Cenovis is giving 10 local clubs the good stuff they need to keep going. It's easy to enter and the rewards are great, so keep reading and then get on with your entry!

How to Enter:
1. Get an entry team together (only one entry is permitted per club so make sure everyone knows about the team that will be driving your entry).
2. Go online - tell us what you would do with $5000 and why you deserve to win it.
3. Get Votes: tell your club members their friends and family to vote for your club online.

Two Ways to Win:
1. Get the most votes: 5 grants will be awarded to the club in each state group (NSW,VIC, QLD, WA/SA, NT/ACT/TAS) that gets the most votes online per club member.
2. BONUS PRIZES: Even if your club does not have the most votes, you still have a chance to win. 5 grants will be awarded based on the quality of their answers from a shortlist of 30 clubs that get the most votes nationally. (regardless of state)



Terms & Conditions

1.Information on how to enter and prizes form part of these Terms and Conditions. Registration for and/or participation in this promotion is deemed acceptance of these Terms and Conditions.

2.Entry for this promotion commences at 00.01 (AEST) on Sunday 22nd May 2011 and closes at 23.59 (AEST) on Sunday 21st August 2011 (“Promotional Period”). Voting for this promotion commences at 00.01 (AEST) on Sunday 22nd May 2011 and closes at 23.59 (AEST) on Sunday 21st August 2011 (“Voting Period”).

3.Entry into this promotion is only open to any Australian not-for-profit sports or community/recreational clubs which provide services to children under the age of 18 (“Eligible Club”). Eligible Clubs must retain any returns generated to benefit its members.

4.Employees of the Promoter and agencies directly associated with this promotion are ineligible to enter.

5.To enter, an authorised representative (aged 18 years or over) of an Eligible Club must on behalf of the Eligible Club, during the Promotional Period:
Visit www.cenovis.com.au (“Promotional Website”) and follow the prompts to the online entry form;

Fully complete and submit the online entry form in order to receive an email from the Promoter.

The online entry form must include the full registered club/group name, total number of club members,club/group address, a contact name, daytime phone number (including area code), mobile phone number (if applicable), a valid email address, and answers to the promotional questions: (a) ‘what good stuff will your club purchase with the grant?’, and (b) ‘why does your club deserve to win the grant?’ to be eligible. Incomplete or indecipherable entries will be deemed ineligible; and

Follow the prompts on the email received from the Promoter to validate their entry.

For the purposes of this promotion, a club member is considered to be any individual who is a registered member of the Eligible Club and whose membership can be formally verified by the Eligible Club.

6.Only one (1) entry per Eligible Club is permitted.

7.Upon completion of the above steps, subject to verification by the Promoter, Eligible Clubs will then have their details uploaded onto the Promotional Website for public voting. 

8.To cast a vote, individuals must visit the Promotional Website and follow the prompts to vote for their favourite Eligible Club, in order to receive an email from the Promoter. To finalise the vote, individuals must follow the prompts on the email received from the Promoter to validate their vote during the Voting Period (“Voter”).

9.Voters will not be eligible to win a prize.

10.Limit of one (1) vote per Voter per Eligible Club during the entire Promotional Period, however, the Voter may vote for multiple Eligible Clubs.

11.The Promoter reserves the right, at any time, to verify the validity of entries, Eligible Clubs (including an Eligible Club’s identity and place of practice), club members (including club members’ identities) and Voters (including a Voter’s identity and place of residence) and to disqualify any Eligible Club and/or Voter who submits an entry/vote that is not in accordance with these Terms and Conditions or who tampers with the entry/voting process. The Promoter may request any documentation (as and in the form required by the Promoter) from an Eligible Club or Voter, in order to determine their legitimacy and eligibility to participate in this promotion and the membership of an Eligible Club, in its absolute discretion. In addition, the Promoter may request any documentation (as and in the form required by the Promoter) from an Eligible Club in order to verify that the Eligible Club is registered with the relevant Commonwealth, State or Territory regulatory/peak representative body (including but not limited to the Australian Securities and Investments Commission, State/Territory fair trading office and the Australian Sports Commission), if legally required. The Promoter further reserves the right to disqualify any Eligible Club that the Promoter reasonably believes engages in activities or purposes that are illegal or otherwise inappropriate for participation in this promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

12.The Promoter also reserves the right, at any time, to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities and/or email addresses.

13.If there is a dispute as to the identity of an Eligible Club and/or Voter, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Club and/or Voter.  In addition, if there is a dispute as to who is deemed to be an Eligible Club, the Promoter reserves the right, in its sole discretion, to determine the eligibility of the Eligible Club for the purposes of accepting their entry into this promotion.

