Terms and Conditions
1. General
(a) MTV Networks Australia Pty Ltd ACN 107 601 418 of Ground Floor, 4-16 Yurong St East
Sydney, Australia NSW 2010 (MTVNA) is the promoter of this competition.
(b) Information on how to enter forms part of these Terms and Conditions.
(c) By entering any competition promoted by MTVNA you agree to these Terms and
Conditions and any other applicable terms as advised by MTVNA.
(d) For the purposes of these Terms and Conditions, MTVNA includes its parents, related
and subsidiary companies, past present and future officers, agents, representatives,
employees, and assigns.
(e) i. The Coachella Festival (“Coachella Festival”) will be held from 15 April 2011 to 17
April 2011 (“Coachella Festival Dates”) in Indio, California, USA (“Coachella
Location”);
ii. The Fuji Rock Festival (“Fuji Rock Festival”) will be held from 29 July 2011 to 31
July 2011 (Fuji Rock Festival Dates”) in Naeba Ski Resort, Yuzawa, Niigata
Prefecture, Japan (“Fuji Rock Location”); and
iii. The Glastonbury Festival (“Glastonbury Festival”) will be held from 22 June 2011 to
26 June 2011 (“Glastonbury Festival Dates”) at Worthy Farm, Pilton, UK
(“Glastonbury Festival Location”)
(f) The Coachella Festival, Fuji Rock Festival and Glastonbury Festival will be collectively
referred to as the “Festivals” and each a “Festival”
(g) Where a Festival is designated as the Festival for the purposes of the Major Prize, that
Festival’s location will be known as the “Location” and that Festival’s dates will be known
as the “Festival Dates”.
2. Entry requirements
(a) Entrants must be residents of Australia and 18 years of age or older and hold a current
passport which is valid for at least 12 months from 31 July 2011
(b) The employees, agents and contractors of MTVNA, any of its affiliate, parent or
subsidiary companies and agencies associated with this promotion are not eligible to
enter the Competition.
(c) Direct family members of any person included in 2(b) are not eligible to enter.
(d) The competition can be entered online at www.mtv.com.au/sharpie.
(e) To enter entrants must download the skateboard deck or cap template and design their
own skateboard deck or cap using Sharpie markers.
(f) All entries must include full contact details: name, email address, date of birth and
telephone number.
(g) Any person who fails to provide the full information in the manner requested as part of the
entry process will not be eligible for any competition prize.
(f) Any information, drawings, designs, photographs, audio-visual or other material provided
to MTVNA by an entrant as part on an entry to this competition will not be returned to
entrants.
(g) Entries to this competition open on Sunday 9th January, 2011 at 9:01am (AEDST) and
close on Saturday 29th January, 2011 at 11:59pm (AEDST). Entries received after the
closing date will not be eligible.
(h) MTVNA accepts no responsibility for lost entries.
(i) Unless otherwise agreed, any personal or confidential information submitted to MTVNA
by any person in the course of entering or being otherwise involved in this competition
such as name, address, telephone number will be treated in accordance with MTVNA’s
Privacy Policy.
3. Judging
(a) Entries will be judged at the MTVNA office at Ground Floor, 4-16 Yurong St, East Sydney
NSW 2010.
(b) This Competition is a game of skill and the most creative entry as selected by the judges
after consideration will be deemed the major prize winner (“Major Prize Winner”).
(c) The Major Prize Winner will be notified by 5:30pm (AEDST) on Monday 31st January,
2011.
(d) The Major Prize Winner will be notified by email and telephone at the details provided in
their entry. All reasonable efforts will be made to contact the Major Prize Winner. MTVNA
will not be liable to any Major Prize Winner who cannot be contacted at the details
provided in their entry.
(e) If MTVNA is unable to contact the Major Prize Winner after reasonable efforts, MTVNA
may assign the prize to the entry judged the next best entry in the competition.
(f) The decision of the judges is final and MTVNA will not enter into correspondence or
communication regarding the judges’ decisions even where MTVNA may not have acted
reasonably or where MTVNA is shown to have made a decision in error.
4. Prizes
(a) The Major Prize Winner will win the following prize (“Major Prize”):
• Return economy flights for the Major Prize Winner and a guest from the Major Prize
Winner’s nearest state or territory capital city to the Location (valued at up to $3000).
• 4 nights accommodation at the Location (valued at up to $1500)
• 2 x three (3) day general admission pass to attend one of the Festivals (valued at up
to $500).
(b) The total prize pool is valued at up to $5, 000.
(c) The Major Prize Winner will be asked to nominate which of the Festivals it would prefer to
attend once notified of being the Major Prize Winner.
(d) The Promoter will make all efforts to enable the Major Prize Winner to attend the Major
Prize Winner’s preferred Festival, but accepts no liability where this Festival is not
available. Tickets to an alternative Festival will be provided by the Promoter where the
preferred Festival is unavailable. Any changes in costs of the any Major Prize element
resulting from a change of Festival will be the responsibility of the Promoter.
(e) The Major Prize is subject to booking and flight availability and must be taken on the
dates agreed with MTVNA. No extension will be permitted, other than where a Festival is
unavailable as set out in Clause 4(d), and subject to Clause 4(d) any alterations to
confirmed Major Prize details will be at the expense of the Major Prize Winner.
