Competition TermsNW Win A Bikini Body Promotion Terms and Conditions 1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2.
Entry is open to all residents of Australia. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. 3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4. Identification of an individual will be deemed to be consisting of a unique answer, a contact name and a mailing address. 5. The promotion commences at 00:01 AEST Monday 5th September 2011
and closes 11:59pm AEST Sunday 2nd October 2011 (“Promotional Period”). The judging will take place at the Promoter’s premises and will begin at 11:00am AEDST on Wednesday 5th October 2011. The winners will be notified by phone and mail using contact details provided in their entry. 6. To enter, entrants must, during the Promotional Period, log on to
www.nwonline.com.au, and then follow the prompts to the competition entry page, enter the requested details including their full name, address, telephone number, email address, dress size, their answer to the question “why you need Dr Joanna’s help to get a bikini body?” in 25 words or less and then submit the fully completed entry form. 7. Incomplete, incomprehensible and illegible entries will be deemed invalid and will not be included in the judging. 8. This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit of the answer provided to the question. Judges decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into. . 9.
The best entry as determined by the judges will win a Dr. Joanna Ultimate Body Haul Prize Pack valued at $500. Prize includes the Dr. Joanna Get Lean Program; a 10 week online nutritional master-class including the Get Lean toolkit (Get Lean plate model with meal ideas and recipes), a one-on-one session with Dr. Joanna in Sydney (subject to availability) and a copy of Dr. Joanna’s award winning book Inner Health Outer Beauty. The next best ten (10) entries, as determined by the judges, will each win a Kooey bikini valued at $130 each. Total Prize pool is valued at $1,800. 10. The winner must be able to redeem the one on one Session component of the major prize at the time, date and venue stipulated by the Promoter. Transport to and from the venue and all other ancillary costs are the responsibility of the winner. If the winner is not from Sydney, the one-on-one session with Dr. Joanna will be conducted via phone or Skype. In the event that the winner is unable to redeem this component of the prize, the winner will forfeit this component of the prize and no cash or other prize will be awarded to the winner. 11. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the One On One Session with Dr Joanna is postponed, cancelled, rescheduled or relocated for any reason whatsoever. The time, date and venue of the session will be determined by the promoter and is subject to Dr Joanna’s availability at the time of booking. 12. The Promoter will contact the winners at time of winner notification to determine sizing for the prize to be awarded in. The Promoter will make all reasonable attempts to supply prize in the size stipulated by the winner at the time of winner notification, however in the event that for any reason whatsoever the sizing stipulated is unavailable at the time of the redemption of the prize, the Promoter will supply the prize in the next sizing available closest to that stipulated by the winner at the time of winner notification. Selection of prize (including but not limited to style, colours, materials, design etc) will be determined by the Promoter in its complete discretion. 13. All entrants warrant that consent that their name, likeness, image and/or voice (including photographs, film and/or recording of the same) to be used in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 14. In consideration of accepting a prize, winners agree that the Promoter or their agents may produce a story or feature on this promotion to be developed and featured in NW Magazine (or any other form of media it deems suitable) without further remuneration or reference to the winner. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times. 15. It is a condition of taking the major prize that the winner may be required to sign a legal release in a form determined by the Promoter. 16. In the event that for any reason whatsoever the prize winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu. 17. If a prize (or any part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification. 18. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 19. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the One on One Dr. Joanna session is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) the Prize. 20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) modify, suspend, terminate or cancel the promotion, as appropriate. 21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. 22. Each entrant warrants to the Promoter that the entry submitted is an original literary work of the entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the entrant in relation to the entry was provided by a third party, the entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. 23. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant.
