PayPal Promotion (“Promotion”)
TERMS AND CONDITIONS
1. The Promotion is conducted by PayPal Australia Pty Ltd (ABN 93 111 195 389) of 1 York Street, Sydney, NSW 2000, phone: (02) 8288
0000 (“PayPal”).
2. This Promotion is based on the following terms and information (“Terms”).  Please read these Terms before entering the Promotion.  If you
participate in the Promotion you will be considered to have agreed and accepted to these Terms.  All entry instructions and prize information
published by PayPal form part of these Terms.
Who can enter the Promotion?
3. You can enter the promotion if you are (“Entrants”):
a) an Australian resident;
b) 18 years or older;
c) hold an active Australian PayPal account and eBay account before entering the Prize Draw   (defined below); and
d) not an employee, contractor (or their immediate family members) of:  PayPal, eBay or any third parties associated with the Promotion. 
What does active mean? An active account usually means that access to the Entrant’s PayPal and eBay account have not been limited. 
PayPal or eBay will determine in its discretion if the Entrant’s account is active.   
What are the prizes?
4. The Winner (defined below) will win either the “Hong Kong Prize Choice” or “Hawaii Prize Choice” (each referred to as “Prize Choice”)  as
selected by the Winner
5. The Hong Kong Prize Choice  includes:
a) return economy airfares for 2 people departing from the Winner’s nearest Australian capital city to Hong Kong International Airport (flight
associated taxes are included) 
b) in Hong Kong  - 4 night twin share accommodation with breakfast in a 4 star property to be determined by PayPal
c) transfers from and to Hong Kong International Airport to the hotel;
d) tickets for 2 to an event (to be determined by PayPal) during the  2012 Hong Kong Fashion Week (held between 3rd and 6th July 
2012) in Hong Kong; and
e) AUD$1,500 to spend.
6. The Hawaii Prize Choice includes:
a) return economy airfares for 2 people departing from the Winner’s neaest Australian capital city to Honolulu International Airport, Hawaii
(flight associated taxes are included)   
b) in Honolulu  - 4 night twin share accommodation with breakfast in a 4 star property to be determined by PayPal
c) transfers from and to Honolulu International Airport to the hotel; and
d) AUD$1,500 to spend.
7. The Hong Kong Prize is valued at a maximum of AU$8,750.  The Hawaii Prize is valued at a maximum of AU$8,750.  The total Prize pool for
this Promotion is valued at a maximum of AU$8,750.
8. The Winner is responsible for the costs of any transfers to and from the Australian airport.  All components of the Prize must be taken together and the Winner and the Winner’s travelling companion travel together on the same flight on all sectors and use the Prize components
together.   If the travelling companion is under 18, an adult must accompany the minor in the use of the Prize.  If the Winner chooses to
not travel with a travelling companion any unused Prize component will be forfeited.  If the Winner selects the Hong Kong Prize Choice, but
chooses to not travel between 3 and 6 July 2012, the Hong Kong Fashion Week event portion of the prize will be forfeited, and no compensation will be given in lieu. 
9. Unless expressly stated all other costs and expenses associated with taking the Prize become the responsibility of the Winner, including, but
not limited to, the following:
a) PayPal’s fees;
b) fees and taxes;
c) transfers;
d) meals;
e) entertainment;
f) insurance; and
g) all other incidental and ancillary costs, incurred by the Prize Winner and/or their travel companion as a direct or indirect result of taking
the Prize that are not otherwise stated as included in the Prize.
10. Frequent flyer points cannot be earned on any of the flights included in the Prize.
When do entries start and close?
11. Entries start at 12:01am ADST on 15 November 2011 and the entries close on midnight ADST on 31 December 2011 (“Promotion Period”).   
Please be aware that there may be a different time zone where you live (for example Western Australia, South Australia or the Northern Territory) and you should follow the ADST zone.
How do I enter the draw to win a Prize?
12. To enter the draw to win a Prize (“Prize Draw”) you have to during the Promotion Period.
a) purchase an item on www.ebay.com.au;  and
b) pay for the item using an Australian PayPal account ;
 (“Entry Requirements”)
How many times can I enter the Prize Draw?
13. You can enter as many times as you like!  Each time you meet all of these Terms including the Entry Requirements you will receive one entry
into the Prize Draw.
How will the winner of the Prize Draw be selected?
14. The winner of the Prize (“Winner”) will be drawn electronically at 2:00pm ADST on 16 January 2012 (“Draw Date”) at Mike Da Silva and Associates (Aust) Pty Ltd at 15 Grosvenor Street, Neutral Bay. 
