UNDERBELLY RAZOR DVD LAUNCH PARTY 2 GIVEAWAY
CONDITIONS OF ENTRY


1. Instructions on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.

2. Entry is only open to Sydney residents aged 18 and over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. Promotion commences 00:01 AEST 2 November 2011 and closes midnight AEST on 6 November 2011.

4. To enter, individuals must logon to www.nwonline.com.au, follow the prompts on the promotion entry page and input the requested details including their full name, address, telephone number, email and answer in 25 words less ‘Which celebrity are you most star struck by and why?’ and then submit the fully completed form.

5. Limit one (1) entry per person.

6. The judging will take place at 11am AEST on 7th November 2011 at 54 Park Street, Sydney NSW 2000. Judging will be done by a panel of judges appointed by the Promoter. The winner will be notified by phone or mail using contact details provided in their entry.

7. This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit and suitability of the promotion. The judges’ decision in relation to any aspect of the promotion will be final and binding on every person who enters. No correspondence will be entered into.

8. Entrants warrant to the Promoter that the entry submitted is an original literary work of the entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided by the entrant was provided by a third party, the entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

9. Entries must not be offensive, defamatory or racist.  Any entry which the judges deem inappropriate will be invalid.

10. There will be five (5) equal winners.

11. The best five (5) valid entries as determined by the judges will be deemed the winners and each will receive two (2) tickets to the Underbelly Razor DVD Launch in Sydney on 9th November 2011.

12. Total prize pool is $500.

13. Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines that are available at: http://www.alcohol.gov.au/

14. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. The prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.

15. The Promoter is not responsible nor liable for any change in the value of the prize at the time of publication. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

16. The prize is valued in Australian dollars. The prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

17. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

18. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter's discretion.

19. The Promoter’s decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into.

20. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to modify, suspend, terminate or cease the promotion with fair notification to the entrants. The form of such notification is at the complete discretion of the Promoter.

21. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

22. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter and Facebook (including their officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to,  arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; (f) redemption of a prize; and/or (g) participation in the promotion.

23. All entries submitted become the property of the Promoter. 

24. By participating, the entrants consent to the Promoter collecting personal information in order to conduct the promotion and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages, telephoning the entrant regarding the promotion, and other messages which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services they may be interested in. Entrants should direct any request to access, update or correct information to the Promoter. The collection, use and disclosure of personal information provided in connection with this competition is governed by the Promoter’s Privacy Notice (see www.acpmagazines.com.au)
