Terms and Conditions of Entry
Instructions on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is open to residents of Australia aged 18 years and over only. Employees of the Promoter, advertising agencies and their immediate families, are not eligible to enter. All persons redeeming this prize must be aged 18 years and over. Only one entry per person will be permitted.
The promotion commences on 27th July 2011 and closes 5pm AEST on 29th August 2011. The judging will take place at the Promoter's premises and will begin on 31st August 2011. The winner will be notified by phone and mail using contact details provided in their entry. Notification will take place by 1st September 2011. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit and originality. The judges' decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The best valid entry as determined by the judges will be deemed the winner and will receive the Major Prize valued at up to $6270 (depending on point of departure), This prize consists of:
4 nights twin share accommodation at The Byron at Byron Resort Valued at $2200,
2 x Spa Massages at The Byron at Byron Resort (awarded in the form of a voucher Valued at $270)
Return transfers for the winner to and from The Byron at Byron in a private car Sedan valued up to $600.00
2 x economy class airfares from the winners capital city in Australia to Byron Bay valued up to $3200 (depending on point of departure).
Total prize pool valued at up to $6270 depending on point of departure. In the event the winner is a resident of Byron Bay, the airfares component of the prize will not be included. Prize does not include transport to and from departure point, spending money, meals, incidentals and any ancillary costs associated with redeeming the prize. These are the responsibility of the winner.
Prize must be taken as a package. Prize must be redeemed in full by 14 February 2012 at the time stipulated by the Promoter. Redemption of prize is subject to booking and availability at time of booking. Prize must be redeemed between September 14th – December 22nd 2011 or January 9th to February 14th 2012. The above package is valid for two persons aged 18 years and over only. It is a condition of accepting the prize that the winner and their travel companion present a valid credit card at the time of redemption of the prize in order to cover the costs of any incidentals and costs incurred throughout their stayWhere prize is awarded in the form of a voucher/letter/ticket/pass, the Promoter shall not be liable for any voucher/letter/ticket/pass that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of voucher/letters/tickets/passes is subject to terms and conditions stipulated on voucher/letter/ticket/pass and to the standard business guidelines of the relevant service provider/accommodation venue. Any ancillary costs associated with redeeming any voucher or gift card are not included in the prize. Any unused balance of any voucher or gift card will not be awarded as cash.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to all relevant state and territory regulations) to either provide an alternative prize to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.
Entries not completed in accordance with the Terms and Conditions or received after the closing date will not be considered. Indecipherable or incomplete entries will be deemed invalid.
If for any reason a winner does not redeem an element of a prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) redemption of a prize and/or (g) participation in this promotion
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
