Terms and Conditions - Game of Skill
By entering the Jetstar Krispy Kreme Twitter Competition, you agree to the following
conditions:
1. Information on how to enter forms part of the terms and conditions of entry. Entry
into the promotion is deemed acceptance of these terms and conditions.
2. The promoter is Jetstar Airways Pty Limited (ABN 33 069 720 243) of Level 4, 222
Bourke Street, Melbourne VIC 3000 (Promoter).
Eligibility
3. Entry is open to Australian residents over 18 years only, excluding directors,
management, employees (and their immediate families) of the Promoter and its
related bodies corporate and registered travel companions of employees of the
Promoter and its related bodies corporate.
4. The competition opens at 09.00am (AEST) on Wednesday 31August 2011 and closes
09.00am (AEST) Friday 2 September 2011. (Promotion Period). Only entries that
are received during that time will be eligible for entry.
Competition entry
5. To enter, Eligible Entrants must, during the Promotion Period:
5.1 If you do not already have a Twitter account, or do not follow
@JetstarAirways on Twitter, sign up at
www.twitter.com and ‘follow’ the
@JetstarAirways Twitter feed page;
5.2 Tweet a message with the answer to the following question, ‘
If Jetstar was a
Krispy Kreme doughnut, what flavour would it be and why?’; and
5.3 Including the hashtag ‘#JetstarKK’ at the end of the tweet.6. While the Eligible Entrant retains the copyright of all works submitted as competition
entries, the Eligible Entrant grants Jetstar the right to unlimited world-wide use of
any material submitted in an entry for company brochures, promotion and
advertising, including without limitation publication in TV, press and web-based
advertising material. Entrants consent to any use of their entry which may otherwise
infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
7. Incomplete, indecipherable, or illegible entries will be deemed invalid and will be
rejected. The Promoter reserves the right to disqualify any entry where it reasonably
suspects that such materials are prohibited by these terms and conditions, any
relevant law, or are otherwise deemed inappropriate. This is at the Promoter's
absolute discretion and discussions will not be entered into. Entries that are
considered unlawful, harassing, defamatory, abusive, threatening, harmful, obscene,
profane, sexually oriented, racially offensive, contain objectionable content or are
otherwise inappropriate will be deemed invalid and will be rejected.
8. There is a limit of one entry per person for the duration of Promotion Period.
9. The Promoter reserves the right to verify the validity of entries and reserves the right
to disqualify any Eligible Entrant for tampering with the entry process or for
submitting an entry that is not (in the reasonable opinion of the Promoter) in
accordance with these terms and conditions.
10. The Promoter is not responsible for any lost, late or misdirected entries.
Judging
11. The winners will be the entries judged by a panel of judges appointed by the
Promoter to be the most creative and original answer from the pool of entries
submitted during the Promotion Period. Entries will be judged at the offices of the
Promoter on at 10:00am (AEST) on Friday, 2 September 2011.
12. The competition is a game of skill and chance plays no part in determining the
winner.
13. Winners will be notified by Direct Message on Twitter by no later than 4:00pm
(AEST) on Friday 2 September, and their names published in the @JetstarAirways
Twitter feed by 5:00pm that day.
14. The judges' decision is final and the Promoter will not enter into correspondence
regarding the result.
15. It is a condition of accepting the prize that the winners must comply with all the
conditions of use of the prize.
The prize
17. T
here are 5 prizes in total, each valued at a maximum of AU$191.40. The maximum
total prize pool value is AU$957, based on the recommended retail value at the time
of printing. The Promoter accepts no responsibility for any variation in the value of
the prizes.
18.
Each prize consists of one $191.40 Krispy Kreme ‘Gold Card’ which entitles the holder
to 1 x dozen box of Krispy Kreme original glazed doughnuts per month for 12
months.19. The prize must be taken as stated and no compensation will be payable if the
recipient is unable to use the prize as stated. The prize is not redeemable for cash. A
prize cannot be transferred to any other person, unless agreed to by the Promoter.
20. In the event of an entrant being unable to satisfy these terms and conditions or not
collecting their prize in accordance with clause 19, the Promoter reserves the right to
cancel the prize to the Eligible Entrant. No replacement winner will be judged in this
instance.
23. If any act, omission, event or circumstance occurs which is beyond the reasonable
control of the Promoter and which prevents the Promoter from complying with these
terms and conditions, the Promoter will not be liable for any failure to perform or
delay in performing its obligations and the Promoter reserves the right (subject to
any applicable law) to cancel, terminate or modify or suspend this promotion.
24. The Promoter, its related bodies corporate and their respective officers, employees,
contractors and agents (Promotion Parties) will not be liable for any losses,
damages, expenses, costs or personal injuries arising out of this promotion, the
promotion of this promotion or the use of any prize, including but not limited to any
breach of these terms and conditions, contract or tort (including negligence) and any
other common law, equitable or statutory remedy (Damages) whatsoever, including
but not limited to direct, indirect and consequential Damages, including Damages
that cannot reasonably be considered to arise naturally and in the ordinary course of
things, even if those Damages were in the contemplation of the Promotion Parties.
25. The exclusion of liability in clause 24 does not apply to limit or exclude liability:
a) for personal injury or death suffered or sustained in connection with the supply of
goods or services which are supplied by the Promoter in the ordinary course of
business. To remove doubt: third party goods or services, which other than in
connection with this promotion, are in the normal course of business supplied by
a third party unrelated to the Promotion Parties, are not supplied by the
Promoter in the ordinary course of business; or
b) to the extent it is not permissible at law to limit or exclude liability in the manner
contemplated in that clause (in which case that liability is limited to the maximum
extent allowable by law).
26. Jetstar collects personal information about entrants for the purpose of running this
competition. Entry details remain the property of the Promoter. Eligible Entrants
consent to the Promoter using personal information provided in connection with this
promotion for the purposes of facilitating the conduct of the promotion and
awarding any prizes. Without limiting the foregoing Eligible Entrants' personal
information provided in connection with this promotion will be handled in accordance
with the Promoter's Privacy Statement, a copy of which is available at
http://www.jetstar.com/au/en/privacy-policy/.