15. The Prize Winner will be notified via phone and email  within  2 working days of the Draw Date.  His/her details will be published in The
Australian newspaper on 20 January 2012.  The Winner must choose whether they want to claim the Hong Kong Prize or Hawaii Prize within
one month of the Draw Date.
When will the Winner receive the Prize?
16. PayPal or PayPal’s authorised representative will make all bookings and issue tickets and documentation included in the Prize within 28 days
of the Draw Date.   
17. The Winner must use all components of the Prize (travel, accommodation etc) within 12 months of the Draw Date  otherwise the Prize will
be forfeited and no substitute will be offered.   If any component of the Prizes are not available within 28 days of the Draw Date the Winner,
within 28 days of the Draw Date, will receive confirmation in writing of when the relevant component of the Prize will be received/delivered to
the Winner.
Is it free to enter the Promotion?
18. As set out in these Terms you have to make a purchase on www.ebay.com.au paying with yo ur Australian  PayPal account to enter the
Promotion.   There may also be costs associated with entering the Promotion for example accessing the internet and mobile phone charges.
PayPal is not responsible for these costs.
Is there an unclaimed prize draw?
19. Yes, subject to any laws, if a Prize is
a) not claimed by a winner  or
b) forfeited for any reason;
the Prize will be awarded to another Eligible Entrant in an unclaimed prize draw (the “Unclaimed Prize Draw”) at 2:00pm AEST on 30 April
2012 by Mike Da Silva and Associates (Aust) Pty Ltd at 15 Grosvenor Street, Neutral Bay.  The winner of the Unclaimed Prize Draw will be
notified in writing and by telephone within 2 days of the Unclaimed Prize Draw. The winner(s) name will be published in The Australian newspaper on 7 May 2012.
What if my details have changed during the Promotion Period?
20. If your details change at any time between the date you enter the Promotion and 11 January 2012,  please notify PayPal Customer Service
immediately by clicking on “Contact Us” at the bottom of any PayPal page on our website (www.paypal.com.au).  We will not be responsible
for any entries or prizes that cannot be submitted / delivered because your details have changed.
21. If PayPal is uncertain as to the claim to a Prize or the identity of the Winner, the Prize will be forfeited. 
Other important terms to know
22. By accepting and using the Prize, the Prize Winner’s travel companion must agree to these Terms to be eligible to accompany the Prize Winner on the Prize and PayPal may require such acceptance in writing.
23. A valid credit card imprint or cash deposit may be required by the Prize Winner and/or their travel companion at check-in to the hotel for all
incidental charges.
24. The Prize Winner is required to obtain relevant and suitable travel insurance at his/her own expense for the travellers in order to be able to
use the Prize. It is the travellers’ sole responsibility to ensure that they have valid documentation which meet the requirements of immigration
and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.
25. PayPal makes no representation as to the safety conditions or any other conditions that may exist at any destination.  It is a condition of
accepting the prize choice that the winner and his/her travelling companions will be required to sign a Release of Liability   in in a form to be
determined in the absolute discretion of the Promoter.
26. The Winners acknowledge that the Prizes may be subject to additional terms and conditions imposed by third parties. PayPal does not accept any responsibility and is not liable for any conditions imposed by third parties in relation to the Prizes.
27. All Prize values are correct as at 1 November 2011.  Prize values are reflective of the Recommended Retail Price and are in Australian Dollars. PayPal takes no responsibility for any variations in Prize values.
28. The Prize must be taken by the Winner and his/her nominated travel companion and cannot be transferred to another person, are not
redeemable for cash and any attempt to resell or auction all or part of the prizes will result in immediate cancellation of the Prizes. 
29. Any element of a Prize which is unused will be forfeited and no compensation will be paid in lieu of that element of the Prize choice.
30. Once any Prize has left PayPal’s premises, PayPal and any entities associated with the Promotion PayPal is not liable or responsible for any
delay in delivery, loss or damage to the Prizes.
31. If a Prize or part of a Prize is unavailable for reasons outside of PayPal’s control for example delayed delivery by the supplier, PayPal will in
its absolute discretion substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the
authorities that have issued permits for the conduct of the Promotion.
32. PayPal is not responsible or liable for any loss or damages incurred by any party if any prize is unavailable.
33. The Prizes must be used in accordance with PayPal’s User Agreement which can be found by clicking on “Legal Agreements” at the bottom
of our website (www.paypal.com.au). 
34. You must ensure that your entries are received by PayPal during the Promotion Period.  All entries are deemed to be received at the time of
receipt by PayPal not time of transmission by the Entrant. PayPal is not responsible for any entries not received by PayPal or for any delays in
the delivery of any entries When will an entry be invalid or rejected?
