”CROSS-TITLE CHRISTMAS 2011 SUBSCRIPTIONS” PROMOTION TERMS & CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to all residents of Australia aged 18 years or over who subscribe or renew their subscription between 24/10/2011 and 11:59pm AEDST on 30/1/2012 (inclusive) to one or more of the following publications: The Australian Women’s Weekly, Money, Australian Personal Computer, PC User, Australian Gourmet Traveller, Gourmet Traveller Wine, GoodFood, Australian House and Garden, Belle, Burke’s Backyard, Real Living, Street Machine, Wheels, Top Gear, CLEO, Cosmopolitan Australia, Shop Til You Drop, madison, Harper’s BAZAAR, Dolly, GoodHealth, Grazia, Mother & Baby, OK!, Woman’s Day, NW, Motor, Empire, Rolling Stone, FHM, 4x4 Australia, Australian Geographic, Recipes+, UFC and Men’s Style. Entry is subject to verification of the credit card or, if payment is made by cheque, the cheque must be cleared for payment by the close date of the promotion. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. The promotion commences 24/10/2011 and closes 11:59pm AEDST on 30/1/2012 (”Promotional Period”).

4. To receive an automatic entry, entrants must during the Promotional Period either:
Visit www.magshop.com.au/xmas or www.magshop.com.au during the Promotional Period and subscribe/renew online (clearly specifying the name of the magazine they wish to subscribe to/renew). Payment can be made online via credit card or a cheque can be sent to Reply Paid 4967, Sydney, NSW 2001; OR
Obtain or renew a subscription via telephone on 136 116 (Mon – Fri 8:00am AEDST – 8:00pm AEDST. Entrants must quote the promotional code relating to the magazine they wish to subscribe to which can be found online. Maximum cost of call is 55c. Calls from mobile and pay phones may attract a higher rate.

5. If an entrant purchases a magazine subscription on behalf of a friend as a gift, both the gift recipient and the person who ordered and paid for the subscription will receive an entry into the draw.

6. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per subscription per person (unless otherwise stated); and (b) each entry must be submitted separately and in accordance with entry requirements.

7. The draw will take place at ACP Magazines Level 11, 54 Park Street, Sydney NSW 2000 at 11:00am AEDST on 8/2/2012. Winners will be notified in writing by mail within two (2) days of the draw and their names will be published on www.magshop.com.au, and in The Public notices section of The Australian on 15/2/2012. The Promoter’s decision is final and no correspondence will be entered into.

8. The first ten (10) valid entries drawn will each win a trip for the winner and one (1) guest to enjoy a six (6) night Hawaiian Accommodation package. Each prize trip is valued at up to AUD$12,051.73 depending on time of the year trip is taken and the departure point.
The prize includes:
Return economy class airfares for the winner and his/her guest from Sydney International Airport flying Hawaiian Airlines to Honolulu. Both persons must travel together on the same dates & routing. Winner and his/her companion must make their own way to Sydney International Airport for flight departure. Costs associated with travel to and from Sydney International Airport are the responsibility of the winner.
Return airport to hotel coach transfers between Honolulu airport and The Royal Hawaiian. Return airport transfers include flower lei greeting upon arrival.
Six (6) nights Hawaiian Accommodation Package includes:
Six (6) nights twin share accommodation stay in either a Royal Beach Tower Ocean Hotel Room or Royal Ocean Hotel Room at The Royal Hawaiian, Oahu.
Accommodation at The Royal Hawaiian, Oahu includes:
High-speed internet access in guest room;
Self-parking for one (1) vehicle;
Unlimited local and 1-800 telephone calls;
Up to 60 minutes of long distance telephone calls per day;
Children 12 & under eat for free from children’s menu in designated dining outlets for breakfast, lunch, and/or dinner with paying adult;
Travel is restricted to the scheduled services of Hawaiian Airlines as follows: Sydney-Honolulu-Sydney. The prize is subject to the following conditions:
Sydney-Honolulu-Sydney flight taxes and fuel surcharges are included;
The prize is non-transferrable/non-exchangeable/non-replaceable/non-upgradeable;
When ready to travel, winner must fax a copy of the completed travel form supplied to them by the Promoter along with the requested dates to (02) 8229 4998;
Winner must acknowledge the prize in writing by completing the Hawaiian Airlines prize certificate (leave travel dates blank), supplied to them by the Promoter, no later than 30 days of the date of the event at which the prize was given or risk forfeiting it. The completed prize certificate needs to be faxed to (02) 8229 4998;
When ready to travel, winner must again fax a copy of this completed form along with the requested dates to (02) 8229 4998;
Winner and his/her guest must be in possession of a passport that is valid for at least 6 months from the date of departing Australia;
Each prize winner and their guest must travel together and share the same itinerary;
Spring break, Mid June to late August, Thanksgiving and Christmas holiday period are busy periods and bookings may not be available during these periods;
Changes are not permitted to date/time of flights once booked (unless permitted by the Promoter);
If the Promoter permits changes to date/time of flights, the winner will be responsible for penalties associated with the changes. Changes to flights, where permitted by the Promoter, are only available for other economy flights. The penalties that apply are as follows: a) AUS$140.66 for change in date/time for flights (economy class) to and/or from Sydney and Honolulu;
Changes in flights (where permitted by the Promoter) are subject to availability;
Payment for the airport taxes can only be done by cash or agency cheque and will be provided by the Promoter;
Winners must fax their completed travel form a minimum of THREE (3) weeks prior to their travel date for (electronic ticket) e-ticket issuance. The e-ticket confirmation will be e-mailed or faxed to the address the winner provides on the form;
All components of the prize must be taken together. Accommodation and flights are subject to availability;
Prize is valid through to 30 November 2012 (subject to booking and flight availability), with the following blackout dates: 20 March 2012 – 21 April 2012; 2-13 July 2012; 24 September – 5 October 2012.

