Terms and conditions

AAMI 2011 CHRISTMAS PRESENT PROMOTION

   1. The promoter is Australian Associated Motor Insurers Limited (AAMI) ABN 92 004 791 744, AFS Licence Number 238173, Level 11, 447 Collins St, Melbourne Vic 3000.
   2. Information on how to enter, mechanics of entry and Prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via mail, Internet, or telephone only.
   3. Directors, management and employees of AAMI and its related entities (and their immediate families), printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.
   4. Entry is only open to residents of Australia aged 18 years or older (Eligible Entrants).
   5. To enter and become an entrant, an Eligible Entrant must:
         1. hold a current motor insurance policy with AAMI and either:
                * log on to www.luckyaami.com.au (Promotional Website) to fully and correctly complete and successfully submit the online entry form, including providing the Eligible Entrant’s full name, postcode and current and valid email address;
                * fully and correctly complete the specially marked entry form provided in AAMI’s direct mail communication received by the Eligible Entrant, including providing the Eligible Entrant’s full name, residential address, telephone number and current and valid email address, and then mail the completed entry form in the Reply Paid Envelope provided to "reply paid 1305, South Melbourne VIC 3205" to be received by last mail on 30/12/2011; or
                * call AAMI on toll-free 1800 609 551 and answer the telephone operator’s prompts, including providing the Eligible Entrant’s full name, residential address, telephone number and current and valid email address.
            for which the Eligible Entrant will receive one (1) entry; or
         2. purchase and pay for a new Comprehensive Car Insurance Policy, Third Party Property Damage Insurance Policy, Building Insurance Policy, Contents Insurance Policy, Fire & Theft Contents Insurance Policy, Landlord Insurance Policy or Strata Title Landlord Insurance Policy (each, a New Policy) during the Promotional Period from AAMI either:
                * online through AAMI's website at www.aami.com.au;
                * by calling AAMI (standard call costs apply) and speaking to an operator; or
            and the Eligible Entrant will receive one (1) entry for each New Policy purchased during the Promotional Period.
   6. For the avoidance of doubt, a customer will not purchase a New Policy where they renew a current or expiring policy issued by AAMI.
   7. The promotion starts at 12:01am (AEDT) on 7/11/2011 and ends at 3:59pm (AEDT) on 30/12/2011 (Promotional Period). The draw to determine the winner will take place at 12:00 pm (AEDT) on 11/01/2012 at Contact Management Associates (VIC) Pty Ltd, 92-94 Tope Street, South Melbourne VIC 3205. The winner will be notified by telephone and in writing. The winner’s name and locality will be published in The Australian on 18/01/2012. AAMI’s decision is final and no correspondence will be entered into.
   8. Only one (1) entry per person entering pursuant to Condition 5(a) is permitted. Any subsequent entry from a person under Condition 5(a) after the first valid entry under Condition 5(a) is received will be invalid.
   9. Persons who enter pursuant to Condition 5(b) will receive one (1) entry for each New Policy they purchase and pay for during the Promotional Period.
  10. Payment for each New Policy must be approved and processed by AAMI within the Promotional Period in order to obtain an entry under Condition 5(b).
  11. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by AAMI during the Promotional Period. Entries received will be considered final by AAMI. AAMI accepts no responsibility for late, lost or misdirected entries.
  12. An entry submitted by post must be an original and photocopies or images of entry forms will not be accepted.
  13. Internet entries will be deemed accepted at the time of receipt by AAMI and not at the time of transmission. Contact details entered incorrectly on the Promotional Website by an entrant will deem an entry invalid. Costs associated with accessing the Promotional Website remain an entrant’s responsibility and may vary depending on the Internet service provider used.
  14. Calls from public telephones or mobiles may incur an additional charge. The charges for all telephone call entry services (if applicable) will appear on an entrant’s next telephone or mobile phone bill. All queries relating to mobile phone and telephone bills should be directed to an entrant’s mobile phone or telephone carrier.
  15. The first eligible entry randomly drawn from all entries received will win $30,000.00 on pre-paid Visa Cash Debit Cards (Prize). The Prize will be in the form of six (6) $5,000.00 pre-paid Visa Cash Debit Cards, will be issued in the winner’s name and will be sent via secured post to the address nominated by the winner. The Prize is subject to prevailing terms and conditions of use, including expiration dates (if any), and is not replaceable if lost.
  16. Total maximum Prize value is $30,000.00. The Prize is not transferable or exchangeable and cannot be taken as cash. The Prize must be taken as offered and cannot be varied. AAMI accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. AAMI accepts no responsibility for any variation in Prize value.
  17. AAMI may conduct a further draw at the same time and place as the original draw as is necessary on 11/4/2012 in order to distribute the Prize (if any) unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of a winner in the unclaimed Prize draw, the winner will be notified by telephone and in writing and the name and locality of the winner will be published in The Australian on 18/4/2012.
  18. The Prize will only be awarded following any winner validation and verification that AAMI requires in its sole discretion.
  19. If the Prize or an element of the Prize becomes unavailable, for any reason beyond AAMI’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
  20. It is a condition of accepting the Prize that the winner may be required to sign a legal release/s or release/s in a form determined by AAMI in its absolute discretion.
  21. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, AAMI reserves the right to seek damages to the fullest extent permitted by law. If AAMI suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify AAMI for those losses, damages and costs.
  22. The use of any automated entry software or any mechanical, electronic or other means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  23. AAMI will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of AAMI including but without limitation technical malfunctions or failures.
  24. AAMI and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
  25. AAMI and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking the Prize or using the Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). AAMI and its agents associated with this promotion take no responsibility for the Prize (or part of the Prize) damaged or lost in transit (if relevant).
  26. If for any reason this promotion is not capable of running as planned for any reason beyond the reasonable control of AAMI including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, AAMI reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize to the same value as the original Prize, subject to any written directions made under applicable State or Territory legislation.
  27. AAMI reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. AAMI’s legal rights to recover damages or other compensation from such an offender are reserved.
  28. As a condition of entering this promotion, an entrant consents to, in the event they are the winner, AAMI using the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by AAMI. The entrant agrees that, in the event they are the winner, the entrant will participate in all reasonable promoted activities in relation to the promotion as requested by AAMI and its agents.
  29. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of AAMI. AAMI collects personal information about an entrant to include the entrant in the promotion and, where appropriate, award the Prize. If the personal information requested is not provided, the entrant cannot participate in the promotion and is deemed ineligible. An entrant also agrees that AAMI may, in the event the entrant is the winner, publish or cause to be published the entrant’s name and locality in any media, as required under the relevant State or Territory lottery legislation. An entrant can gain access to, update or correct any personal information held by AAMI by contacting AAMI’s Privacy Officer on 13 22 44. All personal information will be stored at the office of AAMI. A copy of AAMI’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting AAMI.
  30. If an entrant participates in the promotion and also chooses to “opt-in” to receiving marketing materials when entering, the entrant acknowledges that a further primary purpose for collection of the entrant’s personal information by AAMI is to enable AAMI to use the information to assist AAMI in improving goods and services and to contact the entrant in the future with information on special offers or provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. AAMI may share information with its Australian related companies or promotional partners who may contact the entrant with special offers in this way. By entering the promotion and opting-in, an entrant acknowledges and agrees that AAMI may use the entrant’s personal information in the manner set out in this condition.
