PURCHASE COLES ONLYhttp://www.fantasticsnacks.com.au/promotions/ Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 16 years or over. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Employees (and their immediate families) of the Promoter, participating retailers, Warner Bros. Entertainment Australia Pty Ltd and agencies associated with this promotion are ineligible to enter.
To be eligible to enter, individuals
must purchase a 70g Batman promotional pack of Fantastic Cup Noodle in Beef or Chicken flavour from a participating Coles Supermarkets nationally (while stocks last) between 9:00 am AEDST on 27/10/2011 and 5.00pm AEDST on 19/01/2012 (‘Promotional Period’). To enter, individuals must then visit
www.fantasticsnacks.com.au/promotions follow the prompts to the promotion entry page, input the requested details including name, last name, age, address, contact phone number, full barcode number and full receipt number and submit the fully completed entry form by 11.59pm AEDST on 19/01/2012.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; (c) unrecognised barcode/receipt numbers will be deemed invalid.
Entrants must retain their original purchase receipt OR a photocopy of their purchase receipt as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. The purchase receipt must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw will take place at Maverick Marketing, Ground Floor, 7 Northcliff Street, Milsons Point NSW 2061 on 24/01/2012 at 10.00am AEDST. Winners will be notified in writing within two (2) business days of the draw and their names will be published in The Australian on 07/02/2012. The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn will win a trip for two (2) people to San Diego, USA valued at up to AUD$12,435.35 Prize includes return economy airfares from Sydney, Australia, to San Diego, USA, seven (7) nights twin share accommodation at The Hilton, San Diego, two (2) x Comic Con ® 2012 International 4-day event tickets valued at AUD$100.00 each and AUD$2,000 spending money. Additional spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner will also receive one (1) x Playstation 3 console and one (1) x Playstation game (Batman: Arkham City).
Prize must be taken to coincide with the Comic Con ® 2012 International event with flights departing on 24/07/2012 and is subject to booking and flight availability. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. Flights depart from and return to Sydney NSW only. The winner and their companion will be responsible for any travel to and from Sydney, NSW in order to take the prize.
The winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas and travel documentation.
Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
The Comic Con ® 2012 International ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
The first ten (10) valid entries drawn in the minor draw, will each win one (1) x Playstation 3 console and one (1) x Playstation game (Batman: Arkham City) valued together at AUD$597.95. The next eighty four (84) valid entries drawn will each win one (1) x DVD (Batman: Year One) valued at $29.95 each.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is up to AUD$20,930.65 Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed prizes may take place on 24/04/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing within two (2) business days of the draw and their names will be published in The Australian on 08/05/2012.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
As a condition of accepting the prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Comic Con ® 2012 International event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; (g) use of a prize; or (h) attendance at the Comic Con ® 2012 International event.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
