All information published by the Promoter concerning entry into the Competition and Competition prizes forms part of these terms and conditions of entry. Entry into the draw is deemed acceptance of these terms and conditions of entry. Entry is via the Betts Kids website at
www.bettskids.com.au.
The promoter of the Competition is Betts Group Pty Ltd (ABN 41 008 675 929) of 32 Millrose Drive, Malaga, Western Australia (the Promoter).
It is a condition of the Competition that the participant is an Australian resident and that the major prize is accepted by the participant’s legal guardian who is over 18 years of age on behalf of the winner. Employees and relatives (as defined by the Corporations Act 2001 (the Act) of employees of:
3.1. the Promoter;
3.2. service providers associated with the Competition; and
3.3. a related party or associated entity (as defined in the Act) of the persons specified in paragraph 3.1 and 3.2 above,
are not eligible to enter the Competition.
To successfully enter the Competition, participants are required to:
4.1. purchase one or more pairs of Airflex school shoes from any Betts Kids store;
4.2. Provide their details including name, date of birth, address, phone number, e-mail address, receipt number and date of purchase on an online entry form and lodge this online. Access to the entry form will be made clearly visible, and available from, the Betts Kids website homepage at
www.bettskids.com.au4.3. When shopping online a click through button will appear on the screen after the order has been confirmed and paid for which will give the customer access to the entry form. Incomplete, incorrect and incomprehensible answers and details will, at the sole and absolute discretion of the Promoter, invalidate the participant’s entry into the Competition. Customers will only be allowed one entry per transaction.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
5.1. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control).
5.2. Any theft, unauthorised access or third party interference.
5.3. Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.
5.4. Any variation in prize value to that stated in these Terms and Conditions.
5.5. Any tax liability incurred by a winner or entrant.
5.6. Use of a prize.
The Competition commences on Wednesday 5 January 2011 and the entry form will be available online at 9:00am (AWST) on this day. All entries must be received by 9am (AWST) on Monday 7 February 2011. All registrations are deemed to be received at the time of receipt into the Promoter’s database, and not at the time of transmission by the participant.
The Major Prize draw will take place at the premises of Betts Group Pty Ltd, 32 Millrose Dr, Malaga WA 6090 at 1:00pm (AWST) on Monday 7 February 2011. The winner will be drawn first and then the 30 runner up draws will take place. The winners will be determined by chance. The major prize winner will be notified in writing and by telephone and will have their details published in the Public Notices section of The Australian newspaper and on
www.bettskids.com.au on Friday 11 February 2011. Runner up winners will be notified in writing of their win and have their details published on
www.bettskids.com.au.
The major prize and minor prizes must be claimed by 5:00pm (AWST) on Monday 9 May 2011 and if the major prize or any minor prizes remain unallocated or unclaimed, a further draw will be conducted on Tuesday 10 May 2011 at the same time and place as the original draw (subject to any directions given under all State Regulations). In the event of a re-drawn major prize winner, their details will be published in the Public Notices section of The Australian on Friday 13 May 2011. Any re-drawn minor prize winners will be notified in writing by Friday 13 May 2011.
The total prize pool is valued at a maximum of AU$6500.00.
There is 1 major prize to be won. The major prize comprises:
10.1. A 1 x 2 meter outdoor TV screen + home & garden kit + Diary of a Wimpy Kid DVD valued at $5000.00
There are 30 runners up prizes to be won. The runner up prizes are valued at a maximum of $50 each, total $1500 and comprise:
11.1. 1 x Diary of a Wimpy Kid DVD
11.2. 1 x Diary of a Wimpy Kid Pencil Case
11.3. 1 x Diary of a Wimpy Kid Book
Cash will not be awarded in lieu of the major or runner up prizes or any element thereof.
The major prize winner is responsible for the set up of the outdoor TV screen. The winner is responsible for any expenses that fall outside of receiving their prize to the address supplied.
By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize.
In consideration for the Promoter awarding the prize to the winner, the winner hereby agrees:
15.1. that he or she has no right of attribution or integrity of authorship with respect to the Publications; and
15.2. to assign to the Promoter all right, title and interest in and to all copyright in any material created by the winner and their companion pursuant to the winner’s participation in any aspect of the prize (Works); and
15.3. that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
The Promoter’s decision is final and binding and no correspondence will be entered into.
Prizes are not exchangeable or transferable and cannot be taken for cash.
All prize values are the recommended retail value as provided to the Promoter by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize of similar value subject to any written directions from a regulatory authority.
The Promoter and each of their related bodies corporate, associated agencies and companies associated with the Competition will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
Should a participant’s contact details change during the Competition period, it is the participant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
The Promoter, companies associated with the Competition and related parties and associated entities (as defined in the Act) thereof take no responsibility for any delays caused by airlines, natural disasters, acts of God, civil unrest, strikes and will not provide compensation for any such delays.
The Promoter reserves the right to request winners to provide proof of identity, Australian residency, residency at the nominated residential address and/or entry validity. Proof of identification, residency and entry considered suitable for verification is at the sole and absolute discretion of the Promoter. In the event that a winner cannot provide suitable proof of identity, the winner will forfeit their prize in whole and no substitute will be offered.
All entries become the property of the Promoter. The Promoter collects personal information about participants to enable participants to participate in this Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) but no further use of this information will be made without the participant’s prior consent. Each participant agrees to his or her personal information being disclosed to State and Territory Lottery Departments and being published (if he or she wins a prize) as required under the relevant lottery legislation.
If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any written directions from the a regulatory authority.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions subject to any written directions from a regulatory authority.
The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in the Competition by any person who tampers with or benefits from any tampering with the entry process or with the operation of the Competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
The laws of the State of Western Australia, State regulatory bodies (and where applicable the Commonwealth of Australia) shall apply to the Competition.
