1. Information on how to enter, the ‘How to Play’ instructions page of the Application, and prizes forms part of these Conditions of Entry. Submission of an entry is deemed acceptance of these Conditions of Entry.
2. Entry is only open to Australian residents aged 18 years or over as at 00:00 AEST 4 July 2011 who have a compatible Apple® iPhone® or Android TM device and who, in the event
they are the Major Prize Winner, are able to travel overseas in order to take the Major Prize between the period 22 September 2011 – 9 October 2011 (inclusive) and are also registered users of Facebook® (“Eligible Entrants”).
3. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers, participating retailers and agencies associated with this promotion are ineligible to enter.
4. Promotion commences 00:00 AEST on 04 July 2011. Entries close and must be received by 11:59pm AEST on 08 August 2011 (“Promotional Period”). The Major Prize winner will be notified by telephone via the mobile phone number registered to the Application and in writing via email. The Major Prize Winner will be published in The Australian on 24 August 2011. All reasonable steps to notify the winners of the results of the promotion will be taken by the Promoter. The Promoter’s decision is final and no correspondence
will be entered into.
5. An entry is deemed to be received at the time of its receipt by the Promoter and not at the time of transmission by the Eligible Entrant. Entries received will be considered final by the Promoter. Only one (1) entry permitted per Eligible Entrant. Any subsequent entry after the first valid entry is received will be deemed invalid.
6. The terms Virtual Marker, Collect Points, User Generated Marker, Blocking Marker, Vodafone Store Marker, Redemption Gallery and Redeeming Prize are as set out on the ‘How to Play’ instructions page of the Application.
7. To enter this promotion for a chance to win the Major Prize or one of the Minor Prizes available through the redemption feature, Eligible Entrants must:
a) Download The Amazing Race Australia 2011 Application (the “Application”) on their compatible Apple® iPhone® or Android TM device. The Application is available free of charge and can be downloaded via any of these means:
i. Free text the word ‘Race’ to 19766666. A reply text will be sent to the Eligible Entrant with a link to the appropriate download process.
ii. via the Apple® iTunes store for all Apple® iPhone® devices.
iii. via Android Market for all Android™ devices.
Downloading the Application and accessing mobile content including web-based content will incur data charges. Data usage for video content streaming is free for Vodafone and 3 customers. Data charges apply for all other carriers. Any external links (such as links clicked through the Apple® iTunes store or Android Market) and Application features that require an internet connection (such as Facebook, maps, episode information) may incur data charges for all customers. Data used over WiFi will be charged as per the Eligible Entrant’s Internet Service Provider (ISP) rates. The charges for all data services will appear on the Eligible Entrant’s next mobile phone and/or Internet bill (as applicable). All general queries relating to carrier rates or mobile or Internet bills should be directed to the Entrant’s mobile phone carrier or ISP (as applicable).
b) Eligible Entrants must set up an account to interact with the Application (“Account”). In order to set up an Account, users must register their Facebook account with the mobile phone number associated with their iPhone® or Android TM device through the Application via the following steps:
i. Link their Facebook account to the Application via the ‘Profile’ page on the Application.
ii. Enter their mobile number by completing the relevant field in ‘Profile’ and pressing ‘Send’.
iii. Once they have pressed ‘Send’ a SMS will be sent to the registered mobile phone number with a unique code which must be entered into the Application to confirm the mobile phone number. This code must be entered into the relevant field and ‘Send’ pressed. Limit of one (1) Account can be created per eligible device and/or Facebook account.
c) Eligible Entrants must then collect points via the Application during the Promotional Period. In order to collect points, Eligible Entrants must open the Application, go to the ‘competition’ page, open the ‘maps’ page, and, either:
i. Collect Virtual Markers: View the five (5) randomly dropped Virtual Markers on the ‘maps’ page and collect them. There will only be a maximum of five (5) Virtual Markers on the Eligible Entrant’s screen at any one time within a two (2) kilometre radius of the Eligible Entrant’s current location. If the Eligible Entrant moves, and a Virtual Marker then falls outside of two (2) kilometres of their new location, that Virtual Marker will disappear and a new Virtual Marker will randomly drop itself onto the Eligible Entrant’s map. For every Virtual Marker the Eligible Entrant picks up, the Eligible Entrant will gain give five (5) points. Further details on how to collect a Virtual Marker and gain points are set out in the ‘How to Play’ instructions page of the Application.
