'Be SCENE to be GREEN competition'

The Observatory Port Macquarie – Southern Cross Resorts Pty Ltd

Terms and Conditions

1.Entry is open to Australian residents only.
 
2.There are no age restrictions on entry.
 
3.Employees of Southern Cross Resorts Pty Ltd and their immediate families are not permitted to enter.
 
4.The competition commences on 17 March 2011 and closes at midnight on 30 June 2011.
 
5.To qualify applicable persons must submit an online video of their eco-responsible practices and within the video provide The Observatory with tips on how they can reduce their carbon footprint. Videos must be submitted on the Observatory website at www.oberservatory.net.au/greencompetition.
 
6.Entrants need to have a You Tube account to enter.
 
7.There is 1 prize. The prize is as follows:
Prize Details: An iPad2 and an eco-friendly holiday at The Observatory Port Macquarie.
Inclusions:

•3 nights' accommodation in a 3 bedroom Penthouse apartment at The Observatory Port Macquarie
•Upgrade to an Observatory 'O-Zone Package' (environmentally themed room)
•2 x 30 minute spa treatments at Endota Spa.
•Champagne and chocolates on arrival.
•An Apple iPad 2
Conditions:

•Prize not transferable or refundable and non-redeemable for cash. 
•The prizewinner and their guest(s) must travel together and share the same itinerary.
•No frequent flyer reward program points can be earned on stay.
•Prize is valid for travel between 1 August 2011 and 31 July 2012.
•Travel restrictions and blackout dates apply. Prize cannot be taken during Easter, Christmas, school holidays and long weekends or during major event periods.
•Prize is subject to availability and conditions.
•Prize is based on 6 people (3 bedrooms). Bedding configuration consists of one king bed, one queen bed and two single beds (or re-configured to a king bed).
•All other incidental costs unless otherwise stated, including any costs related to taxes, visas, meals, beverages, transfers to and from departure points, additional accommodation and insurances will be the sole responsibility of the winner.
Total value of prize: up to $3369
8.The competition is a game of skill.
 
9.Submitted videos must not be longer than 3 minutes in duration.
 
10.Filming on-site at The Observatory is not allowed. This includes Observatory apartments, retail shops, restaurants and common areas such as foyers, reception, pool area, BBQ grounds, car parking and so on. Any entries which include on-site filming or inappropriate material which is not in the spirit of the competition will be in breach of the terms and conditions and will be prohibited from entering.
 
11.All entries will be judged individually and on their merit. Judging will be based on the level of creativity and the environmental tips provided.
 
12.Videos which are deemed inappropriate will not be eligible for entry. This includes, but is not limited to, videos which: fail to meet the entry requirements, negatively portray any organisation or person or contain offensive material.
 
13.The judges' decision is final.
 
14.The competition will be judged by a panel of 4 judges. The judging will take place at 12 noon on Friday 8 July 2011 at The Observatory, 40 William Street, Port Macquarie NSW.
 
15.The winners will be notified on 8 July 2011 by email directy through their You Tube account 'inbox' and direct to their email address linked to their You Tube account (where available). The winner's name will be published on the Observatory website at www.observatory.net.au and the Observatory Facebook page on Monday 11 July 2011.
 
16.The winner consents to the use of their name, suburb of residence and image for promotional and marketing purposes and agrees to participate in reasonable promotional activities as requested by the Promoter.
 
17.To the extent permitted by law, the Promoter is not responsible or liable for:
(i) inaccurate / incorrect transcription of entry information;
(ii) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, sent with insufficient postage (where entry is by post), or sent other than as directed in the entry instructions;
(iii) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems including YouTube or network, servers or providers, computer equipment, or software;
(iv) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any Website;
(v) unauthorised human intervention in any part of the competition;
(vi) electronic or human error which may occur in the administration of the competition;
(vii) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or
(viii) any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in this competition.
 
18.The Promoter will not be liable for personal injury suffered during prize winnings.  The winner, and his or her guests (if any), must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded.  Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and the selection of another winner.
 
19.This condition does not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.
 
20.Should a prize remain unclaimed for 30 days the prize will be awarded to the entry awarded second place on 3 August 2011 at The Observatory, 40 William Street, Port Macquarie NSW. The winners of the unclaimed prize draw will be notified by phone and (e)mail, and published at www.observatory.net.au/greencompetition on 8 August 2011. The winner of the unclaimed prize draw will be offered a prize of equal value to the original prize. The unclaimed prize winner must book by 10 October 2012.
 
21.The Promoter is Southern Cross Resorts Pty Ltd ACN 102 483 349 located at 40 William Street, Port Macquarie NSW 2444.  The personal information of entrants will be collected to enable the Promoter to administer and promote this competition and its winners and may be used to market its services to the entrant.  The personal information of the entrants will be held and used in accordance with the Promotor's privacy policy, which is available at www.observatory.net.au. The personal information of winners may be provided to others assisting, including prize suppliers and deliverers, and to authorities that regulate this competition.  If an entrant does not truthfully provide all requested personal information, the Promoter may determine that they are not eligible to win the prize.
