The Promoter is Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) of 40 Mount Street, North Sydney, New South Wales 2060 (Promoter).
PROMOTION PERIOD
The Promotion will be open from 00:01 AEST on 8/06/2011 until 15:00 AEST on 30/06/2011(Promotion Period).
Entry in the Promotion is only open to residents of QLD aged 18 years or over who are members of CCAClubhouse excluding:
(a)management, employees, directors and contractors of the Promoter, its related entities, and other agencies, firms or companies associated with the Promotion (including suppliers of the prizes);
(b)a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph (a) of these Terms;
(c)persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;
(d)persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and
(e)persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,
(Eligible Entrants). The persons referred to in paragraph (b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
HOW TO ENTER
To enter and be eligible to win, Eligible Entrants can complete their Eligible Entry during the Promotion Period by:
(a)visiting
www.ccaclubhouse.com logging in or registering as a CCA Clubhouse member and following the links to the Promotion entry page (Online Entry Site);
(b) remain a member of CCA Clubhouse for the duration of the Promotion Period; and
(c)be a member at the time of claiming the Prize; and
(d)fully completing and submitting the online Promotion entry on the online Entry Site (Online Entry Form) indicating their acceptance of these Terms (Web Entry).
If an Eligible Entrant submits a Web Entry:
i.which complies with these Terms, they will receive an on-screen notification confirming that their Web Entry is valid and has been received; or
ii.which does not comply with these Terms, they will receive an on-screen notification that their Web Entry is invalid,
whichever is applicable in the circumstances.
EARN BONUS ENTRIES
Eligible Entrants who are members of CCA Clubhouse also have the opportunity to earn up to three (3) additional entries into the Promotion by inviting up to three (3) people who:
(a) have provided express consent to the Eligible Entrant to receive an invitation; and
(b) have not previously been invited to become a CCA Clubhouse Member; and
(c) are not currently CCA Clubhouse Members, to register as Member(s) of CCA Clubhouse (a “New Member Invitation”) and enter this Promotion.
If an Eligible Entrant successfully submits a New Member Invitation, and a recipient of the New Member Invitation registers as a member of CCA Clubhouse and pursuant to these Terms enters this Promotion (New CCA Clubhouse Member Entry) the Eligible Entrant will receive one (1) additional entry into the Prize Draw per New CCA Clubhouse Member Entry, up to a maximum of three (3) bonus entries (New Member Bonus Entry).
Eligible Entrants must only provide the email addresses of persons who have given their express consent to receive emails in relation to this Promotion. The onus is on the Eligible Entrant to obtain express consent from the person(s) they invite.
The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that any entry mechanism will be available at all times.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means invalid.
Incomplete, illegible or incorrect entries, or which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
VERIFICATION
If requested by the Promoter, an entrant must produce, within the time requested by the Promoter at its absolute discretion appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the Prize (if applicable) and compliance with these Terms. If the items required by the Promoter are not received or an entry has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the entry will be invalid and, at the Promoter's absolute discretion, all of the entrants remaining entries will be invalid.
Prize will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
All costs associated or arising in connection with the Prize are the responsibility of the Prize winner.
Entrants can only enter the Promotion in their own name.
In order to claim the Prize, the Prize winner may be required to sign a Promotion Participation Agreement on terms determined by the Promoter, including:
(a)confirming their eligibility to enter the Promotion and compliance with these Terms; and
(b)providing a release and indemnity in favour of the Promoter in respect of their participation in the Promotion and acceptance and use of the prize.
DRAW AND PRIZE INFORMATION
A random electronic prize draw will be conducted at PrimeFocus 403 / 62 Beach Street Port Melbourne VIC 3207 (Draw Location) by a representative of the Promoter at 16:00 on 30/06/2011 from all Web Entries and New Member Bonus Entries received during the Promotion (Prize Draw).
