Terms and Conditions
“Kids Party Games” Promotion – Conditions of Entry1 Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the “Kids Party Games” Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
2 The Promotion commences 4 April 2011 at 10:00am AEST
and closes 31 May 2011 at 11.59pm AEST (Promotion Period).3
Entry is only open to Australian residents who are members of Kleenex Mums. If you are not already a member you can join online at
www.kleenexmums.com.au. Employees (and their immediate families) of the Promoter who are directly involved with administering this Promotion, are ineligible to enter.
Entry
4 This is a game of skill and chance plays no part in determining the winner.
5 To enter (Entry) the entrant must:
(1) log onto
www.kleenexmums.com.au (Kleenex Mums Website);
(2) click on the competition links featured throughout the Kleenex Mums Website or as featured on the Kleenex Mums promotions page
www.kleenexmums.com.au/promotions to enter the Promotion;
(3) complete all the information requested for Entry into the Promotion including:
(a) personal contact information; and
(b) a response between 50 to 300 words to the Promotion question “Share your favourite kids’ party game with us”;
(4) follow the link in the email sent by the Promoter to confirm Entry into the Promotion prior to the end of the Promotion Period.
Judging of Entries
6 All Entries must be the sole work of the entrant.
7 Entries are deemed to be received by the Promoter at the time the entrant confirms the Entry by following the link in the email sent by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
8 An entrant may enter more than once. However, each Entry must contain a new response to the Promotion question.
9 The Promoter and its associated agencies or companies accept no responsibility for any lost, late, stolen, damaged or misdirected Entry.
10 The Promoter has no control over internet or mobile telephone communications, network lines, bugs/ viruses and server problems and accepts no responsibility for any problems associated with them, for whatever reason.
11 Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will void the entrant’s entry.
12 The Promoter reserves the right to validate and check the authenticity of entries and to disqualify any entries which do not meet validation criteria or which are not submitted in accordance with these Conditions of Entry.
13 All valid Entries received during the Promotion Period will be individually judged by a panel of writer experts appointed by the Promoter.
14 All valid Entries will be judged at 10:00 AEST on 7 June 2011 at Kimberly-Clark Australia, 52 Alfred Street, Milsons Point, NSW 2061 having regard to the overall quality of the Entry, including creativity, novelty, composition, creative merit and originality. The best ten (10) entries will win a Prize.
15 The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute.
16 The winners will be notified by email on 10 June 2011. The winners’ names will be published on the Kleenex Mums website by 10 June 2011.
17 If the prize is not claimed by 16 September 2011, the winner will forfeit his or her prize. The Promoter may award a forfeited prize to the next-best entry as determined by the panel of writer experts appointed by the Promoter. The winner of any unclaimed prize will be notified by email on 19 September 2011. The winner of any unclaimed prize will be published on the Kleenex Mums website by 20 September 2011.
Prize
18 The Prize consists of a $50 gift voucher to spend at the online party supply store
www.lovelylittleparties.com.au.
19 The Prize consists of a voucher redeemable through a third party. The Promoter excludes any liability for any voucher that has been lost, stolen, damaged or tampered with in any way. Redemption of each voucher is subject to the terms and conditions imposed by the issuer of the voucher from time to time.
20 Each Prize is valued at $50. There are ten (10) Prizes to be won. Total prize value is up to a maximum of $500. The value of the Prize is accurate and based upon the recommended retail price(s) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.
21 The Prize cannot be transferred, exchanged or redeemed for cash. The Prize must be taken as offered and cannot be varied by a winner. The Promoter retains the right to substitute the Prize with a prize or prizes of equal or greater value (including where the Prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
General
22 All tax liability arising as a result of accepting any prize is the responsibility of the winner.
23 The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of the Promotion or receiving, taking or using the Prize except for any liability which cannot be excluded by law.
24 If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the Conditions of Entry.
25 If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
26 All claims and entries become the property of the Promoter.
27 By entering this Promotion, you grant the Promoter an exclusive, royalty-free, perpetual, worldwide licence to use and exploit your response to the Promotion question by all means whatsoever (including, without limitation, in print and electronic format). In addition, you consent to the Promoter and the Promoter’s related body corporates and agents infringing your moral rights in your response to the Promotion question for an indefinite period of time by:
(1) not naming you as the author of your response to the Promotion question; and
(2) amending or modifying (whether by changing, adding to or deleting/removing) any part of your response to the Promotion question.
28 Responses to the Promotion question (with or without attribution to the author) will be reproduced on the Kleenex Mums Website for an indefinite period of time.
29 The winners agree to participate in any news media activities surrounding the Promotion. The Promoter reserves the right to use the winners’ name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity without additional compensation.
30 The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion, and to third parties as required by law. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request). By entering into this Promotion, each entrant also consents to the Promoter using their personal information for future marketing purposes, unless otherwise advised by the entrant. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
