TERMS AND CONDITIONS
1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is only open to Facebook users 18 years and over who reside in Australia and who will be available to claim the major prize. Other Facebook users may upload a photo but are not eligible to win any prizes in this promotion.
3.Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4.To be eligible to enter, eligible entrants must, during the Promotional Period:
a) Visit a Promotional Store and take a picture of the Prize Surfboard and pose of a big wave legend that’s just pulled out of a 30ft monster barrel at that Promotional Store.
b) Visit
www.facebook.com and either log into their Facebook profile or follow the prompts to register a new Facebook account. To enter, eligible entrants must, during the Promotional Period, visit the “’Tis the Season to Surf” tab on the Virgin Mobile Australia Facebook page, “Like” the Virgin Mobile Australia Facebook page and follow the prompts on the competition entry form, input the requested details, including their photo based on the designated challenge and submit the fully completed entry form.

6.By entering this promotion, individuals agree to receive future communication from the Promoter.
7.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.Multiple entries permitted, provided each entry is submitted separately and in accordance with entry requirements. Incomplete, indecipherable or illegible entries will be deemed invalid.
9.This is a game of skill and chance plays no part in determining the winners. All entries will be individually judged according to their originality and creativity. The Promoter's decision is final and no correspondence will be entered into.
10.If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the Facebook account is held.
11. Promotional period commences on the 20 December 2011 at 09.00hrs and will finish on 21 January 2012. Entries will be judged on Wednesday 22 January 2012 and will take place at Virgin Mobile, Level 8, 213 Miller Street, North Sydney, NSW 2060. Winners will be notified by E-mail & telephone. The Promoter’s decision is final and no correspondence will be entered into.
12.The first fifteen (15) valid entries judged from the competition will win the prize valued at up to AUD$740. The prize is:

13. Prizes are subject to availability. All prizes must be claimed and collected by the winner at the Virgin Mobile store they took the picture at by 21 February 2012. Winners must present proof of identity at time of collection. Prizes not claimed after 30 days are forfeited.
14.If for any reason the winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
15.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
16.Maximum total prize pool is valued at up to AUD$11,100. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
17.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
18.If this promotion is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
19.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
20.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the appearance of any or all of the winner’s selected entertainment or if the Promotion is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant.
21.As a condition of accepting the major prize, the winner (and any guest/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
22.The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. The Promoter’s privacy policy can be located at

23.The laws of the state of NSW apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of NSW and those court entitled to hear appeals from NSW.
