“SKIN IT TO WIN ON PACK” PROMOTION


1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 14 or over. Entrants under 18 years of age must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

3. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. Promotion commences on 01/09/11 and purchases end in-store at close of business on 16/12/11 (“Promotional Period”).

6. To be eligible to participate in this promotion, individuals must purchase a specially marked 600ml, 1.25L, 2L or 24 x 375ml Pepsi or Pepsi Max product, featuring a label that refers to this promotion ("Promotional Product”) from a participating retail outlet during the Promotional Period. Promotional Products will feature a unique code ("Unique Code"), printed on the reverse of the label (in the case of 600ml, 1.25L and 2L products) and on a layer sheet located inside the pack, between the layer of cans (in the case of 24 x 375ml products).

7. CASH PRIZES

i. To submit an entry into prize draw for cash prize, individuals must, visit www.skinittowin.com.au, follow the prompts to the promotional entry page and fully complete the online entry form, including their full name, postal address, a valid e-mail address and the Unique Code from the Promotional Product and submit the fully completed online entry form by 11:59pm AEDST on 16/12/11.

ii. There will be a draw conducted each day between 02/09/11 and 01/11/11 (inclusive) at 2pm (each a “Daily Draw”). There will also be 1 overall draw conducted from all entries received between 01/09/11 and 16/12/11 for this promotion (“Overall Draw”).

iii. Entries received between 01/09/11 and 11:59pm AEDST on 31/10/11 will be entered into the relevant Daily Draw and the Overall Draw. Entries received between 01/11/11 and 11:59pm AEDST on 16/12/11 will only be entered into the Overall Draw.

iv. All Daily Draws scheduled for a weekend or NSW public holiday (i.e. Labour Day public holiday on 03/10/11) will take place the next business day. Entries in each Daily Draw will not be included in any subsequent Daily Draws, however, all entries will be entered into the Overall Draw.

v. The Overall Draw will be held at 2pm on 20/12/11.

vi. All draws will be held at Tigerspike, Level 1, 28 Richards Avenue, Surry Hills NSW 2010.

vii. In each Daily Draw, the first valid entry drawn will win $500 cash (subject to clause 14).

viii. In the Overall Draw, the first three (3) valid entries drawn will each win $500 cash (subject to clause 14).

ix. All Daily Draw winners and the Overall Draw winners will be published in The Australian newspaper on 22/12/11.

x. A draw for any unclaimed cash prizes may take place on 20/03/12 at 2pm the same place as the original draws, subject to any directions from a regulatory authority. Winner(s), if any, will be published in The Australian on 27/03/12.

xi. The total prize pool of all prizes awarded in the Daily Draws and the Overall Draw is valued at $32,000.

8. 2011 SYDNEY TELSTRA 500 EVENT PRIZE

i. To submit an entry into the judging pool for the 2011 Sydney Telstra 500 Event Prize, individuals must follow the instructions provided in clause 7(i) to submit their entry before 11:59pm AEDST on 31/10/11. Then, the individual must follow the prompts to use the tools provided online to design the exterior of their own Pepsi MAX V8 Supercar, provide a name for their designed Pepsi MAX V8 Supercar (in 200 characters or less) and submit the fully completed online entry form by 11:59pm AEDST on 31/10/11.

If an individual does not wish to use the tools provided online to design the exterior of their own Pepsi MAX V8 Supercar, that individual may also:

(a) upload their own individually designed images, provided such images comply with these Terms and Conditions; or

(b) use the function provided online to randomly generate a Pepsi MAX V8 Supercar design.

Uploaded files must be submitted in either JPG or PNG format.

ii. Every valid entry received will be individually judged by a panel of representatives determined by the Promoter (“Pepsi Team”) on 03/11/11 based on the artistic creative merit of:

(a) the design of the Pepsi MAX V8 Supercar; and

(b) the name provided for V8 Supercar design.

iii. This element of the promotion is a game of skill and chance plays no part in determining the winner.

iv. The best valid entry, as determined by the Pepsi Team, will win the 2011 Sydney Telstra 500 Event Prize, which includes:

    The opportunity to have their winning design used on the exterior of the Kelly Racing Pepsi MAX V8 supercar livery for the race at the 2011 Sydney Telstra 500 event;
    Return economy flights for 4 people from the winner’s nearest capital city to Sydney (with all airline and airport taxes paid for by the Promoter. Depart 30 Nov 11- Return 5 Dec 11);
    Return Hummer Sedan transfers from Sydney airport to place of accommodation for 4 people;
    5 nights at a 4 star rated accommodation in Sydney CBD in 2 twin share rooms;
    Breakfast daily for 4 people;
    Return stretch Hummer transfers from place of accommodation to Sydney Heliport including beverages and snacks on 01/12/11;
    A morning scenic helicopter flight over Sydney from over 1,000 feet in the air including return transfers from place of accommodation to heliport for 4 people on 01/12/11;
    Return Harley Davidson transfers on 03/12/11 and 04/12/11 from place of accommodation to the 2011 Sydney Telstra 500 event for 4 people;
    Corporate hospitality at the 2011 Sydney Telstra 500 event on 03/12/11 and 04/12/11 for 4 people;
    A dinner at Manta in Sydney to the value of $500 for 4 people;
    4 x Red Balloon AU$500 Gift Vouchers (1x AU$500 voucher for each of the winner and his/her companions, if they are aged 12 years or over) redeemable for a Hot Lap in a V8 car in the winner’s and his/her companion’s capital city; and
    $1,000 spending money for the winner only.

