MTV Classic 80’s Month Competition
Terms and Conditions
1. General
(a) MTV Networks Australia Pty Ltd (ABN 18 107 601 418) of Ground Floor, 4-16 Yurong St East Sydney, Australia NSW 2010 (“MTVNA”) is the promoter of this competition (“Competition”).
(b) Information on how to enter forms part of these terms and conditions (“Terms and Conditions”).
(c) By entering any competition promoted by MTVNA you agree to these Terms and Conditions and any other applicable terms as advised by MTVNA.
(d) For the purposes of these Terms and Conditions, MTVNA includes its parents, related and subsidiary companies, past present and future officers, agents, representatives, employees, and assigns.
2. Entry requirements
(a) Entrants must be residents of Australia who are 18 years of age or older.
(b) The employees, agents and contractors of MTVNA, any of its affiliate, parent or subsidiary companies or any agency associated with the Competition are not eligible to enter the Competition.
(c) Direct family members of any person included in 2(b) are not eligible to enter.
(d) The competition can be entered online via
http://www.facebook.com/MTVCLASSIC.
(e) To enter entrants must:
i) Become a fan of the MTV Australia page.
ii) Obtain the daily code word, available via a daily status update on the MTV Classic Fan page.
ii) Complete the 80’s Month application found on the 80’s MONTH tab on the Facebook page to create an entry.
iii) Fill out all of the required data entry fields in the application to accompany the entry, including the advertised code word.
(f) All entries must include full contact details: name, email address, telephone number and code word.
(g) Any person who fails to provide the full information in the manner requested as part of the entry process will not be eligible for any Competition prize.
(f) Entries to this competition open on 12:01pm (AEDST) Monday 7 February 2011 and close at11:59am (AEDST) on Tuesday 1 March 2011.
(g) Entries received after each day’s closing time will not be eligible for that day’s entry, but may be eligible for the following Daily Competition where the entry is received during the Competition period.
(h) Daily entries will not roll over into the next day’s draw.
(i) The entry validity periods for each daily draw are outlined in the table in Clause 4 (a).
(j) Entrants may enter the competition once a day during the Competition period.
(k) MTVNA accepts no responsibility for lost entries.
(l) Unless otherwise agreed, any personal or confidential information submitted to MTVNA by any person in the course of entering or being otherwise involved in this competition such as name, address, telephone number will be treated in accordance with MTVNA’s Privacy Policy, available at
http://www.mtv.com.au/.
(m) MTVNA reserves the right in its sole discretion to disqualify any individual who MTVNA has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. MTVNA’s legal rights to recover damages or other compensation from such an offender are reserved.
3. Draw
3.1 Game of Chance
(a) All entries that are received over the Competition Periods outlined in the table in Clause 4 (a) will be entered into a daily draw (“Daily Competition”). One valid entrant will be drawn at random to become the winner (“Daily Prize Winner”).
(b) Each Daily Prize Winner will be notified by telephone within two business days of the Daily Competition for which they have been drawn as the Daily Prize Winner, and will also be notified in writing via email. Any winners of prizes valued over $250 will be published in the public notices section of The Australian newspaper on Tuesday 15 March 2011.
(c) The draws for each Daily Competition will take place at Ground Floor, 4-16 Yurong St East Sydney NSW 2010, on the dates outlined in the table in Clause 4 (a) at 2:00pm (AEDST) daily.
3.2 General
(a) Prize winners will be notified by at the details provided in the entry. All reasonable efforts will be made to contact prize winners.
(b) If MTVNA is unable to contact a prize winner after reasonable efforts or if a prize winner fails to claim a prize within 3 months of being notified MTVNA may conduct a redraw for the unclaimed or undistributed prize subject to State Regulation.
(c) Subject to State Regulation, an unclaimed prize draw will take place at Ground Floor, 4-16 Yurong St East Sydney NSW 2010 on Wednesday 1 June 2011 at 12:00 (AEST) and any winners will be notified by telephone within two days of the draw and will also be notified in writing and winners of prizes valued over $250 will be published in the public notices section of The Australian newspaper on Wednesday 15 June 2011.
(d) The decision of the judges is final and MTVNA will not enter into correspondence or communication regarding the judges’ decisions even where MTVNA may not have acted reasonably or where MTVNA is shown to have made a decision in error.
4. Prizes
(a) There will be 22 Daily Prize Winners in total. Each Daily Prize Winner will win the prize outlined in the table below, corresponding with the day for which they have been drawn as the Daily Prize Winner.
(b) The total prize pool is valued at a maximum of $2024.85.
(c) Once a prize has been collected MTVNA is not responsible for the use or distribution of any prize.
(d) MTVNA will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this competition.
(e) If a prize referred to in this competition becomes unavailable for any reason MTVNA reserves the right to substitute that prize for a similar item of similar value. subject to State regulation.
(f) Prizes are not transferable or redeemable for cash. MTVNA accepts no responsibility for any variation in the value of the prizes, subject to State regulation.
(g) Prize winners agree to participate in any promotional activity promoting MTVNA, prize sponsors and/or the competition at the reasonable request of MTVNA.
(h) MTVNA may require any person collecting or receiving a prize to show photograph identification and/or sign a deed declaring that they have collected or received the prize before MTVNA gives the Prize over.
(i) Unless expressly stated all other costs and expenses associated with taking any prize under this Competition become the responsibility of the winner.

(l) Neither MTVNA nor Facebook will be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this Competition.
(m) The promotion is not sponsored, endorsed, administered by, or associated with Facebook.
(n) Any questions, comments or complaints about the Promotion should be directed to MTVNA at the address given in Clause 1(a) of these Terms and Conditions, and not to Facebook.
5. Intellectual Property
(a) MTVNA may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or prize winners’ performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.
(b) Any material, including without limitation competition entries and images and/or audio-visual material included in competition entries, submitted or provided by a competition entrant, and/or prize winner in association with any competition will become the property of MTVNA and MTVNA may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.
(c) MTVNA may require an entrant or prize winner to execute any document necessary to give effect to 5(a) and/or (b).
6. Warranties
(a) Entrants warrant and represent to MTVNA that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law of Australia or any law of New Zealand.
(b) Entrants indemnify MTVNA against any claim, loss or damager suffered by MTVNA as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Terms and Conditions.
(c) If MTVNA becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to MTVNA, MTVNA may deem that prize winner ineligible.
7. Governing Law
These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
8. Permits
This Competition is authorised under NSW Permit Number LTPS/11/00965 and ACT Permit Number TP 11/00361.1