14.The Promoter’s decision is final and no correspondence will be entered into.

15.For each Eligible Club, the Promoter will divide the total number of valid votes received on the Promotional Website (during the Promotional Period) by the total number of club members within that Eligible Club (as specified on the online entry form). This will form the “Average” for the Eligible Club.
Major Prizes

16.Eligible Clubs will be divided into the following State/Territory groups: NSW, VIC, QLD, TAS/NT/ACT and WA/SA.

17.The Eligible Club with the highest Average of valid votes received in each State/Territory group will be declared the Major Prize Winner of that State/Territory group. Each Major Prize Winner will receive one (1) x $5,000 cash grant, awarded in the form of a cheque made out to the Eligible Club.

18.Major Prize Winners will be notified via phone or email.

Bonus Prizes

19.The next thirty (30) Eligible Clubs (excluding Major Prize Winners) with the highest Average of valid votes received nationally will have their entries individually judged based on the literary and creative merit as well as the Eligible Club deemed to be the most deserving of the prize based on the answers provided to the promotional questions: (a) ‘what good stuff will your club purchase with the grant?’, and (b) ‘why does your club deserve to win the grant?’ on the online entry form.

20.The judges reserve the right to select additional reserve entries from those mentioned in clause 19 which they determine to be the next best entries, and record them in order of merit, in case of an invalid entry or ineligible Eligible Club.

21.The five (5) best entries received nationally amongst those judged in accordance with clause 19 (excluding Eligible Clubs which won a Major Prize), as determined by the judges in their sole discretion, will be declared the Bonus Prize Winners. The Bonus Prize Winners will each receive one (1) x $5,000 cash grant, awarded in the form of a cheque.

22.The Bonus Prize winners will be notified via phone or email.
General

23.This is a game of skill and chance plays no part in determining the winners.

24.In the event of a tie between Eligible Clubs with the highest Average of valid votes, the tied entries will be individually judged by the Promoter based on the literary and creative merit as well as the Eligible Club deemed to be the most deserving of the prize based on the answers provided to the promotional questions: (a) ‘what good stuff will your club purchase with the grant?’, and (b) ‘why does your club deserve to win the grant?’ on the online entry form, in order to determine a winner for the relevant prize.

25.In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.

26.If for any reason a winning Eligible Club does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

27.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

28.Total prize pool value is $50,000.00.

29.Winning Clubs must use their grant to purchase the ‘Good Stuff’, as outlined in their Entry.

30.Winning Eligible Clubs are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. All taxes (excluding GST) which may be payable as a consequence of receiving the prize(s) are the sole responsibility of the Winning Eligible Clubs.

31.Prizes, or any unused portion of a prize, are not transferable or exchangeable.

32.Authorised representatives of Eligible Clubs consent to the Promoter using the Eligible Club's name and/or images of Eligible Club members/participants and/or facilities in the event they are a winning Eligible Club (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

33.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Club; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

34.Any cost associated with accessing the promotional website is the responsibility of the Eligible Club’s representative and Voter (as the case may be) and is dependent on the Internet service provider used. The use of any automated entry/voting software or any other mechanical or electronic means that allows an Eligible Club and/or Voter to automatically enter/vote repeatedly is prohibited and will render all entries/votes submitted by that Eligible Club and/or Voter invalid.

35.When an authorised representative of an Eligible Club submits their response to the promotional questions on the online entry form  for this promotion (“Content”), the authorised representative of the Eligible Club, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media (including but not limited to, company brochures and other marketing and/or advertising material), without compensation, restriction on use, attribution or liability.
 

Authorised representatives of Eligible Clubs agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Authorised representatives of Eligible Clubs warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

Each authorised representative of an Eligible Club warrants to the Promoter that each entry submitted is an original literary work of the authorised representative of the Eligible Club that does not infringe the rights of any third party.  The authorised representative of the Eligible Club agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.  Eligible Clubs consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

The Promoter reserves the right to invalidate any entry and/or Eligible Club connected with a breach of the warranties in this clause 35.

Without limiting any other terms herein, the authorised representative of the Eligible Club agrees to indemnify the Promoter for any breach of the above terms.

36.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

37.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, vote or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a Eligible Club; or (e) use of a prize.

38.The Promoter collects personal information of an authorised representative of Eligible Clubs in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the representatives of Eligible Clubs. Authorised representative of Eligible Clubs should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
