Summadayze National Australia Tour Competition (VIC/SA/WA/QLD)
Terms and Conditions
1. This competition is conducted by Cotton On Clothing Pty Ltd (ACN 052 130 462) of 14 Shepherd Court, North Geelong, Victoria 3215 (“Cotton On”).
2. Information regarding prizes and how to enter forms part of these terms and conditions. By entering this competition, contestants accept these terms and conditions.
3. Entry is open to Australian residents. Employees of Cotton On and their immediate families and the suppliers and agencies associated with this competition are ineligible to enter. Contestants must be 18 years or older to attend this event
4. Contestants must enter during the period from 10am AEST on 23rd November 2011 to 5pm AEST on 14th December 2011 (“Competition Period”).
5. To enter, contestants must head to shop.cottonon.com/summadayze/ to submit an entry form during the Competition, including by providing first name, last name, email address, postal address, and postal code and answer in 25 words or less “ Which artist is on high rotation on your ipod and why?” (“Topic”). Limit 1 entry per contestant. Late, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected responses will be deemed invalid.
6. Each response to the Topic will be reviewed and judged by a panel of Cotton On’s marketing and communications personnel (“Panel”). The Panel will judge each response according to how relevant, creative and inspiring it is. All decisions of the Panel are final and no discussions or correspondence will be entered into.
7. A prize will be awarded to 3 winners in VIC/WA/QLD/SA who submit the most relevant, creative and inspiring responses to the Topic as judged by the Panel by 20 th December 2011. The prize winners will be contacted by phone or email by 20th October 2011.
8. Each winner will receive one double pass to Summadayze Festival valued at $ 262 (including relevant taxes). The double pass entitles you to attend Summadayze on one of the below dates. It does not include any travel, accommodation or other ancillary costs associated with attending the festival. You must be 18 years or older to attend this event.
9. Summadayze Festival takes place at the following locations and dates:
Dec 31st- New Years Eve, Adelaide- Rymill Park, South Australia
Jan 1st - New Years Day, Melbourne, Sidney Myer Music Bowl, Victoria
Jan 2nd- (Summafieldayze) Gold Coast, Doug Jennings Park, Queensland
Jan 3rd -Perth, Sir James Mitchell Park & Taylor Reserve, Western Australia
10. If any prize remains unclaimed after 3 days of the winner being announced, Cotton On may deem that winner as ineligible to receive the prize. In that event, Cotton On will reconvene the Panel to determine the next most relevant, creative and inspiring response to the Topic from the relevant Pool and the contestant who submitted that response will be deemed the replacement winner.
11. Prizes are not transferable or exchangeable and cannot be redeemed for cash. Cotton On accepts no responsibility for any variation in the value of prizes. Where a prize is unavailable for any reason, Cotton On may substitute another item of equal or greater value for that prize, as determined by Cotton On.
12. Cotton On reserves the right, at any time, to verify the validity of entries and the identity of contestants. Proof of entry and identity will only be deemed as sufficient at the discretion of Cotton On.
13. If this competition is interfered with in any way or is not capable of being properly conducted due to any reason beyond the reasonable control of Cotton On, Cotton On reserves its rights to disqualify any contestant or to modify, suspend, terminate or cancel this competition, to the extent permitted by law.
14. Cotton On and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the maximum extent permitted by law). Without limiting the foregoing, none of Cotton On or its associated agencies or companies will be liable for any damage to any prize which occurs in transit and winners are solely responsible for any tax implications that apply to them.
15. By participating in this competition, each contestant assigns copyright (including future copyright) in and to any entry submitted by such contestant and, to the extent permitted by law, waives his or her moral rights in respect of same. Each contestant warrants to Cotton On that his or her entry does not infringe the intellectual property rights of any person.
16. Personal information provided by contestants will be used by Cotton On for the purpose of conducting this competition and otherwise in accordance with contestants’ consent. Cotton On may disclose contestants’ personal information to its contractors and agents in relation to the conduct of this competition. Cotton On’s privacy policy is available at
