BRIDES OF ADELAIDE - $10,000 JENNY & GERRY’S WEDDING GIVEAWAY



1.Unless otherwise advised, these Terms and Conditions apply to Brides Of Adelaide promotions as nominated below. Information on how to enter and prizes for each Brides Of Adelaide promotion form part of these Terms and Conditions. Participation in a Brides of Adelaide promotion is deemed acceptance of these Terms and Conditions. The Promoter is Design Channel, PO Box 6005 Halifax Street Adelaide SA 5000 (ABN 33 868 026 133).

2. The Promoter reserves the right to cancel or postpone the competition in the unlikely situation of a natural disaster or extreme unforeseen event.

3. This competition is open to Australian residents only. The competition is open to all readers excluding all employees and family of employees of the Promoter or advertisers. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion (including Jenny & Gerry’s Bridal Centre) are ineligible. Entrants must be 18 years of age or over at the date of the draw. For entry to be valid, all questions must be answered including all contact details.

4. Unless indicated otherwise, entrants may enter:

(i) By mail: Each mail entry must be in a separate envelope, on a completed official entry form (from the January 2011 issue of Brides Of Adelaide Magazine Vol.2 No.2) and posted to Design Channel, PO Box 6005 Halifax Street Adelaide SA 5000 ; or

(ii) In person: Each entry must be in a separate envelope, on a completed official entry form (from the January 2011 issue of Brides Of Adelaide Magazine Vol.2 No.2) and placed in the competition entry box in the foyer of Jenny & Gerry’s Bridal Centre, located at 54-58 Payneham Road, Stepney SA 5069.

5. Multiple entries are permitted, however: (a) each entry by must be submitted separately and in accordance with the entry requirements outlined above and (b) only one prize will be awarded.

6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable, inaudible or illegible entries will be deemed invalid. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to verify the identity of the entrant.

7. Jenny & Gerrys Bridal Centre (ABN 87057864132) agrees to supply the prize to the value of $10,000.

8. Unless indicated otherwise, entry opens at 00.01 on 24/01/2011 and entries close 23.59 on 30/06/2011 AEDT. The draw will be held on Friday 1st July 2011 at 10:00am at 101 Halifax Street, Adelaide SA 5000 and the winner will be notified by mail. The first valid entry drawn will receive the total prize value of $10,000 made payable to the winner in the form of vouchers claimable for products from Jenny & Gerry’s Bridal Centre departments including Jenny & Gerry’s Bridal, Glamour Room, Gerry’s Suit Hire and Giftables. Photos and description of prizes are an indication only and actual prizes may differ from what is shown.

9. Prize vouchers are not transferable to or interchangeable between Jenny & Gerry’s Bridal Centre departments and will be forfeited if orders are cancelled. The promoter takes no responsibility for lost or stolen vouchers. Lost or stolen prize vouchers will not be reissued or replaced. If the products/services chosen are of greater value than the prize, the difference will be paid by the competition winner. Unused vouchers will not be refunded or credited and will be forfeited after the prize claim by date.

10. All products and services selected will be calculated on the full retail price of the product/service. Any store discounts or promotional offers will not be applied. Should the winner have already placed any orders and deposits in any of the Jenny & Gerry’s Bridal Centre departments prior to being announced as the winner, prize vouchers may only be used towards any balances owing and/or new products/services. Refunds will not be issued for any previous monies paid.

(i) Jenny & Gerry’s Bridal Gown Voucher: Voucher must be presented at time of order and orders are not subject to cancellation once the order has been processed. Order cancellations are not refundable or transferable to other goods or departments. The voucher is for a single wedding gown only and accessories such as headpiece, veil, jewellery or shoes. Gown may be ordered or selected off the rack to the voucher value. Approximately 4-6 months should be allowed for delivery of ordered gowns. Floor stock/sale gowns cannot be exchanged for other goods/services and are accepted as seen. The prize value does not include alteration charges, hoop hire or dry cleaning.

(ii) Glamour Room Voucher: Voucher must be presented at time of order. Orders are not subject to cancellation once the order has been processed and order cancellations are not refundable or transferable to other goods or departments. The prize value does not include alteration charges or re-order charges should gowns need to be re-ordered for any reason.

(iii) Gerry’s Suit Hire Voucher: Gerry's Suit Hire voucher can only be used towards any products in the hire department and cannot be used towards the purchase of products in their store or other departments. Voucher must be presented at time of order and orders are not subject to cancellation once the order has been processed. The prize does not include the bond money or accidental damage waiver (ADW) paid by the hirer to cover the hirer against any liability to Gerry’s Suite Hire for loss or damage to a garment that occurs as a consequence of the fault or negligence of the hirer.

(iv) Giftables Voucher: Giftables voucher can be used towards any special orders of wedding invitations or bomboniere and also any products physically in stock. Voucher must be presented at time of order and orders are not subject to cancellation once the order has been processed. Order cancellations and are not refundable or transferable to other goods or departments.

11. The Promoter's decision in relation to any aspect of the competition is final.

12. The prize is subject to availability, is non-returnable, is not redeemable for cash, must be claimed prior to Friday 30th September 2011 and must be used prior to 30th June 2012.

13. Without limiting the forgoing, unless expressly stated in the terms and conditions all other expenses are the responsibility of the winner. Prizes are subject to the standard terms and conditions of individual prize department suppliers. It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize.

14. Unless otherwise stated, all prizes are valued in Australian dollars and include GST. Prizes, including any unused portion, are not transferable or exchangeable and cannot be taken as cash.

15. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

16. If any Design Channel promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate, postpone or cancel the promotion, as appropriate.

17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical product malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of, or participation in, any prize.

18. Winners may be required to provide satisfactory identification and sign a winner's deed of release or any other relevant forms or agreements that the Promoter deems necessary before a prize may be awarded.

19. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

20. The total prize value is $10,000 and includes:
