Ben & Jerry’s are looking for 8 legen-dairy campaign managers to rally for their favourite flavour in the run up to annual Free Cone Day on 12th April 2011

Each Flavour Campaigner will receive an iPhone 4 to capture their journey. The ultimate winner will win a trip to any Ben & Jerry’s Scoop Shop in the whirled.

A Dairing-licious Challenge will also pop up along the campaign trail. It may just present the opportunity to go to Vermont, the home of Ben & Jerry’s! So be prepared for anything.

TERMS AND CONDITIONS OF ENTRY - Ben & Jerry's 2011 Flavour Election

1. Information on how to enter and prizes form part of these Terms and Conditions. Submission of an entry into this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to all Australian permanent residents aged 18 years and over. Employees, Directors and their immediate families of the Promoter and printers, suppliers, providers and agencies associated with this promotion are ineligible to enter.
3. Competition opens on February 7th, 2011, 12pm and Promotion period ends at February 20th, 2011, 6.00 pm. (The "Promotional Period").
4. The competition is made of two phases:
Phase 1: Flavour Campaigners recruitment Entrants will apply for a chance to become one of eight Flavour Campaigners in the Ben & Jerry's 2011 Flavour Election. The promoter will fly all Flavour Campaigners to Sydney for a Flavour induction. One night accommodation will be catered for. The Flavour Induction is mandatory. Successful entrants who do not attend the Flavour Induction will not be able to go ahead and will be replaced. Flavour Campaigner will receive a Flavour Election pack, which includes an iPhone 4, 10 x tee shirts, 2,000 bumper stickers, 1,000 badges, 5,000 postcards, 50 x posters, 1 x sandwich board and 2 x picket signs.
Phase 2: The Election Flavour Campaigners will have to campaign for their flavour by getting people to vote for their flavour online at www.flavourelection.com.au and www.benandjerry.com.au/flavourelection or on facebook http://on.fb.me/flavourelection. The promoter will assist each Flavour Campaigner in setting up a sampling event for their Flavour. Flavour Campaigners will also have the opportunity to organise a "Dairing-Licious" move. The idea will have to be pre-approved by the promoter. Full requirements about the role and responsibilities will be provided to the Flavour Campaigners during the Flavour Induction.
5. To enter, entrants must, during the Promotional Period, enter by applying online at www.flavourelection.com.au and www.benandjerry.com.au/flavourelection or on facebook http://on.fb.me/flavourelection. From here all participants will have to answer three questions and submit a video about themselves. The skill-based competition will give entrants the opportunity to become one of eight (1 of Cool "Flavour Campaigner" to campaign for their favourite flavour.
6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. Incomplete, indecipherable, or illegible entries will be deemed invalid.
8. Only one entry per person is permitted.
9. There will be three rounds of judging during the promotion.
a. Eight flavour campaigners will be selected on February 20th, 2011, 10am. (Flavour Campaigners Prize)
b. The flavour campaigner who gets the most votes will win a trip to any Ben & Jerry's Scoop Shop in the world. Judging will take place on April 13th, 12pm. The winner will be notified via email prior to April 15 th (Grand Prize)
c. The best "Dairing-licious Move" will be rewarded with a trip to Vermont, the home of Ben & Jerry's ice cream (Runner Up Prize)
10. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on the answers submitted by entrants (Flavour campaigners Prize) and the number of votes each flavour received (Grand Prize). The participant with the best "daring-licious" move will be rewarded with a trip to Vermont (Runner Up Prize). The Promoter's decision is final and no correspondence will be entered into.
11. Flavour Campaigners Prize: The best eight (Cool entries will be selected to each represent a flavour in the Flavour Election. Each Flavour Campaigner will receive an iPhone 4 to document their effort throughout the election. The Flavour Campaigners Prize value is of is $4835.25, with 8 winners the total value is $38,682.00. Flavours will be allocated to each Flavour Campaigner at the absolute discretion of the Promoter.
12. Runner Up Prize winner: The Flavour Campaigner with the best "daring-licious" move will receive flights and accommodation for 2 persons to Vermont, United States of America. The Runner Up Prize will include return flights from Australia to Vermont. The winner will have the opportunity to take a free day tour to the Ben & Jerry's Vermont factory. The prize includes travel for two persons from Australia to Vermont, United States of America within the 12-month period from the 13th of April 2011 to the 13th of April 2012. Accommodation caters only for 3 days. Accommodation does not include meals, drinks or breakfast. Transfers from the airport to accommodation destination will be catered for. The mode and times of transport will be chosen by the Promoter in its discretion. The Runner Up Prize value is of $10,000.
13. Grand Prize: The Flavour Campaigner who receives the most votes for his/her flavour will win a trip to any Ben & Jerry's scoop shop around the world. The prize includes travel for two persons from Australia to any Ben & Jerry's Scoop Shop in the world within the 12-month period from the 13th of April 2011 to the 13th of April 2012. Accommodation caters only for 5 days. Accommodation does not include meals, drinks or breakfast. Transfers from the airport to accommodation destination will be catered for. The mode and times of transport will be chosen by the Promoter in its discretion. The Grand Prize value is $15,000. The winner also receives the opportunity to select a charity from a list of approved charities compiled by the Promoter at its absolute discretion, to which a $5,000 donation will be made by the Promoter.
14. Total Prize value is $63,682 (excluding the $5,000 donation).
15. If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
16. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification.
17. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
18. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry, which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
19. All content created by the Flavour Campaigners during the promotion period become the property of the promoter. Flavour Campaigners grant to the promoter and its affiliates a royalty-free license to use your content in any manner or media, globally, forever, without any obligation to Flavour Campaigners. This includes the right to use any ideas submitted (including ideas about products or advertising campaigns) in any manner that the promoter chooses, without any obligation to Flavour Campaigners.
20. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
22. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.
23. Any cost associated with accessing the promotional website and/or email address is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically vote repeatedly is prohibited and will render all entries submitted by that entrant invalid.
24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) the acceptance or use of a prize; (g) any act or omission of the Promoter or its associated agencies.
25. The Promoter excludes all liability for any of the Flavour Campaigners' actions during the promotion period.
26. As a condition of accepting the prize, the winners (and any companion/s) must sign any legal documentation as and in the form required by the Promoter / Prize Supplier / organisers in their absolute discretion including but not limited to a legal release and indemnity form.
27. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers, to assist in conducting the promotion. Entry is conditional on providing this information. If entrants indicate their consent on the entry form, each entrant agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
