GAME OF SKILL
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is via mail and internet only.
2. Entry is open to residents of Australia under the age of sixteen (16) only. Entrants, being under 18 years of age, must obtain the consent of their parent or legal guardian to enter the promotion and provide personal information about them. All entries of entrants who are under the age of 18 years and enter the promotion without disclosing (or who attempt to conceal) their age (as and where required) and/or do not provide the required parental consent (as and where required) will be deemed invalid. The Conditions of Entry will bind the entrants and any parent or legal guardian who gives their consent (for entrants aged 18 years and under).
3. The directors, management and employees (and their immediate families, including their children and wards) of the Promoter, its related entities, corporations or franchisees, printers, suppliers, providers and agencies associated with this promotion are ineligible to enter the promotion.
4. Promotion commences at 12.01 am (AEST) on 15/09/2011 and closes at midnight (AEST) on 26/11/2011 (“Promotional Period”). No entries sent by post will be accepted by the Promoter after last mail on 31/11/2011.
5. No McDonald’s product purchase is required to enter this competition.
6. To enter the promotion, eligible entrants must, during the Promotional Period:
a) Take a photograph of their family; and
b) Tell us in 100 words or less as follows:
“Tell us why your family is so special to you”;
These two components together form the entrant’s submission (“Submission”).

7. Any costs associated with accessing the Promotional Website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the Promotional Website shall be deemed invalid and will result in an ineligible entry.
8. Multiple entries are permitted. However, each entry must be submitted separately and must independently comply with these Conditions of Entry. Multiple entries by entrants must be substantially unique. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, illegible or incomprehensible entries will be deemed invalid. Entries missing any of the entrant’s details will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
9. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into.
10. The prize judging will take place at10.00 am (AEST) on 21/12/11. All eligible entries received will be judged by a panel of judges. Each valid entry will be judged on the basis of answer given in the submission and the creativity, skill, and merit (literary or artistic) of the submission, relative to the entrant’s age. Chance plays no part in determining the winners. The two Major Prizes will be awarded to the two entries that are judged to be the most outstanding. The 100 Minor Prizes will be awarded to the 100 next best entries.
11. All winners’ details will be published on 02/02/2012 at
www.happymeal.com.au. Major Prize winners’ details will be published in the Australian on 02/02/2012. All winners will be notified by telephone All reasonable steps to notify winners of the results of the judging will be taken by the Promoter. Judges' decision is final and no correspondence will be entered into.
12. There are a total of one hundred and two (102) prizes to be won. There are 100 Minor Prizes and 2 Major Prizes. The prizes are detailed below.

13. Minor Prizes
100 x The Smurfs Movie on DVD. Prize will not be awarded until 16 January 2012 when the DVD is released. Each DVD is valued at $39.95
14. Major Prizes
Two (2) x Dream World Holidays, each holiday is for 2 adults and 2 children (aged 0 to 13 years).
Major Prize Includes:
Return airfares from the winner’s nearest airport within Australia to the Gold Coast or Brisbane;
Four nights accommodation in Surfers Paradise on the Gold Coast;
Five days car hire;
2 day unlimited entry to Dreamworld and White Water World;

Each Major Prize is valued at $11,000. Conditions apply to the Major Prize, see below.
15. The total maximum prize is valued up to $22,000. The prizes are not transferable or exchangeable and cannot be taken as cash. Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
16. Minor Prizes will be sent to the winners nominated address within a reasonable time of the winner being notified and their eligibility verified. Prizes are not transferable or exchangeable and cannot be taken as cash. Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value.
17. Entrants can only enter in their own name. The Promoter reserves the right to request an entrant to produce (within the requested time) appropriate photo identification or any other documentation (to the Promoter’s satisfaction at its sole discretion) in order to confirm the entrant’s identity, age, residential address and email address, eligibility to enter the Promotion and any information submitted by the entrant in entering the promotion (including, where a winner is under 18 years of age, consent of a winner’s parent or legal guardian and also the name, age and address of the parent or legal guardian that gave their consent) before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant’s eligibility has not been verified or validated to the Promoter’s satisfaction within the time requested, the entry will be deemed invalid. A prize will only be awarded following any winning entrant’s validation and verification that the Promoter requires in its sole discretion.
18. The Promoter may award a prize to the next best judged entries at 10:00 am on 5/04/2011 in order to award a prize if a prize remains unclaimed by that date. If this occurs, prize winners’ details will be published on 10/05/2011 at
www.happymeal.com.au. All winners will be notified by telephone. All reasonable

19. The Promoter, its franchisees and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its associated agencies and companies accept no liability for prizes lost or damaged in transit.
20. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for: a) tampering with the entry process; or b) for submitting an entry which is not in accordance with these Conditions of Entry; or c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
21. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
22. Caution: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
23. The Promoter is not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
24. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion.
25. As a condition of entering this promotion, an entrant consents to the Promoter using the entrant's name, likeness, image and/or voice and coloured-in entry in the event they are a winner in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the

Promoter. The entrant agrees that, in the event they are a winner, the entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents, and expressly gives the Promoter permission to publish the winner’s name and state on

