Application Procedure, Eligibility Requirements and Rules

The Promoter is Ford Motor Company of Australia Limited ABN 30 004 116 223 ("Ford"), whose principal address is 1735 Sydney Road, Campbellfield, Victoria, Australia.

1. Application Procedure

NO PURCHASE IS NECESSARY TO ENTER OR BE SELECTED TO PARTICIPATE. The Program commences on 16 May 2011. There are 2 ways to apply. (1) Applicants can submit an application on their behalf: and (2) Applicants can be nominated to participate by another party. All Applicants will be asked to submit one of the following items or a combination of the following: video or written proposal (with or without a photo) explaining why they should be selected to participate in Ford's The Global Ranger Challenge explaining what challenge they would like to see the all-new Ranger take on which can relate to a task performed on their job, in their community or in and around their town (the "Program"). Applicants must submit their video or written proposal and any pictures and complete the application via the www.fordrangerchallenge.com.au. Applications must be received by 23:59 (AEST) on 19 June, 2011. The time of entry will in each case be the time the registration is received by Ford's database.

2. Eligibility Requirements and Rules

2.1 Employees, officers, directors, dealers and agents of Ford and WPP Group, Wunderman Pty. Ltd., PLC, Team Detroit, Inc., and affiliated and subsidiary companies, representatives, legal advisors, any other advertising, promotion, and fulfillment agencies ("Program Team") and the immediate family or members of their same households (whether related or not) of such employees are not eligible to apply or participate in the Program. Persons applying for the Program are hereinafter referred to as "Applicant." Persons who may be contacted to be considered to participate in the Program are hereinafter referred to as "Potential Participant." Persons who are ultimately selected to participate in the Program are hereinafter referred to as "Participant." The person who is ultimately selected as the winner of the Program is hereinafter referred to as the "Grand Prize Winner".

2.2 Applicants acknowledge that Ford has promoted the Program to its existing customers and that existing Ford customers will be eligible to submit an application. All applications received will be moderated by an external agency prior to Ford selecting the Potential Participants in accordance with rule 3.

2.3 Applicants must be at least 18 years old, and have a full and unrestricted driver's licence issued in Australia and be a citizen of Australia.

2.4 Applicants must complete and submit an application and one of the following:

    a video, no longer than 2 minutes in length (acceptable formats include AVI, MOV, WMV, MP4, MPEG, FLV, 3GP and 3G2 and must not exceed 100MB); or,
    a written proposal with an optional photo (must not exceed 1000 characters and any accompanying image must not exceed 5MB).


    The video or written proposal should illustrate how the Applicant would put the Ranger to the ultimate test. The submission should also address how the Applicant is uniquely qualified to take on their challenge and to participate in Program follow-up activities (refer to rule 4). By submitting an application and video or written proposal (with or without a photo) the Applicant grants Ford, its affiliates and sub-licensees, a non-exclusive worldwide, royalty-free license to use, copy, display publically, distribute, modify and alter any materials, including without limitation video/text/photo material, submitted in connection with the application or the Program (to the extent not assigned to Ford hereunder), with the right to sublicense and assign the foregoing rights. Each Applicant hereby represents that they own all rights to materials, including without limitation video/text/photo material, submitted in connection with their application or the Program.

2.5 In respect of their application (including following submission), each Applicant warrants and represents that:

    the Applicant is the sole owner and author;
    the Applicant has the right to make the video, written proposal, photo available to Ford, as contemplated by these rules;
    each person depicted in the video/photo has granted permission to be portrayed as shown;
    the video/text/photo does not contain personally identifiable information about the Applicant or any other person(s) without their consent with the exception of their name;
    the video/text/photo does not contain any infringing, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, nude, scandalous, inflammatory, blasphemic, pornographic, profane, or illegal content; and
    the video/text/photo does not infringe upon the copyright, trademark, contract rights, or any other intellectual property rights of any third person or entity, or violate any person's rights of privacy or publicity, and the video/text/photo does not prominently include trademarks owned by third parties; copyrighted materials owned by third parties (including music); names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead.

2.6 If selected to participate, in a time frame to be determined by the Program Team, each Applicant must complete, sign, and return any additional Program documents required by the Program Team, before being permitted to participate in the Program. Additional required documents may include, but will not necessarily be limited to, disclosure and authorisation for relevant background reports, authorisation for release of records and information and a vehicle loan agreement (all of which will be furnished to the Applicant and/or are available to view at fordrangerchallenge.com.au). In connection with the disclosure and authorisation for background reports and authorisation for release of records and information, all Applicants must authorise the Program Team to conduct such full and complete background checks of the Applicant as the Program Team, in its sole discretion, deems necessary or appropriate (including but not limited to a police check). Applicants will be required to cooperate fully with the Program Team in connection with such background investigations.