ii. Collect User Generated Markers: It is up to the Eligible Entrant if they wish to pick up a User Generated Marker. Collecting User Generated Markers can result in being awarded fifty (50) points. User Generated markers and Blocking Markers look the same. An Eligible Entrant may be deducted ten (10) points if the Eligible Entrant collects a Blocking Marker. If a User Generated Marker is picked up by an Eligible Entrant, the Eligible Entrant who dropped the marker will receive ten (10) points each time an Eligible Entrant picks up their marker to a maximum of ten (10) times before the marker will disappear. Eligible Entrants are allocated three (3) markers that they may drop at any time during the game. No more markers will be allocated once the three (3) have been dropped. At any point during the game an Eligible Entrant can choose to drop a marker which is located at the bottom of the screen. Further details on how to collect a User Generated Marker and gain points are set out in the ‘How to Play’ instructions page of the Application.
iii. Collect points by scanning QR codes printed on The Amazing Race Australia leaflet in participating Vodafone Stores, the Vodafone Store Catalogue or printed on The Amazing Race Australia Application Print Advertisement in Australian magazine publications including New Idea, WHO and Men’s Health magazines. Scanning QR codes will result in the player being awarded five (5) points. These codes can be scanned a maximum of once per day.
8. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Application, the Redemption Gallery, or any website accessed in connection with the Application or the information on such websites, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Eligible Entrant, the Eligible Entrant agrees to indemnify the Promoter for those losses, damages and costs.
9. The Promoter reserves the right to the right to verify the validity of any and all entries and game plays via the Application and reserves the right to disqualify any Eligible Entrant from participating in this promotion (including cancelling any or all points accrued and/or cancelling any or all prizes redeemed), if the Promoter has reasonable suspicion that the Eligible Entrant has attempted, deliberately or otherwise, to cause malicious damage or interference with the normal functioning of the Application, the Redemption Gallery, any accessed website or the information on the website, or to otherwise undermine the legitimate operation of the this promotion. This includes but is not limited to: (a) using inappropriate tactics to gain points that are not in the spirit of this promotion’s intended purpose; (b) tampering with the entry process; (c) submitting an entry which is not in accordance with these Conditions of Entry; (d) using any automated entry software or any mechanical, electronic or other means that allows the Eligible Entrant to automatically play the Application or enter repeatedly; or (e) if the Eligible Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
10. Facebook membership and use of Facebook generally are subject to the Facebook prevailing terms and conditions of use available at
www.facebook.com. The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. To the extent permitted by law, each Eligible Entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Eligible Entrant in respect of the Eligible Entrant’s entry into and participation in the promotion. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.
PRIZES
11. “MAJOR PRIZE”: The one (1) Eligible Entrant with the highest number of points collected through the process identified in Sections 7(c)(i), (ii) and (iii) as determined by the Promoter, in its sole discretion (“Major Prize Winner”), will win the following, valued at up to $50,000.00 (depending on the point of departure):
i. 2 x adult economy class ‘around the world’ air tickets from the Australian capital city airport closest to the ordinary residential address of the Major Prize Winner (inclusive of airfare related taxes and charges). See table below for full route details. Major Prize Winner will be responsible for their, and their one (1) guest’s (aged over 18 years of age), own transport to and from their residence to the airport.
ii. Accommodation in twin share, minimum 4 star hotel in each destination set out in the table below and is inclusive of transfers to and from the destination airport and the destination hotel.

iii. Each destination will include a ‘Pit Stop’ experience for the Major Prize Winner and their guest. See below table for details. The Major Prize Winner must confirm their choice of Option 1 or Option 2 of the ‘Pit Stop’ experiences with the Promoter within twenty-four (24) hours of their acceptance of the Major Prize. Failure to nominate their selected option within the required time frame may result in both options being revoked with no compensation payable to the Major Prize Winner or their guest, at the discretion of the Promoter.

iv. AUD$3,000.00 spending money for the Major Prize Winner and their companion, which will be direct deposited into each of the winner and their guest’s bank account within two (2) weeks of departure.
12. The Eligible Entrant who is deemed to have collected the highest number of points at the end of the Promotional Period (in the Promoter’s sole discretion) must confirm their eligibility to be awarded the Major Prize, and ability to take the Major Prize within forty-eight (48) hours of being successfully notified by the Promoter that they have won, otherwise their entry will be deemed invalid. If the Eligible Entrant’s entry is deemed invalid, the Major Prize will be awarded to the Eligible Entrant with the next highest number of points who is able to confirm their eligibility to be awarded the Major Prize within the time-frame nominated by the Promoter. The Promoter will repeat this process until an Eligible Entrant is awarded the Major Prize.
13. TIE BREAKER DETERMINATION: If more than one (1) Eligible Entrant accumulates the same total number of points at the end of the Promotional Period, the Major Prize Winner will be deemed according to which Eligible Entrant has provided the most creative answer in twenty-five (25) words or less to the question: “Why do you deserve to win the Major Prize?” within the time-frame nominated to each of the tied Eligible Entrants by the Promoter. The answers will be judged by a panel of appropriately qualified judges and chance will play no part in determining which of the tied Eligible Entrants will be deemed the Major Prize Winner. The Promoter’s decision is final and no correspondence will be entered into.
