Everyone says they're easygoing - especially in Australia where it's practically the national sport. But for every person who is legitimately laid back, there are probably ten others who spend 99% of their energy trying to look like they just fell out of bed and magically landed at work. And who can blame them? Easygoingness beats difficultgoingness every time.

Right now, Jameson is looking for Australia's most easygoing James so they can fly him (or her) out to their distillery in Ireland. There, that lucky, laid back individual will be named the official Jameson representative to Australia, a title that comes with a year's supply of whiskey. TERMS AND CONDITIONS

1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.


2.Entry is only open to residents of Australia (excluding NT residents) aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 


3.Promotion commences on 1/11/2011 and closes at 11:59pm AEDST on 14/12/2011 (Promotional Period).



GAME OF SKILL


4.To be eligible to enter the game of skill element, an entrant’s first, middle or last name must be either ‘James’, ‘Jaimes’, ‘Jayms’, ‘Jammes’, ‘Shamus’, ‘Seumas’, ‘Jim’ or ‘Jimmy’, and no other variations will be acceptable. 


5.To enter the game of skill element, entrants must during the Promotional Period:


a.visit the Jameson Whiskey Australia website at www.Jamesonwhiskey.com.au/James; 
b.accept the Jameson Facebook Connect application (Application) by clicking “Allow” when prompted;
c.using the tools on the Application, either record one (1) video response or upload one (1) video/photograph. Uploaded files must be submitted in .jpg, .png or .gif format and must not exceed 2 MB file size;
d.fully complete the entry from; and
e.submit their entry.


6.Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.


7.This element is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on creative merit, uniqueness, how entertaining the entry is and how it depicts the easygoing attitude of the entrant.


8.The best valid and correct entry, as determined by the judges, will win a trip for two (2) adults to Dublin, Ireland, valued at up to AU$6,000 depending on date and point of departure, including the following:


a.return economy airfares from winner's nearest capital city to Dublin, Ireland;
b.five (5) nights three (3) star twin share accommodation;
c.a tour of the Jameson Distillery in County Cork;
d.return bus travel to Jameson Distillery in County Cork and accommodation; and
e.twelve (12) x 700ml bottles of Jameson Irish Whisky containing the winner’s name;


9.Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 16/11/2012 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or peak periods.


10.The winner and companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner and companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Winner may be required to present credit card at time of accommodation check in.


11.The tour of the Jameson Distillery in County Cork prize is subject to the event venue and ticket terms and conditions. The Promoter and tour organisers hereby expressly reserve the right to eject the winner and/or companion for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.



GAME OF CHANCE


12.To be eligible to enter the game of chance element, an entrant must have a Facebook friend whose first, middle or last name is either ‘James’, ‘Jaimes’, ‘Jayms’, ‘Jammes’, ‘Shamus’, ‘Seumas’, ‘Jim’ or ‘Jimmy’, and no other variations will be acceptable (Eligible Facebook Friend).


13.To enter the game of chance element, entrants must during the Promotional Period:


a.visit the Jameson Whiskey Australia website at www.Jamesonwhiskey.com.au/James; 
b.accept the Jameson Facebook Connect application (Application) by clicking “Allow” when prompted;
c.using the tools on the Application, select an Eligible Facebook Friend to nominate;
d.fully complete the entry from; and
e.submit their entry.


14.Multiple entries permitted, subject to the following: (a) each entry must be based on a separate Eligible Facebook Friend; and (b) each entry must be submitted separately and in accordance with entry requirements.


15.For the avoidance of about, Eligible Facebook Friends will not be entered into the promotion and the Promoter will not be collecting their personal information.


16.The draw will take place at Tequila, 80 Gipps Street, Pyrmont NSW 2009 on 16/12/2011 at 12:30 AEDST.  Winners will be notified in writing and their names will be published in The Australian on 30/12/2011.


17.The first ten (10) valid and correct entries drawn will each win a year supply of Jameson Standard product Irish Whiskey valued at $450. A year supply is made up of twelve (12) x 700ml bottles of Jameson Standard product Irish Whiskey. Ten (10) prizes will be awarded with a total prize pool value of $4,500.


18.A draw for the prizes, if unclaimed, may take place on 16/3/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing and their names will be published in The Australian on 30/3/2012.


19.No more than twenty (20) litres of alcohol will be won by New South Wales residents – i.e. only the first two (2), if any, New South Wales residents drawn will a prize in the draw and unclaimed draw. If two (2) prizes have been won by New South Wales in the draw and unclaimed draw, any further New South Wales entrants drawn will be awarded cash in lieu of a prize.



GENERAL


20.Incomplete, indecipherable or illegible entries will be deemed invalid.


21.The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and will render all entries submitted by that individual invalid.


22.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence), to disqualify any individual who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


23.The Promoter reserves the right, at any time, to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts.


24.The Promoter’s decision is final and no correspondence will be entered into.


25.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.


26.If any prizes (or part of any prizes) are unavailable, the Promoter, in its discretion, reserves the right to substitute the prizes (or that part of the prizes) with prizes to the equal value and/or specification, subject to any written directions from a regulatory authority.


27.If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash, unless otherwise specified.


28.Prizes are subject to the standard terms and conditions of individual prize and service providers. Prizes, or any unused portion of prizes, are not transferable or exchangeable and cannot be taken as cash.


29.When an entrant submits any materials via the promotion including comments, recordings, videos and images (Content), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.



Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.



Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.


30.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.


31.In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a regulatory authority.


32.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, subject to any written directions from a regulatory authority.


33.Any cost associated with accessing the promotional website or Application, is the entrant’s responsibility and is dependent on the internet service provider used.