2.7 Each Applicant agrees to treat all information in respect of the Program identified by the Program Team as confidential in nature, as strictly confidential.

2.8 Ford reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Ford, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements or is otherwise in breach of these rules. Ford reserves the right to disqualify any Applicant who tampers with the entry process, who submits an entry that is not in accordance with these rules or who has, in the opinion of Ford, engaged in conduct in entering the Program which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of Ford or the Program. Ford reserves the right to disqualify a Potential Participant or a Participant (including the Grand Prize Winner) if it becomes aware that the Potential Participant/Participant and/or the Potential Participant/Participant's entry is of a type described in this rule or is otherwise in breach of these rules generally.

2.9 The Program Team reserves the right in its discretion to disqualify any Applicant/Participant at any time based on lack of fulfillment of these obligations or other lack of cooperation.

2.10 The Program Team reserves the right to contact Applicants to ask additional questions and/or conduct phone interviews to gather additional information about Applicants. Such phone interviews are at the Program Team's sole discretion to assist in gathering information for Participant selection.

2.11 The Program Team is not responsible for applications not received. Due to the high volume of anticipated applications, the Program Team will not be able to answer any questions about the receipt or status of any application. The Program Team assumes no responsibility and is not liable for any video/text/photo misuse. The Program Team assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilised in the Program, and the Program Team assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the Program. The Program Team assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of applications. The Program Team is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail addressed to the Program Team on account of technical problems, human error or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to an Applicant's or any other person's computer related to or resulting from participation or downloading any materials in the Program. If for any reason an application cannot be viewed or is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorised intervention, fraud or technical failures, the Program Team assumes no responsibility.

2.12 If an Applicant is selected to proceed to the interview round, the dates and times of the Potential Participant interviews will be some time from video/text/photo application submission through to 28 June, 2011. This date may be extended by the Program Team in its sole discretion.

2.13 The Program Team reserves the right to cancel, terminate or modify these rules or the administration of this Program or suspend this Program in whole or in part, without prior notice with no obligation or liability, including if for any reason the Program is not capable of running as planned, whether due to technical failure, or computer virus, tampering, fraud, or corruption of security or proper administration of the Program or other causes beyond the control of the Program Team.

2.14 By submitting an application, each Applicant agrees to release, discharge and hold harmless the Program Team from all claims and damages arising out of or in connection with participation in the application process or the Program itself, and to have the Applicant's name, voice and likeness used at the Program Team's discretion as part of the Program, or as part of promotions arising out of or in connection with the Program, in any and all media now known or hereafter devised as further set forth in the release and waiver at the end of this application.

3. Selection Process

3.1 Submissions will be viewed as they are received and judged based on, but not limited to, creativity, quality of content, challenge submitted and compliance with these rules. Incomplete and incomprehensible entries will be deemed invalid. The Program Team will require each applicant to provide it with details of each Applicant's social media presence and will investigate such social media presence for both quality of content, creation and distribution capability. Applicants are permitted to submit as many unique applications as desired, however each application must be submitted separately and in accordance with these rules.

3.2 A number of Potential Participants (as determined by Ford in its absolute discretion) will be chosen by the Program Team to take part in a phone interview with a panel selected by Ford. From these Potential Participants, the five (5) Participants will be chosen. Participant selection will be made by a panel selected by Ford. Each Potential Participant chosen by the panel will participate in an interview process and Participant selection will be based on, but not limited to, Potential Participant creativity, quality of content, social vibrancy, compliance with these rules, ability and willingness to travel and general acceptance to participate in follow-up Program activities as shown in the application and video/text/photo (as expressed during the phone interview). Participant selection will be based on the above criteria at the panel's discretion. Chances of being selected to participate depend on the number of applications received and the ability to meet the selection criteria above. The panel's decision is final. Selected Participants will be contacted by email within 72 hours of selection and may also be contacted by phone if a selected Participant cannot be reached via email. A list of the Participants will be available at www.fordrangerchallenge.com.au beginning on 2 July 2011. If a selected Participant cannot be contacted within 72 hours of selection or is not able to adhere to Program dates or does not meet all of these rules, alternate Participant(s) will be selected and notified. Under no circumstances, may a Participant transfer their participation to another person.