26. An entry and any copyright subsisting in an entry irrevocably becomes, at the time of entry, the property of the Promoter. Photographs submitted as part of a Submission will not be returned to the Entrant. The Promoter collects personal information about an entrant to include the entrant in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant cannot participate in the promotion. Entrants can also gain access to, update or correct any personal information by contacting the McDonalds Privacy Officer by mail at PO Box 392, Pennant Hills NSW 2120. All personal information will be stored at the office of the Promoter. 27. The Promoter is McDonalds Australia Limited, ABN 42 008 496 928, of 21 – 29 Central Avenue Thornleigh NSW 2120.
MAJOR PRIZE CONDITIONS
28. Selection of airline, departure and arrival destination, flight times and accommodation venue is at Ardent Leisure Limited’s discretion upon time of booking.
29. The Major Prizes are subject to availability, cannot be taken during Australian school holidays (inclusive of all Australian States) or during Gold Coast Super GP Season (dates TBC), and travel must be taken on a date which is mutually agreeable for both major prize winners (before 21 Dec 2012). If either prize winner is happy to accept the prize without the “Meet the Smurfs” component, then the prize may be taken at any time up to 21 December 2012 (excluding during Australia school holidays or during Gold Coast Super GP). Validity date of the Major Prize cannot be extended.
30. Flight may only be taken from the winners nearest Australian major airport to the Gold Coast or Brisbane.
31. The Major Prize winner will be required to provide at least 3 weeks notice of intent to travel. All components of Major Prize are subject to availability at time of booking.
32. If the winner resides within a 3-hour drive or 240km from Dreamworld and WhiteWater World, airfares and car rental are not included in the Major Prize.
33. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. The winner of the Major Prize (and their travel companions) will not accrue any frequent flyer points from taking the Major Prize.
34. The car hire vehicle will be available upon arrival at Queensland, for pick from the airport and drop off on departure. It is a condition that the hirer be 25 years and over, and hold a current Australian or New Zealand license. Provisional licences and learners permits will not be accepted. The Promoter accepts no responsibility for damage, mistreatment or ill manor to the hire car caused by the hirer. The

Promoter will not be liable for any additional expenses incurred by the hirer through mistreatment, illegal behaviours, or a violation of the car hire's terms and conditions of use. The car hire only covers the day rate hire of the car, all insurance, petrol and damage costs will be the responsibility of the Major Prize-winner. Prize winner will need to present a current credit card for security purposes upon collection of the vehicle.
35. All components of the Major Prize must be taken together. Travel Insurance is not included. Travel Prize does not include meals, spending money or transport to and from departure and arrival points. All other ancillary and travel costs are the winner’s responsibility. All additional costs incurred whereby the Major Prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner. All travel variations are subject to approval by Ardent Leisure Limited upon booking. Travel variations include, but are not limited to extension of travel duration, travellers outside of the age restriction and additional travellers.
36. Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the Major Prize by the time stipulated, then the Major Prize will be forfeited by the winner and cash will not be awarded in lieu of Major Prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the Major Prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
37. If the winner is under the age of 18 years the Major Prize may be awarded, at the absolute discretion of the promoter, to their parent or legal guardian. In the event that the winner is under 18 years of age, the winner must be accompanied by an adult aged 21 years and over.
38. Any change in the value of the Major Prize between publishing date and the date Major Prize is claimed is not the responsibility of the promoter.
39. All other costs not disclosed in these Conditions of Entry including, but not only, additional meals, beverages, laundry services, additional spending money, transport to and from airport departure point, taxes (including applicable arrival and departure taxes), insurance, travel insurance, passports, visas and all other ancillary costs not expressly provided but incurred in acceptance and use of the Major Prize are the responsibility of the winner and their travel companions. The Major Prize cannot be used in conjunction with any other discounts or special offers. Use of any passes and vouchers issued as part of the Major Prize are subject to prevailing terms and conditions of use.
40. Taking the Major Prizes is subject to any prevailing terms and conditions of any accommodation/transport/services/transfers or amusement parks or tour providers (as applicable), and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the winner, or their travel companions, are unable to use any element of the Major Prize as stated for whatever reason, including refusal of entry or departure into or out of Queensland, refusal of entry into or ejection from any event or participation in certain activities for health, age, behaviour or safety reasons. Any part of the Major Prize that is not taken for any reason is forfeited.
41. The Major Prize’s travel component must be travelled in full within twelve (12) months of being awarded (21/12/2011 to 21/12/2012) and travel must be taken on a date which is mutually agreeable for both major prize winners (before 21 Dec 2012). Travel exclusion periods apply as outlined in clause 29. No extension or

variation of the travel dates nominated by the Promoter will be permitted. The winner and their travel companions will not accrue any frequent flyer points from taking the Major Prize. All components of the Major Prize must be taken together. Any element of the Major Prize not taken will be deemed to be forfeited. Accommodation and travel is subject to booking, accommodation, flight availability and blackout periods may apply. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner and their travel companions. Travel and accommodation are to be arranged by the Promoter or a licensed travel agent nominated by the Promoter.
42. During the entire duration of the Major Prize, a nominated parent/guardian must accompany any person under 18 years of age. It is also a condition of accepting the Major Prize that the winner (and their travel companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
43. The Promoter reserves the right to request the Major Prize winner to have the winner’s travel companions to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity before issuing the Major Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the details of the winner’s travel companions have not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The Major Prize will only be awarded following any validation and verification relating to the winner’s travel companions that the Promoter requires in its sole discretion.
44. If the prizes or any element of the prizes become unavailable for any reason beyond the Promoter’s reasonable control, then a similar prize or prize element of equal or greater value (including an alternative travel prize at an alternative destination as specified by the Promoter) will be awarded to the winner in lieu, subject to any written directions made under applicable Australian State and Territory legislation.
45. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable Australian State and Territory legislation, the Promoter reserves the right to either provide an alternative prize (including an alternative travel prize at an alternative destination and date as specified by the Promoter) to the same value as the original prize, or to cancel, terminate, modify or suspend the promotion