The first two (2) Eligible Entrants drawn in the Prize Draw will win the following Maroons State of Origin prize packages valued at $750 RRP (including GST) comprising of –
•Two (2) Gold tickets to attend the Harvey Norman State Of Origin Game 3 in QLD at Suncorp Stadium (Brisbane) on Wednesday 6 July 2011 at 8pm , valued at $125 RRP (including GST) each;
•One (1) piece of Maroons memorabilia signed by at least 3 current Maroons players, valued at $200 RRP (including GST);
•Two (2) tickets to attend a closed Maroons training session and a chance to meet and greet the players and coaching staff on 4 July 2011 valued at $300 RRP (including GST) (Major Prize).
The Major Prize includes tickets to the match and training session only and does not include travel to and from the venues for these events. The Prize winner is responsible for any excess or additional costs incurred in participating in this prize. Tickets lost, stolen or damaged cannot be replaced.
The next three (3) Eligible Entrants drawn in the Prize Draw will win a Double Pass to the State Of Origin Game 3 in QLD at Suncorp Stadium (Brisbane) on Wednesday 6 July 2011 at 8pm valued at $125 RRP (including GST) each.
The total value of the prize pool available to be won in the Promotion is AU$1,875 RRP (including GST).
NOTIFICATION OF WINNER
The Draw winner will be notified by phone and mail and published at
www.ccaclubhouse.com at 17:00 on the 30/06/11.
UNCLAIMED PRIZE DRAW
If the Prize is won by an Eligible Entrant and they do not claim their Prize by 16:00 1/07/11, a random electronic re-draw will be conducted on that date and time at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion, subject to any directions from State Gaming Departments (Re-Draw).
NOTIFICATIONS OF RE-DRAW WINNER
The Re-Draw winner, if any, will be notified by mail and published at
www.ccaclubhouse.com on the 4/07/11.
Prizes will be delivered to the residential address as advised by the respective winner.
Acceptance and use of the Prize is subject to terms and conditions imposed by those involved in providing goods and / or services as part of or in connection with the Prize.
If more than one person attempts to claim the Prize, the Promoter has sole and absolute discretion to determine which of those persons is the winning entrant.
GENERAL
Each Eligible Entrant may enter the Promotion once only.
Prize is not transferable, exchangeable or redeemable for cash. Prize must be taken as offered and may not be varied.
The Promoter shall not be liable for the Prize being lost, stolen, damaged or tampered with in any way before it reaches the winner or after it has been released to the winner.
The Promoter accepts no responsibility for any variation in the value of the Prize.
If the Promoter is unable to provide the winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize, subject to any directions given by the relevant gaming department.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.
If, for any reason, the Promotion is not capable of being run as planned, including due to infection by infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State regulations, including cancelling, terminating, modifying or suspending the Promotion.
Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry or draw mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
The:
(a)Promoter, the Promoter's related entities, and all agencies associated with the Promotion; and
(b)the employees, agents, directors and contractors, of all entities referred to in paragraph (a), shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the prize.
PERSONAL INFORMATION
The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award the Prize. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each entrant consents to the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of the Prize) for use for, the following purposes:
(a)contacting the entrant in relation to the Promotion;
(b)improving the Promoter's, the Promoter's related entities’ goods and services; and
(c)in the Promoter's and its agencies case, the purposes set out in the Promoter's privacy policy (available by writing to the Promoter at the address set out in paragraph 2 of these Terms).
The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter at the address set out in paragraph 2 of these Terms. All personal information will be stored at the office of the Promoter.
By entering the Promotion, entrants agree and acknowledge:
(a)they may be contacted by the Promoter (or an agent of the Promoter) to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos or recordings of them;
(b)the Promoter may use any comments obtained from them, their name, and - or likeness and any photos or recordings taken of them (the Materials) for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
(c)the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means (including communicating them to the public in any media). The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
(d)they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose it determines;
(e)they unconditionally and irrevocably:
i.consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights); and
ii.waive all Moral Rights in the Materials that arise outside Australia; and
(f)they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