4. Program follow-up activities.

4.1 Participants must be available for:

    a minimum of 2 days during the period 28 June 2011 to 12 July 2011 to attend the Australian International Motor Show in Melbourne and to complete any necessary driver training courses nominated by Ford (including, but not limited to a product induction, and a defensive driver training course); and
    a minimum of 10 days during the period 24 July 2011 to 30 September 2011 to complete their challenge and film a 2 minute video for public voting purposes.


4.2 Participants may be required to write (or ghost write) reviews of the Ranger, or be available to be interviewed about the Ranger, after completing their challenge (each a "Review").

4.3 Ford will arrange for each Participant to stay in a minimum three star accommodation venue for one night to enable the Participant to satisfy their obligations under rule 4.1(a). Each Participant will also receive breakfast, lunch and dinner while they are in Melbourne, and return transfers from the accommodation venue to the Australian International Motor Show. If a Participant is not located in Victoria, Ford will arrange for return air travel to Melbourne from the Participant's nearest capital city and return hotel – accommodation transfers.

4.4 At the sole discretion of the Program Team, Participants will be provided with loan of a vehicle (subject to the Participant's entry into a vehicle loan agreement with Ford) for a minimum of ten (10) consecutive days during the period 24 July 2011 to 30 September 2011 to film the challenge they nominated in their entry. Participants will also be provided with a fuel card to aid in completing the challenge.

4.5 For up to two (2) of the ten (10) days, Participants will be filmed taking on their challenge in the Ranger by a film crew with the creative assistance of an international director. Participants will be required to allow a production crew to shoot them completing the challenge they nominated in the entry process. Participants will be required (with the assistance of a production team) to produce one (1) x two (2) minute video (at minimum) for the public to vote on. Specific requirements will be outlined in either a phone interview or selection/validation/confirmation interview.

5. Compensation

Participants in the Program will not be entitled to any compensation or employee benefits of any kind from any company, and agree to refrain from seeking same. There will be no cash alternative for any Participant.

6. Privacy

6.1 The Applicants' personal information will be collected by Ford for the purpose of conducting and promoting the Program (including but not limited to determining and notifying the Grand Prize Winner). The Participants' personal information may be disclosed to agencies employed by Ford to conduct the Program. If a Participant is not willing for this to occur the Participant cannot participate in the Program. No further use will be made of the Participants' personal information without prior consent.

6.2 Information collected in connection with the Program will be used in accordance with these rules and Ford's Privacy Policy viewable at www.ford.com.au/privacy. By submitting personally identifiable information in connection with your application, you are agreeing to Ford's Privacy Policy viewable at www.ford.com.au/privacy. You further agree that you will not submit a video/text/photo containing the images or voices of any other person unless you have received prior consent from that person to such submission and his/her consent to use of the video/text/photo in connection with the Program.

6.3 Ford will hold the personal information each Applicant provides through this Program so they can be contacted if they are a successful Potential Participant. If an Applicant consents, it may also be disclosed to Ford's employees, related companies and agents for the provision of marketing services and to help keep them informed of the products and services offered by Ford (by direct mail, telephone or electronic messages). Applicants have a right to access personal information Ford holds about them. 6.4 Participants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to Ford.

7. Prizes

7.1 The five (5) Participants will be invited to the Australian International Motor Show for the official announcement of The Global Ranger Challenge and to fulfill media obligations.

7.2 The five (5) final Participants will take on their challenge where they will be filmed by a film crew who will then create a video showcasing the Ranger in the Participant's nominated challenge. Each Participant's video will be posted on www.fordrangerchallenge.com.au on September 1 2011 and the general public will be given the opportunity to vote via a thumbs up/thumbs down tool. The general public will be required to register and log in to vote ("Voters"). Voters will also go into the draw to win a $250 Fuel Card. Voters may vote for one Participant a maximum of once per day. For full terms and conditions of this promotion, see www.fordrangerchallenge.com.au. Ford reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts.