14. The Major Prize must be taken for the period 22 September 2011 – 9 October 2011 (inclusive) otherwise the entire Major Prize is forfeited. All components of the Major Prize must be taken together and when offered or are forfeited. The Major Prize Winner and their companion (if any) must travel together and depart from and return to the same departure point. The Major Prize Winner and their companion (if any) may not accrue frequent flyer points. No extension or variation of the travel dates nominated by the Promoter is permitted. Use of the Major Prize and any passes or vouchers issued as part of the Major Prize may be subject to prevailing prize supplier terms and conditions of use. The Major Prize cannot be used in conjunction with travel discounts or special offers.
15. Redemption of the Major Prize is subject to availability and may be dependent on travel class availability, specific room category availability and travel ‘blackout’ periods applying (including school holidays and public holidays). Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule.
16. All additional costs not expressly stated, but which may be incurred in acceptance and use of the Major Prize, are the responsibility of the winner and companion. The winner and their companion will be responsible for making their way to and from their home to their nearest capital city airport or nearest regional airport in Australia. The winner and companion are responsible for any further costs associated with redeeming the Major Prize which are not otherwise specified in these Conditions of Entry, including but not limited to, food and beverage expenses, room service, telephone calls, laundry services, other spending money, other transfers, taxes including arrival and departure taxes (if applicable) but excluding airfare related taxes and charges included in the Major Prize, insurance, travel insurance, passports and visas (if applicable), any medical tests (if applicable), additional entertainment and/or miscellaneous expenses. The winner may be required to present a credit card at time of accommodation check-in.
17. The Major Prize Winner is solely responsible for their entry and the entry of their companion (if any) into any overseas destination included in the Major Prize, at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel and, if required, on or by a date nominated by the Promoter. Failure to do so may result in the Major Prize being forfeited.
18. Taking the Major Prize is subject to any prevailing terms and conditions of any accommodation/transport/services/transfers/travel insurance or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the Major Prize Winner, or their companion (if any), are unable to use any element of the Major Prize as stated for whatever reason, including refusal of entry or departure into or out of any of the overseas destinations included in the Major Prize or participation in certain activities for health, age, behaviour or safety reasons. Any part of the Major Prize that is not taken for any reason is forfeited.
19. The Major Prize Winner and their companion (if any) acknowledge that the Major Prize may involve a dangerous activity (including but not limited to the ‘Pit Stop’ experiences), which may result in injury or death, and participates at their own risk. The Major Prize Winner and their companion (if any): (a) must attend, undergo and pass any appropriate training, briefings, safety demonstrations, required medical tests and other requirements (including blood alcohol testing) of the Promoter and a prize supplier as determined by them in their absolute discretion; (b) must declare to the Promoter or a prize supplier (as applicable) any health-related issues that may affect his/her safe participation in any part of the Major Prize and obtain a written clearance from their doctor in this respect; (c) must not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in any part of the Major Prize; (d) must not be under the influence of any drugs or alcohol; (e) must comply with all directions of the Promoter, a prize supplier and relevant officials; and (f) must wear all safety and other equipment required. The Promoter and a prize supplier in their absolute discretion (a) reserve the right to refuse to allow the Major Prize Winner or their companion (if any) to take part in any or all aspects of the Major Prize if they reasonably believe the Major Prize Winner or 9 their companion (if any) poses a safety risk or for any other reason; and (b) may cancel the relevant component of the Major Prize if the conditions are deemed dangerous. No compensation will be payable if the Major Prize Winner, or their companion (if any), are unable to use any element of the Major Prize as stated for whatever reason, including refusal of participation in certain activities for health, age, behaviour or safety reasons.
20. The Promoter reserves the right to request the Major Prize Winner and their companion (if any) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction at its sole discretion) in order to confirm the Major Prize Winner’s or the companion’s identity and age, and ability to travel, before issuing the Major Prize.

21. “MINOR PRIZES”: Eligible Entrants can use the points they have collected through the process identified in Sections 7(c)(i), (ii) and (iii) above to redeem Minor Prizes in the Redemption Gallery through the Application during the Promotional Period in accordance with the Minor Prize’s availability and point value as stated below:

22. Eligible Entrants may redeem a Minor Prize through the redemption gallery located at
www.amazingrace.vodafone.com.au (“Redemption Gallery”). Eligible Entrants must fully and correctly complete the claim form available on the website in the manner required, including selecting a Minor Prize or Minor Prizes based on the number of points required to claim the Minor Prize and that Eligible Entrant’s points balance at the time of redemption. Prizes will be delivered to the address nominated by the Eligible Entrant in the claim form within twenty business days (20) days of a valid claim form being received by the Promoter.