(f) The Major Prize does not include transfers to or from airport and hotel, and any costs
associated with this must be met by the Major Prize Winner and their guest.
(g) A credit card imprint maybe required upon check in to the hotel.
(h) The Major Prize does not include hotel meals, hotel incidentals, taxes (excluding GST),
insurance and any other expense and fees connected with the Major Prize that are not
included in the Major Prize description.

(i) Hotel accommodation is for 4 nights, based on two people sharing a twin or double room.
(j) The Major Prize Winner’s guest must be aged over 18 years of age and hold a currrent
passport which is valid for at least 12 months from 31 July 2011.
(k) Unless expressly stated all other costs and expenses associated with taking the Major
Prize become the responsibility of the Major Prize Winner.
(i) The Major Prize Winner and guest must be available to attend the allocated Festival on
the Festival Date
(l) All aspects of the Major Prize must be taken together as a package. The Major Prize
must be taken on the Festival Date for the allocated Festival and must be taken to
coincide with that Festival. In the event that for any reason whatsoever the Major Prize
Winner does not take the Major Prize or an element of the Major Prize at the time
stipulated by the Promoter, then the Major Prize or that element of the Major Prize will be
forfeited by the Major Prize Winner.
(m) The Major Prize cannot be used in conjunction with any other discounts or special offers.
(n) Frequent Flyer points are not available for any of the flights included in the Major Prize.
(o) The Major Prize Winner and their guest must depart from and return to the same point of
departure and travel together.
(p) If the Major Prize Winner and/or their guest determine that travel insurance is required,
they will be responsible for arranging and paying for such travel insurance.
(q) MTVNA may require any person collecting or receiving the Major Prize to show
photograph identification and/or sign a deed declaring that they have collected or
received the Major Prize before MTVNA gives the Major Prize over.
(r) MTVNA may require any person collecting the Major Prize to sign a copy of these Terms
and Conditions.
(s) Once a prize has been collected MTVNA is not responsible for the use or distribution of
any prize.
(t) MTVNA will not be liable for any loss or damage whatsoever which is suffered (including
but not limited to direct or consequential loss) or for personal injury suffered or sustained,
as a result of taking any prize under this competition.
(u) If a prize referred to in this competition becomes unavailable for any reason MTVNA
reserves the right to substitute that prize for a similar item of similar value.
(v) MTVNA will use reasonable endeavours to keep the Major Prize Winner advised of any
cancellations or postponements of the Festival prior to taking the Major Prize, however,
and notwithstanding Clause 4(u), if the Major Prize Winner and guest have already taken
the flight component of the Prize and the Festival is cancelled or postponed, MTVNA will
be under no obligation to replace the Festival component of the Prize or to arrange flights
to any other Location.
(w) Prizes are not transferable or redeemable for cash. MTVNA accepts no responsibility for
any variation in the value of the Major Prize.
(x) The Major Prize Winner agrees to participate in any promotional activity promoting
MTVNA, prize sponsors and/or the competition at the reasonable request of MTVNA.
(y) The Festival operators may impose their own conditions of entry to the Festival and may
refuse entry at their own discretion, or may appoint third parties to impose conditions of
entry to the Festival who may refuse entry on the Festival operators’ behalf. MTVNA is
not responsible for any refusal of entry made by or on behalf of the Festival operators.
(z) Where alcohol will be served at a Festival, the Major Prize Winner and their guest must
abide by the minimum drinking age restrictions of the country in which the Festival is
taking place. Minors may not be permitted to attend some parts of the Festival, and will
be required to respect the conditions set by the Festival operators.
(aa) The Major Prize Winner and their guests must carry valid photo identification with them at
all times during the Festival.
5. Intellectual Property
(a) MTVNA may record, reproduce, publish, adapt, communicate or otherwise use the
entrants’ and/or Major Prize Winners’ performances, names, voices, and likeness for the
purposes of creating or producing any television program or other audio and/or audiovisual
material and for advertising and publicity purposes in any media in perpetuity
without needing to provide additional compensation.
(b) Any material, including without limitation competition entries and images and/or audiovisual
material included in competition entries, submitted or provided by a competition
entrant, and/or the Major Prize Winner in association with any competition will become
the property of MTVNA and MTVNA may reproduce, publish, adapt, communicate, cause
to be seen and/or heard in public or otherwise use any such material throughout the world
in perpetuity and without needing to provide additional compensation.
(c) MTVNA may require an entrant or the Major Prize Winner to execute any document
necessary to give effect to 5(a) and/or (b).
6. Warranties
(a) Entrants warrant and represent to MTVNA that nothing in any entry to any competition
infringes the rights, including copyright, of any third party and is not defamatory or
obscene and does not breach any state or commonwealth law.
(b) Entrants indemnify MTVNA against any claim, loss or damager suffered by MTVNA as a
direct or indirect consequence of a breach by the entrant of any warranty or
representation contained in these Terms and Conditions.
(c) If MTVNA becomes aware that the Major Prize Winner is in breach of any warranty
contained in these Terms and Conditions or made subsequently to MTVNA, MTVNA may
deem that Major Prize Winner ineligible.
7. Governing Law
These Terms and Conditions are to be construed according to the laws New South
Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that
state.
