TERMS AND CONDITIONS
1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is open to all NSW, QLD and VIC residents. Entries received from Victorian residents will be split into 2 groups (those aged over 18 years and those aged under 18 years) to ensure prize winners meet with the entry restrictions of the hosting venue. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.
3.Promotion commences at 12:01am (AEST) on July 13 2011 and closes 11:59pm (AEST) on August 13 2011 (“Promotional Period”).
4.This promotion will be running in Dolly Magazine (August) on the Owl City advertorial. To enter, entrants must send an email with the subject title “Owl City Dolly” also include the state which you are from (NSW, VIC or QLD), the email must contain the entrants full name, age, address, daytime telephone number and response in 25 words or less to the question “what makes your world bright and beautiful?” Send your completed entry by email to owlcity@acpmagazines.com.au.
5.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6.Incomplete or indecipherable entries will be deemed invalid.
7.Only one (1) entry permitted per person.
8.This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit and originality. The judge’s decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into.
9.Judging will begin on 14 August 2011 at the Promoter’s premises. This promotion will be judged by a panel of judges appointed by the Promoter. The winner will be notified by telephone and in writing using contact details provided in their entry. Prior to judging all entries will be split in to their relevant state/ state/age group (eitherNSW, QLD, VIC under 18/ Vic over 18) to ensure that each and every entry has a fair and equal opportunity of winning.
The Best entry in each group as determined by the judges will be deemed the Major Prize Winner and will receive the Major Prize as outlined below. The Next 5 best entries in each of the NSW and QLD groups as determined by the judges will be deemed Runners up and will receive the Runners Up prize as outlined below. After the Major Prize Winner has been selected, the judges will combine the two VIC groups (Under 18 and over 18) and then select the next best 5 entries. These entries will be deemed the VIC Runners Up
NSW Major Prize (valued at over $1104.25) includes:

5 x money-can’t-buy spots in the Owl City sound check party, including a meet and greet with Adam
Transfer in a limousine from the winners nominated pick up address to the concert venue (valued at up to $500 depending on nominated address)
QLD Runner Up Prize (valued at $185.85) includes:
2 x tickets to the Owl City Concert at the Tivoli Brisbane on Monday 15th August 2011 valued at $63.00 each

Total prize pool available to residents of QLD is $2,043.50
VIC Under 18 Major Prize (valued at over $1104.25):
5 x tickets to the Owl City Concert at Billboard The Venue Melbourne on Thursday 18th August 2011 (valued at $61.00 each)
5 x Owl City CD packs (valued at $59.85 each)
5 x money-can’t-buy spots in the Owl City sound check party, including a meet and greet with Adam
Transfer in a limousine from the winners nominated pick up address to the concert venue (valued at up to $500 depending on nominated address)
VIC (18+ only) Major Prize (valued at over $1104.25) includes:
5 x tickets to the Owl City Concert at Billboard the Venue, Melbourne) on Wednesday 17th August 2011 (valued at $61.00 each)
5 x Owl City CD packs valued at $59.85 each
5 x money-can’t-buy spots in the Owl City sound check party, including a meet and greet with Adam
Transfer in a limousine from the winners nominated pick up address to the concert venue (valued at up to $500 depending on nominated address)
VIC Runners Up Prize (valued at over $181.85):
2 x tickets to the Owl City Concert at Billboard The Venue Melbourne on either Wednesday 17th August 2011 OR Thursday 18th August 2011 valued at $61.00 each
1 x Owl City CD pack valued at $59.85
Allocation of tickets for this prize will be dependant on the selected Runners Up age.
Total prize pool available to residents of VIC is $[4,027]
10.Prize does not include transport from the concert venue back to the winners residence/nominated pick up address, transport to and from pick up address, meals, spending money, accommodation or any other ancillary costs associated with redeeming the prize. These are the responsibility of the winner and their guests.
11.All persons attending the concert venue must meet the age restriction requirements of the concert venue for the event they are attending. All persons must present required photo identification to gain entry to the event. Determination of what will considered suitable identification will be determined by the event Organisers and venue representatives in their complete discretion.
12.The “money cant buy” spots in the Owl City sound check party and meet and greet with Adam must be redeemed on the same day as the concert to which the winner and their guests will be attending. For the removal of doubt Winner and 4 guests must be Owl City Concert ticket holders
13.Choice of limousine used for transportation to the concert venue will be determined by the Promoter in its complete discretion. The winner will be required to provide the Promoter with one pick up address for the pick up transfer to the concert. This address must be located with the metropolitan area of the state in which the winner is redeeming their prize. The winner and their 4 guests will be responsible for making their own way to and from this nominated pick up address.
14.Prize must be taken to on dates stipulated to coincide with the concert event. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the scheduled event is relocated, postponed, rescheduled or cancelled for any reason whatsoever.
15.The Promoter is neither responsible nor liable for any loss or damage suffered in the event that Adam is unavailable or postpone, cancel, reschedule the meet and greet for any reason whatsoever. The availability of Adam to participate in the meet and greet is subject to Adam’s schedule and availability at the time of the arranged meet and greet. The Promoter makes no guarantees to the availability of Adam. Redemption of Meet and Greet with Adam is subject to the guidelines stipulated by the venue, Promoter, and Adam’s representatives at time of redemption of prize. Failure to follow these guidelines will result in the winner and/or their guest forfeiting their right to redeem the prize. The Promoter makes no guarantees on the restrictions that will be placed at time of Meet and Greet, these are stipulated by Adams representatives and must be followed. (Ie – the Promoter makes no guarantees on the opportunity for the winner to take a photo of or get an autograph from Adam at the time of the Meet and Greet).
16.Prize must be redeemed as a package and must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the prize subject to the standard terms and conditions and guidelines of the accommodation venue and the activity service provider. Failure to follow the standard rules and guidelines presented will result in the winner forfeiting their right to participate in the said activity.
17.If any prize is unavailable, the Promoter, in its discretion, reserves the right (subject to reference to all relevant state and territory regulations) to substitute the prize with a prize to the equal value and/or specification.Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
18.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/or (g) redemption of the prize.
19.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
20.The Promoter is neither responsible nor liable for any late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the web entry into the Promotion database and NOT time of transmission by the entrant.
21.The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this competition, or for any technical error that may occur in the course of the administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. The Promoter reserves the right (subject to all relevant state/ territory rules and regulations) to cancel, postpone or reschedule the promotion, if it deems in its complete discretion that the integrity and fairness of the promotion has been compromised in any manner whatsoever.
22.The collection, use and disclosure of personal information provided in connection with this promotion is governed by the ACP magazines Privacy Notice (please see contents page of Dolly magazine for location in each issue)
23.By entering the competition, the entrant consents to receipt of any email and/or communication regarding the competition, and other emails/ communication which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