23. All claim forms must be received by the Promoter by the end of the Promotional Period otherwise the Eligible Entrant will no longer be eligible to claim a Minor Prize and all remaining points may be deemed expired. The Promoter accepts no responsibility for late, lost or misdirected claims. Claims received will be considered final by the Promoter. Claims will be deemed to be accepted at the time of receipt and not the time of transmission. Incorrect, incomplete or incomprehensible claims will be ineligible.
24. Any vouchers issued as a Minor Prize are subject to their own prevailing conditions of use including expiry dates and are not replaceable if lost or stolen. Connection, mobile telephone plan and call costs in respect of a handset Minor Prize are the responsibility of the winner.
25. Total possible Minor Prize pool value is up to $109,963.16.
GENERAL
26. Total maximum prize pool value is up to $159,963.16. Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize values. All prize values are the recommended retail price including GST, depending on point of departure (if applicable).
27. It is a condition of accepting a prize that the winner (and their companion, if applicable) may be required to sign a legal release or releases in a form determined by the Promoter and/or any prize supplier in its or their absolute discretion. 28. Eligible Entrants can only enter in their own name. Eligible Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Eligible Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Eligible Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Eligible Entrant’s identity, age, residential address, eligibility to enter and claim a prize, that the Eligible Entrant obtained the bill payer’s consent to download the Application before submitting their entry and/or claiming a prize, that the Eligible
Entrant has a clear relationship with the end mobile device used to download the Application (where applicable), and any information submitted by the Eligible Entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Eligible Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Eligible Entrant will be ineligible and deemed invalid. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
29. Eligible Entrants must be identified as having a clear relationship with the end mobile device and have the bill payer’s consent to download the Application and use mobile Internet to participate in the promotion or their entry will be deemed invalid. Any costs associated with accessing or downloading are the Eligible Entrant’s responsibility and may vary depending upon the Eligible Entrant’s usage plan, mobile carrier or Internet Service Provider. Contact details entered incorrectly via the Application, the Redemption Gallery, or any website accessed in connection with the Application by an Eligible Entrant will deem an entry invalid.
30. Incomplete, indecipherable or illegible entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
31. The Promoter’s decision is final and no correspondence will be entered into.
32. If there is a dispute as to the identity of an Eligible Entrant, the Eligible Entrant will be deemed to be the person in whose name the corresponding Facebook account is held.
33. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any written directions made under applicable State or Territory legislation, the Promoter reserves the right to: (a) disqualify any Eligible Entrant; (b) subject to any written directions from a regulatory authority, cancel, suspend, modify, terminate or cancel the promotion; and/or (c) provide an alternative prize (including an alternative destination/s at an alternative date/s as specified by the Promoter for the Major Prize) to the same value as an original prize.
34. If a prize (or part of any prize) is unavailable for any reason beyond the Promoter’s reasonable control, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with an alternative prize (or part of the prize) to the equal or greater value, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
35. Except for any implied condition or warranty the exclusion of which from these Conditions of Entry would contravene any statute or cause any part of these Conditions of Entry to be void (“Non Excludable Condition”), the Promoter excludes from these Conditions of Entry all conditions, warranties and terms, implied by statute, general law or custom. Except for any liability in relation to a Non Excludable Condition, the Promoter (including its officer, employees and agents) excludes all liability whether arising in tort (including, without limitation, negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss or profits) whether direct, indirect, special or
consequential, arising in any way out of the promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control): (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax implications; (f) the cancellation or postponement of the promotion; and/or (g) a prize or use of a prize. All warranty claims and queries in respect of any prizes must be directed towards the applicable manufacturer and not the Promoter.
36. Each Eligible Entrant consents, if the Eligible Entrant becomes a winner, to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in an media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), the Promoter and or products/services supplied by the Promoter. The Eligible Entrant agrees that, in the event they are a winner, the Eligible Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents. An Eligible Entrant also agrees that the Promoter may, in the event the Eligible Entrant is a winner, publish or cause to be published the Eligible Entrant winner’s name and locality in any media, as required under the relevant State or Territory lottery legislation.
37. The Promoter collects personal information in order to conduct the promotion and provide any goods/services requested and may, for that purpose, disclose such information to third parties, including, but not limited to, prize suppliers or a regulatory authority and for any purpose to which the Eligible Entrant has previously consented, including but not limited to, future promotional, marketing and publicity purposes. If the personal information requested is not provided, the Eligible Entrant cannot participate in the promotion and is deemed ineligible. Eligible Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the
Promoter.