35. Entries into the Promotion may be invalid or PayPal may reject entries if PayPal reasonably forms the opinion that an entry is:
a) made using automated entry means or by use of a computer entry service;
b) late;
c) incomplete;
d) incorrect including if an Entrant provides the wrong details;
e) breaches PayPal’s User Agreement;
f) incomprehensible;
g) unlawful;
h) offensive;
i) capable of encouraging conduct that would be considered a criminal offence;
j) capable of giving rise to civil liability; and/or
k) made on behalf of an Entrant by a third party or otherwise by proxy.
36. PayPal reserves the right, at any time, to verify the validity of entries and Entrants (including an entrant’s identity, age and place of residence)
and to disqualify any Entrant who submits an entry that is not in accordance with these Terms or who tampers with the entry process. An
Entrant must, within 7 days of being asked, allow PayPal to inspect and copy any documents PayPal may request establishing eligibility to
enter the Promotion, including evidence of age, residence or identity.  Proof of identification, residency and entry considered suitable for
verification is at the discretion of PayPal.
37. Errors and omissions may be accepted at PayPal’s discretion. Failure by PayPal to enforce any of its rights at any stage does not constitute
a waiver of those rights.
38. PayPal may, at its absolute discretion, declare any or all entries made by an Entrant to be invalid if the Entrant:
a) fails to establish their entitlement to enter the Promotion to PayPal’s satisfaction; or
b) fails to produce documents as requested by PayPal to verify the validity of entries or produces items that are illegible, stolen, forged,
reconstructed, altered, incomplete or tampered with in any way;
c) appears, to PayPal, to have tampered with, or benefited from tampering with, the entry process;
d) has submitted an entry that is not in accordance with these Terms; or
e) does not hold an open or active PayPal account.  The relevant Prize will be forfeited by the Winner.
39. If for any reason, the Promotion is not capable of running as planned, including, without limitation, due to infection by computer virus, bugs,
tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of PayPal, which corrupt or affect the
administration, security, fairness or integrity or proper conduct of the Promotion, PayPal reserves the right in its sole discretion take any action that may be available, including to cancel, terminate, modify or suspend the Promotion subject to any direction given under the relevant
state/territory permit regulations and/or disqualify any individual who tampers with the entry process.
40. Except for any liability that cannot be excluded by law, PayPal (including its officers, employees,  agents and related Bodies Corporate as
defined by the Corporations Act 2001 (Cth) exclude all liability (including negligence) for any personal injury or any loss or damage (including
loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to:
a) any technical difficulties, technical error or equipment malfunction (whether or not under PayPal’s control);
b)     any error, omission, interruption, deletion, delay, defect, theft, unauthorised access or third party interference;
c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by PayPal) due to any re
son beyond the reasonable control of PayPal;
d) any variation in Prize value to that stated in these Terms;
e) any tax liability incurred by a winner or entrant; or
f) use of a Prize.
41. Under no circumstances will PayPal’s total aggregate liability in connection with this Promotion, whether based upon warranty, contract,
statute, tort (including negligence) or otherwise, exceed AU$1,000.
42. These rules are Terms and constitute the entire terms and conditions between the Entrant and PayPal with respect to the Promotion and
cannot be altered, modified or amended.43. This Promotion is authorised under permit numbers NSW LTPS/11/10425, ACT TP11/04576, Victorian Permit No. 11/2486 & SA Licence
No. T11/2442.
44. These Terms are subject to the applicable State or Territory lottery laws and are governed by the laws of Australia.
How your personal information may be collected and used
45. All entries become the property of PayPal.
46. If you participate in this Promotion you agree that:
a) PayPal or other entities on its behalf may use and collect your personal information to administer this Promotion and to contact you
about this Promotion and about PayPal’s services.  This information will be collected and used in accordance with PayPal’s Privacy Policy,
which can be found by clicking on “Legal Agreements” at the bottom of our website (www.paypal.com.au).  You can choose to opt-out from
these communications at any time.
b) your personal information may be disclosed to third parties including marketing and communications agencies in order to conduct this
Promotion and to the authorities responsible for the regulation of lotteries. Winners’ names will be published and retained as required by
relevant legislation and as specified in these Terms;
c) PayPal may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and
profiling purposes, including sending electronic messages or contacting the Entrant.  This information will be collected and used in accordance with PayPal’s Privacy Policy, which can be found by clicking on “Legal Agreements” at the bottom of our website (www.paypal.com.au).
47. The PayPal service is provided by PayPal Australia Pty Ltd (ABN 93 111 195 389) which holds an Australian Financial Services Licence,
number 304962. Before deciding to sign-up for or use the PayPal service entrants should consider the Product Disclosure Statement, available at www.paypal.com.au.