7.3 The Grand Prize Winner will be selected based on total number of thumbs ups generated during the winner selection phase. The Grand Prize Winner will receive a PX Ford Ranger Double Cab XLT (actual colour to be determined by Ford) with an approximate driveaway value of up to $58,500 (the "Grand Prize"). The Grand Prize value is based upon the recommended manufacturer's list price at the time of printing (inclusive of GST), 12 months registration in the Grand Prize Winner's State or Territory of residence, 12 months compulsory third party insurance, dealer delivery charges, stamp duty and where applicable, luxury vehicle tax. Any other amounts (including comprehensive insurance) are the responsibility of the Grand Prize Winner and are not included in the Grand Prize]. Ford accepts no responsibility for any change in the Grand Prize value between this date and the ultimate Grand Prize redemption date. The Grand Prize cannot be transferred or redeemed for cash. The Grand Prize will be available for collection from an authorised Ford dealership nominated by Ford and must be collected within the period October 15 2011 to November 15 2011 (the dates of this period are subject to change at Ford's discretion however the length of the period will not be changed). Ford will endeavour to nominate the closest Ford dealership to the Grand Prize Winner's residential address. If the Grand Prize Winner fails to collect the Grand Prize within the specified period then the Grand Prize will be forfeited and Ford, in its absolute discretion, reserves the right to award the Grand Prize to the entry that receives the next greatest number of thumbs up during the winner selection phase. If the Grand Prize is unavailable for whatever reason, Ford reserves the right to substitute the Grand Prize for a prize of equal or greater value, subject to State regulation. Independent financial advice should be sought as tax implications may arise as a result of accepting the Grand Prize. The Grand Prize Winner is responsible for any personal tax liability.

7.4 Each of the 4 runner up Participants will receive a fuel gift card valued at $500 (each a "Runner Up Prize"). No Runner Up Prize (or part thereof) can be transferred or redeemed for cash. If a Runner Up Prize is unavailable for whatever reason, Ford reserves the right to substitute a Runner Up Prize for a prize of equal or greater value, subject to State regulation.

7.5 Unless expressly stated in these rules, all other expenses become the responsibility of the winner.

7.6 Once prizes have left Ford's premises, Ford takes no responsibility for prizes damaged, delayed or lost in transit.

7.7 It is a condition of accepting a prize that the relevant winner:

    must comply with all the conditions of use of the prize and the prize supplier's requirements; and
    may be required to sign a legal release in a form determined by Ford in its absolute discretion.

7.8 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Ford (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Program.

7.9 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Ford (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under Ford's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Ford) due to any reason beyond the reasonable control of Ford; (d) use of a prize or participation in the Program.

8. Acknowledgement of Applicant

Each Applicant hereby acknowledges that:

    the Applicant has read, and meets and agrees to be bound by, the above eligibility requirements and rules;
    all information submitted in either the video/text/photo and/or application is honest and accurate;
    if any of the above information is found to be false, this will be grounds for dismissal from the selection process, and/or from the Program, if selected;
    even if the Applicant meets the eligibility requirements, the Applicant understands that there are no obligations to interview the Applicant, and/or select the Applicant as a Participant;
    subject to applicable law, Ford or the Program Team reserves the right to cancel, terminate, modify these rules or administration of or suspend this event in whole or in part without prior notice with no obligation or liability, including if for any reason the event is not capable of running as planned, whether due to technical failure, computer virus, tampering, fraud, corruption of security or proper administration of the event or other causes beyond the control of the Program Team;
    all decisions by the Program Team and Ford concerning selection of the Participants and the Program generally are final and not subject to challenge or appeal; and
    except for any liability that cannot be excluded by law, the Program Team excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Program.

9. Applicant Consent

By submitting this application, each Applicant hereby consents to the recording, use and reuse by the Program Team and any of their respective licensees, assigns, parents, subsidiaries, divisions, business units, or affiliated entities and each of their respective employees, agents, officers and directors (collectively "Releasees") of the Applicant's voice, actions, likeness, name, appearance and biographical material (collectively "Likeness") in any and all media now known or hereafter devised, worldwide, in perpetuity, in or in connection with the Program. The Applicant agrees that the Releasees may use all or any part of the Applicant's Likeness, and may alter or modify it, regardless of whether or not it is recognisable. The Applicant further agrees that the Releasees may use the Applicant's Likeness, and the Applicant hereby assigns and agrees to assign to Ford the content developed and generated as a result of the Applicant's selection as a Participant in the Program (including any Review written by the Applicant). Without prejudice to the foregoing, the Releasees may use the content developed and generated by the Program (including any Review) in connection with any promotion, publicity, marketing or advertisement arising out of or in connection with the Program in any manner whatsoever. The Applicant releases the Releasees from any and all liability arising out of its use of the Applicant's Likeness, the video/text/photo and/or the Review. The Applicant hereby acknowledges and affirms that all actions and statements made by the Applicant are the Applicant's own, made of the Applicant's own freewill, and are truthful to the best of the Applicant's knowledge. The Applicant agrees not to make any claim against the Releasees as a result of the use of the Applicant's Likeness, video/text/photo and/or the Review (including, without limitation, any claim that such use invades any right or privacy and/or publicity).
