Terms and Conditions – carsales.com.au Electric Dream T&C's
1) General
a) Information on how to enter forms part of these conditions. Entry into the competition constitutes acceptance of these terms and conditions.
b) The Promoter is carsales.com Ltd, Level 1, 109 Burwood Road, Hawthorn, Victoria 3122.

c) For the purposes of the Terms and Conditions, carsales.com Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
2) Entry Requirements
a) Entry is only open to Australian residents who are 25 years and over, who hold a current valid Australian driver’s license. Employees of the Promoter and their immediate families and agencies associated with this Promotion are ineligible to enter.
b) The Promotion commences at 4:00am AEDT on Thursday 3rd February 2011 and entries close at 4:00am AEDT on Wednesday 16th March 2011 (the Promotion Period).
c) To enter the Promotion, participants must visit
www.carsales.com.au/electricdream and follow the prompts to participate in the ‘carsales.com.au and Mitsubishi iMiEV Electric Dream Reporter Competition’ (the Promotion). Entrants need to enter all required fields for the entry to be valid.
d) Entrants can enter as many times as they want during the Promotion Period.
e) To win, the entrant must tell us in 25 words or less ‘why they should win the electric dream and become the carsales.com.au Mitsubishi iMiEV reporter’. Entrants will also be required to answer a series of questions, including: (a) does the entrant have a garage with power supply and an outlet to house the Mitsubishi iMiEV for three months; (b) can the entrant’s place of residence support 15 amp power supply; and (c) how far does the entrant travel each day on average. The best answer, as judged by the Promoter, will win the carsales.com.au Mitsubishi iMiEV electric car to drive for three months, plus an iPhone 4 16GB with a Prepaid Data MicroSim (please note this will include data only, not calls and messaging).
f) The Promotion will be judged based on skill and chance plays no part in determining the winner. Each entry will be individually judged based on a combination of literary and creative merit and originality. There will be one (1) winner selected.
3) Prize
a) The best entry, based on skill, will win the carsales.com.au Mitsubishi iMiEV electric car to drive for three months (valued at $5,220), comprehensive motor insurance for three months (value to be determined), contribution to the winner’s electricity bill to recharge the Mitsubishi iMiEV for three months (valued at $300), and an iPhone 4 16GB (valued at $859) with a Prepaid Data MicroSim (valued at $100). The entire prize is valued at more than $6,479. The prize will also include the costs associated with an electrician, should the winner’s place of residence need to be upgraded to 15 amp power supply to recharge the Mitsubishi iMiEV.
b) The entrant who is declared the winner of the Promotion will be required to sign the Winner’s Agreement.
c) The prize may not be transferred or substituted except at the Promoter’s discretion. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability. Any tax on the prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this Promotion.
d) The prize will be delivered to the address as registered in the winning entrant’s entry, unless otherwise agreed upon.
e) The Promoter shall not be liable for any costs associated with the iPhone and prepaid data microsim prizes after delivery.
f) The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for the liability that cannot be excluded by law.
g) The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries.
4) Judging
a) The judging of all the entries will take place at carsales.com Ltd, Level 1, 109 Burwood Road, Hawthorn Victoria 3122 on Friday 11th March 2011 at 11:00am.
b) The winner will be notified via telephone and email within two (2) business days of the judgement occurring.
c) The winner of the Promotion will be published on
http://www.carsales.com.au and in The Australian Newspaper week commencing Monday 14th March 2011.
d) Should the Promoter not be able to make contact with the chosen winner within 14 days after making a judgement, or if the chosen winner refuses to sign a Winner’s Agreement, the Promoter reserves the right to re-judge the Promotion and choose a different winner.
e) Should item 4e come into effect, re-judging of the Promotion will take place at carsales.com Ltd, Level 1, 109 Burwood Road, Hawthorn Victoria 3122 on Friday 25th March 2011 at 11:00am. The winner will be notified via telephone and email within two (2) business days of the re-judgement occurring. The winner of the re-judged Promotion will be published on
http://www.carsales.com.au and in The Australian Newspaper week commencing Monday 28th March 2011.
f) The judge’s decision is final and no correspondence will be entered into.
5) Entries
a) All entries become the property of the Promoter.
b) By entering the Promotion each entrant agrees to be entered onto the Promoter’s database and gives consent to the Promoter using the entrant’s name, email address and telephone number, including to send the entrant electronic messages.
c) The winner’s name and photographs may be used for any future promotional, marketing and publicity purposes in any media worldwide.
d) The Promoter may require an entrant or prize winner to execute any document necessary to give effect to item 5a.
6) Warranties
a) The Promoter does not take any responsibility for any costs associated with entering and/or accessing this Promotion including and not limited to internet service provider costs and the prize allowance.
b) If for any reason this Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the Promotion or to disqualify any individual who has tampered with the entry process.
c) In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may, in its absolute discretion, cancel the Promotion and/or recommence it from the start on the same conditions subject to state legislation.
d) If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to, the Promoter may deem that prize winner ineligible.
e) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize vale to that stated in these Terms and Conditions of entry; (e) any tax liability incurred by the winner or entrant; and/or (f) redemption of the prize.
7) Reporting Obligations
a) As agreed upon through Your entry to the Promotion, You are required to submit a minimum of one editorial piece per week to the Promoter for publishing over the three month period in which you have possession of the Vehicle.
b) Your editorial pieces should consist of Your feedback and thoughts on the Vehicle, including Your honest and unbiased opinion regarding the general performance of the Vehicle.
c) Your editorial pieces will be monitored and edited by a representative of the Promoter.
d) Your editorial pieces will be both posted and tweeted to the carsales.com.au Facebook and Twitter pages, and may be published on any site as owned by the Promoter.
e) Once submitted, Your editorial pieces become copyright property of the Promoter.
f) The Promoter reserves all copyright and publishing rights at their discretion.
g) You unconditionally waive all moral rights (as defined in the Australian Copyright Act 1968) You may have in respect of the editorial pieces.
