“Gold Class Escape” – Birch, Carroll & Coyle Garden City Promotion

1.Information on how to enter forms part of these conditions of entry.

2.Entry is open to Australian residents of QLD who are at least 18 years of age and spend $60AUS or more on food and/or beverage in the Gold Class Lounge of BCC Garden City. Entry is open to all cinema patrons who purchase the Gold Class Aphrodisiac Experience for $130AUS per couple. All entrants must complete and hand in an entry form that will be presented to qualifying patrons in the Gold Class Lounge.

3.The Promoter, other entities and agencies associated with this competition, their related bodies corporate and each of their officers, agents, employees and immediate family of any of them are ineligible to enter. “Immediate family” means spouse, parent, child or sibling, whether or not they live in the same household as the employee.

4.By entering this promotion, Eligible Participants agree to be bound by these terms and conditions. The Promoters reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.

5.The competition commences at 12.01am AEST on 12/2/2011 and closes at midnight AEST on 13/3/2011 (‘Promotion Period’).

6.To enter, customers must have committed to a transaction of $60 or more on food and/or beverage in the Gold Class Lounge of BCC Garden City or purchased a Gold Class Aphrodisiac Experience for $130AUS per couple.

7.No responsibility will be taken by the Promoter for any ineligible or lost entries or entries submitted or received by the Promoter after the closing date. Entries that do not comply with these terms and conditions are incomplete, or submitted or received by the Promoter after the closing date will be declared void.

8.The competition prize draws for the winners will take place on the following dates at the office of the Promoter, located at BCC, Garden City Shopping Centre.
a.21/2/2011 at 12.00 midday AEST
b.28/2/2011 at 12.00 midday AEST
c.7/3/2011 at 12.00 midday AEST
d.14/3/2011 at 12.00 midday AEST

9.The winner will be contacted immediately via phone or email relying on contact details provided by the entrant. The winners will also be announced on the BCC Garden City Facebook page


10.The first eligible entry drawn will win a Major Prize each week for four weeks.

Major prize details:

•Two nights accommodation for two people including two breakfasts and one dinner in a Spa room of the Rydges Oasis Resort in Caloundra.
•Value - $554AUS

11.Prizes are not transferable or exchangeable or redeemable for cash or any other goods or services nor can they be re-sold. The Promoters accepts no responsibility for any variation in the value, performance, or availability of any prize. The Promoters reserve the right to substitute the advertised prize for a prize of equivalent or greater retail value if, for any reason beyond the Promoter’s control, the Promoters are not able to give the prize-winner the advertised prize, subject to State legislation. Any incidental costs relating to the prize are the responsibility of the winner.

12.If the prize is not available from Rydges Oasis Resort due to demand in availability, the Promoter reserves the right to substitute a prize of similar theme and value.

13.Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner. The winner is responsible for all expenses including but not limited to the expense of travel to and from the resort, additional meals and beverages.

14.The Promoter reserves the right to redraw the prize in the event of an entrant failing to comply with these terms and conditions or forfeiting or not claiming the prizes by 28/3/2011. If the prize remains unclaimed by that date, a second draw will be held at 12.00pm AEST on 29/3/2011 at the same location as the original draw. Disposal of any unclaimed prizes may be made subject to any written directions given by any government authority and pursuant to any relevant legislation. All unclaimed prize draw winners will be contacted by phone and mail immediately. Any winner/s will also be announced on BCC Garden City Facebook page on 30/3/2011.

15.The Promoter, other entities associated with this competition and their related bodies corporate, and each of their officers, employees and agents shall not be liable for and shall be held harmless in respect of any loss, damage, or injury whatsoever which is suffered (including but not limited to direct or consequential loss) or sustained, as a result of or arising from the winner’s acceptance and use of the prize, except to the extent that any such liability cannot be excluded by law.

16.Entry details remain the property of the Promoter. Acceptance of the prize is deemed to be acceptance by the winner of these terms and conditions and approval to use the winner’s name and photograph for publicity purposes, unless specifically requested by the winner not to do so at the time of accepting the prize.

17.If the competition does not run for its duration due to, but not limited to, computer viruses, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the Promoter’s control that corrupts or affects administration, security, fairness or proper conduct of the competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process. The Promoter will not be responsible for:

(a)Malfunction, delay or traffic congestion on any telephone network or line, computer on-line system, servers or providers, computer equipment, software, or website;

(b)Failure of any entry to be received by the Promoter as a result of those matters; nor

(c)Any injury or damage to entrants or any other person related to or resulting from participation in the competition or downloading any materials relating to the competition.
