Terms and Conditions of Entry – Hunter Leisure, The Battle Trainer Competition
1. Information on how to enter form part of these Conditions of Entry for the Nickelodeon and Hunter Leisure, The Battle Trainer Competition (“the Competition”).
2. There is one method of entry for this Competition: Online
3. To enter, entrants must:
a. log onto the Nickelodeon website (www.nickelodeon.com.au) and either:
i. Register their Nick Name and Password by providing the following information; First name, Last name, Address, State, Postcode, Date of birth, whether they are a girl or a boy, their email address, and some other optional information; or
ii. If the entrant has previously registered their details they are only required to enter their Nick Name and Password in order to enter the Competition.
b. Once logged on, answer in 25 words or less the following question: If you could have any magical power, what would it be and why?
4. Entry is open to all Australian residents. Employees and immediate families of the Promoter and agencies associated with this promotion, including without limitation Nintendo, are ineligible to enter.
5. The Promoter at its absolute discretion may require photographic identification including proof of age before awarding the prize. Identification considered suitable is at the discretion of the Promoter.
6. The Competition commences at 12:01am (AEDST) on Monday, 13th December 2010 and entries close at 11:59pm (AEDST) on Sunday, 16th January 2011.
7. Entries received after the closing date will not be eligible to enter. Entries are deemed to be received at the time of receipt of the web entry into the Competition database and NOT the time of transmission by the entrant.
8. No responsibility will be taken for late or lost entries.
9. The Competition will be judged on Monday, 17th January 2011.
10. The Competition is a game of skill and the fifteen (15) most creative entries as selected by the judges after consideration will be deemed the major prize winners. The next nine (9) most creative entries will be selected as the runners up.
11. The judging will be held at the Promoter’s offices, 5 Thomas Holt Drive, North Ryde, NSW 2113.
12. The fifteen (15) major prize winners will each win one (1) Battle Trainer prize pack, comprised of:
1 x Harry Potter Battle Trainer Sword (RRP $69.95)
1 x Harry Potter Book of Monsters (RRP $39.95)
1 x Harry Potter Dress Up Kit (RRP $19.95)
1 x Harry Potter Moulding Kit (RRP $14.95)
1 x Harry Potter Mirco Puzzle (RRP $12.95)
13. The nine (9) runners up will each receive one (1) Battle Trainer runners up prize pack, comprised of: 1 x Harry Potter Battle Trailer Sword (RRP $69.95)
1 x Harry Potter Moulding Kit (RRP $14.95) 1 x Harry Potter Mirco Puzzle (RRP $12.95)
14. The total prize pool for the Competition is $3246.90.
15. Prizes are not transferable or redeemable for cash. The Promoter accepts no responsibility for any variation in the value of the prizes.
16. Within 14 days of the Competition ending winners will be notified of the prize they have won and how the prize will be delivered. . All reasonable efforts will be used to contact prize winners. If the Promoter is unable to contact a prize winner after reasonable efforts or if a prize winner fails to claim a prize within 3 months of being notified, the Promoter may reaward the unclaimed or undistributed prize to the next most creative entry.The prize remains the property of the Promoter until claimed by the prize winner.
17. The Promoter reserves the right to substitute any prize for an item of similar value.
18. The Promoter reserves the right to use the winner’s name, voice, and likeness for advertising and publicity purposes in any media in perpetuity without additional compensation.
19. The Promoter accepts no responsibility for any additional costs that may be associated with a prize, or any loss or damage.
20. By entering, entrants agree that the Promoter, their respective parent companies, affiliates, subsidiaries, advertising and promotions agencies, and their respective officers, directors, and employees shall not be liable for injury, loss (including but not limited to indirect or consequential loss), or damage of any kind resulting from participating in this promotion or from the acceptance or use/misuse of the prize awarded. This includes, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
21. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
22. In the event of war, terrorism, state of emergency, disaster or cancellation, the promoter reserves the right to cancel, terminate, modify or suspend the promotion.
23. The judge’s decision is final. No correspondence will be entered into.
24. All entries become the property of the Promoter and may be used for promotional purposes. By entering the Competition, each entrant consents to their personal information being entered on to a database. Subject to the Promoter’s privacy policy. Entrants who do not want their personal information used for the above purposes, or who want to gain access to or correct their personal information should contact the Promoter.
25. The Promoter is Nickelodeon Australia Management Pty Limited (ACN 071 493 340), 5 Thomas Holt Drive, North Ryde NSW 2113.
26. These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