v. All elements of the 2011 Sydney Telstra 500 Event Prize (excluding the Red Balloon vouchers) must be taken to coincide with the 2011 Sydney Telstra 500 event with flights departing on 30/11/11 and returning on 05/12/11, subject to booking and flight availability.

vi. If the winner is from NSW, then the 2011 Sydney Telstra 500 Event Prize does not include airfares into Sydney airport and airport transfers and the airfare and airport transfers components of the prize are not redeemable for cash. Additional spending money, additional meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

vii. If the winner is under 18 years of age, the 2011 Sydney Telstra 500 Event Prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf. During the entire duration of the 2011 Sydney Telstra 500 Event Prize, a nominated parent/guardian must accompany any person under 18 years of age.

viii. The winner (or the winner’s parent/guardian if the winner is under the age of 18 years) may be required to present credit card at time of accommodation check in. Frequent flyer points will not form part of the prize. The 2011 Sydney Telstra 500 Event Prize is subject to the standard terms and conditions of individual prize and service providers. The Promoter strongly recommends that the winner and his/her companions take travel insurance before travelling.

ix. The 2011 Sydney Telstra 500 tickets are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/parent/guardian) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the 2011 Sydney Telstra 500 Event Prize.

x. The following conditions apply to the hot lap element of the prize for the winner and each of his/her three (3) companions:

(a) Each person aged 18 years or over who holds a current valid driver’s licence (must be a ‘P’ plate or full licence) issued in an Australian State or Territory will have the opportunity to drive a V8 car in a hot lap with an instructor;

(b) Each person aged 12 years or over who does not participate in a hot lap as a driver may participate in a hot lap as a passenger of a driver provided by the prize supplier; and

(c) Any companions aged under 12 years of age will not be eligible to participate in a hot lap, in which case, cash will be awarded to the winner in lieu of the Red Balloon voucher for that companion.

xi. Any ancillary costs associated with redeeming the Red Balloon voucher are not included. Any unused balance of the Red Balloon voucher will not be awarded as cash. Redemption of the Red Balloon voucher is subject to any terms and conditions of the issuer including those specified on the Red Balloon voucher.

xii. The winner and his/her companions (and/or parent/guardian if the winner is under 18 years of age) acknowledge that the scenic helicopter flight, and the hot lap to be experienced with the Red Balloon voucher elements of the prize (each an “Activity”) are dangerous activities that may result in injury or death, and participate at their own risk. The winner and his/her companions must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or any of his/her companions from participating in the Activity if, at any time, they reasonably believe that the winner or any of his/her companions pose a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

xiii. The 2011 Sydney Telstra 500 Event Prize is valued at up to $22,500, depending on the winner’s point of departure.

GENERAL

9. Incomplete or indecipherable entries will be deemed invalid.

10. If an entrant submits more than 50 entries, for each Promotional Product purchased for his/her 51st and all subsequent entries, the entrant must: (i) keep the whole original label from the Promotional Product; and (ii) retain the original purchase receipt showing the date, time and store of purchase.

11. Multiple entries permitted, subject to the following: (a) only 1 entry into a Daily Draw, Overall Draw and the judging pool for the 2011 Sydney Telstra 500 Event Prize permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only 1 Unique Code per entry is permitted; (d) unrecognised Unique Codes will be deemed invalid; (e) each Unique Code can only be used once; and (f) each entry into the judging pool for the 2011 Sydney Telstra 500 Event Prize must be substantially unique and contain a unique design name.

12. All winners will be notified by email.

13. The Promoter’s decision is final and no correspondence will be entered into.

14. All cash prizes will be paid by a crossed cheque payable to the winner, or if the winner so requests, by means of electronic transfer of funds to any nominated account in Australia. If the person who won is under 18 years of age, references in this condition to the "winner" are references to the parent or guardian of the person who won.

15. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

16. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

17. The total prize pool is valued at up to $54,500.

18. Prizes (or any unused portion of a prize) are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

19. The Promoter reserves the right to alter the winning design of the Pepsi MAX V8 Supercar in any way to allow the design to be translated and applied to the Kelly Racing Pepsi MAX V8 supercar.

20. When entrants submit any materials via the promotion including comments, images and car designs (“Content”), entrants, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media on any material (including on the Kelly Racing Pepsi MAX V8 supercar), without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use. Entrants warrant that they have the full authority to grant these rights.

Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 14, or otherwise unsuitable for publication; (b) entrants will obtain prior consent from any person or property that appears in their Content; (c) entrants will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) entrants Content shall not contain viruses or cause injury or harm to any person or entity; and (e) entrants will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

Without limiting any other terms herein, entrants indemnify the Promoter for any breach of the above terms.

21. Entries will not be returned to any entrant. Each entrant warrants to the Promoter that each entry submitted is an original work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

22. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

24. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

25. As a condition of accepting a prize, a winner (and his/her/their companion/s or the winner’s parent/guardian if the winner is under the age of 18 years) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and companies and agencies associated with this promotion exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents), and companies and agencies associated with this promotion are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2011 Sydney Telstra 500 event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use/taking of a prize.

28. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