9. All other costs including additional meals, tips, additional transfer fees, excess baggage, spending money, beverages, transport to and from departure/arrival points, additional transfers, taxes (unless otherwise specified), airport charges, insurances, passports, visas, gratuities, excess baggage costs, room service costs, optional excursions whilst on tour and all other ancillary costs are the responsibility of the winner and his/her guest.

10. No extension on the validity date of this prize will be permitted. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee at the cost of the winner.
The winner and his/her guest must be in possession of valid picture ID and proof of citizenship satisfactory to customs and immigration officials.
Prices quoted are recommended retail and are correct at 30/8/2011 and can be changed at any time subject to market fluctuation. The Promoter and publishers take no responsibility for market price fluctuations.

11. All food, beverages, taxes, and other incidental costs incurred by the guest are to be settled prior to departure from, and direct with, the individual hotel;
Winners may be required to present their credit card at time of accommodation check in; and
Frequent flyer points will not form part of the prize.

Total prize pool is valued up to AUD$120,517.30

12. If the winner wishes to stay longer than six (6) nights in Hawaii or at an accommodation not nominated by the Promoter, all additional costs incurred will be the winner’s responsibility.
Accommodations are confirmed at the time of reservation based upon availability. This prize is exclusive of any:
Taxes and additional charges outside of the accommodations. These include but are not limited to:
Incidental charges the guest charges to their folio for food and beverage, activities, spa, alcohol, in-room movies or phone;
Transfers to and from the hotel and airport or any other location;
3rd person charges for any additional person sharing the room; due to union agreement additional charges will be added;
The prize is non-transferable once reservations are made and any lost certificate is not replaceable;
There is no cash value for any unused portion of the prize and it may not be redeemed for cash or credit.

13. The Promoter recommends that the winner obtain travel insurance, however, this is not a mandatory requirement and any costs to do so will be at the winner’s personal expense.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

14. Incomplete, indecipherable, or illegible entries will be deemed invalid.

15. The winner and his/her companion is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations required and travel documentation. The winner (and his/her companion) must depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The winner may be required to present credit card at time of check in at accommodation. Prize is subject to the standard terms and conditions of individual prize and service providers.

16. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (”Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

17. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

18. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
In the event of unforeseen circumstances, the Promoter reserves the right to offer an alternative prize of equal or greater value. In the event of war, terrorism, state of emergency or disaster (including natural disaster), the Promoter reserves the right to either provide an alternative travel prize (including an alternative destination as specified by the Promoter) to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.

19. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter at their discretion.

20. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated, then the prize or that element of the prize will be forfeited.

21. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

22. The Promoter may conduct a further draw at the same time and place as the original draw as necessary on 8/5/2012 in order to distribute any prize which remains unclaimed by that date subject to reference to all relevant state and territory regulations and any written directions. Winners, if any will be notified in writing within two (2) days of the draw and their names will be published in the Public Notices section of The Australian on 15/5/2012.

23. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

24. The Promoter reserves the right to verify the validity of all entries and entrants (including an entrants name, age and place of residence) and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

25. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers, to publish the winner's name and locality as required under the relevant lottery legislation and, as required, to provide winner’s information to Australian regulatory authorities without any further reference or payment or other compensation to the entrant. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Collection, use and disclosure of information collected in connection with this promotion is governed by the Privacy Notice. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

26. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

27. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
