner is under the age of 18 years, the prize will be awarded to the winner’s parent or guardian on their behalf.
18. All decisions made by the Promoter are final and no correspondence will be entered into.
19. Subject to the approval required by any relevant gaming or lotteries authority, if any prize item is unavailable despite the Promoter’s reasonable endeavours to procure it in Australia, the Promoter may substitute a different prize item of equal or greater value.
20. If the Promotion is not able to be run as planned, whether caused by computer virus, line drop-out or congestion, tampering, unauthorised intervention, fraud, technical failures or other cause beyond the control of the Promoter which affects the administration, security, fairness or integrity of the Promotion, the Promoter may cancel, terminate, modify or suspend the Promotion. The Promoter may disqualify any individual who tampers with the entry process.
