Conditions of Entry
1.Information on how to enter and prizes forms part of these Conditions of Entry. Entry into this promotion is deemed to be acceptance of these Conditions of Entry.
2.Entry is only open to Australian residents aged 18 years and over. Employees (and their immediate families) of the Promoter, its associated companies, advertising agencies and participating retailers are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who the Promoter believes either has tampered with the entry process or has submitted an entry which is not in accordance with these Conditions of Entry or acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4.Incomplete, indecipherable or illegible entries will be deemed invalid.
5.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
6.Promotion commences on 02/11/2011 and ends for purchases at close of business on 29/11/2011 (Promotional Period).
7.To be eligible to enter, a participant must, during the Promotional Period, purchase any three (3) packets of Participating Arnott's Biscuit Products in one (1) transaction (see immediately below for a list of participating products) from a participating Woolworths or Safeway supermarket nationally.
Participating Arnott's Biscuit Products include Butternut Snaps Cookie, Choc Ripple, Rice Cookie, Granita, Lattice, Malt-O-Milk, Arnott's Shortbread, Ginger Nut, Marie, Milk Arrowroot, Milk Coffee, Nice, Shredded Wheatmeal, Scotch Finger (250g & 375g), Teddy Bear (250g & 500g), Yo Yo, Family Assorted Pack, Royals Chocolate Dark and Royals Chocolate Milk ("Participating Arnott's Biscuit Products").

2.fully complete the official original entry form found in-store including all of the requested details, attach the three (3) original barcodes cut from the Participating Arnott's Biscuit Products purchased and send together to "Arnott's Bake & Create Promotion", PO Box 686, Eastern Suburbs MC, NSW 2004 so that it is received by last mail on 06/12/2011; or

www.arnotts.com.au/promotions, follow the prompts to the competition entry page, fully complete the online entry form including the personal details requested, the last four (4) digits from the barcode of each of the three (3) Participating Arnott's Biscuit Products purchased, the full Woolworths/Safeway receipt number and submit the fully completed entry form by 11:59pm AEDST on 06/12/2011.
9.All entrants will be required to retain a photocopy of their Woolworths or Safeway receipt(s) as proof of purchase. Failure to provide this proof of purchase to the Promoter upon request within the specified time period will, at the Promoter's discretion, result in an invalid entry (and, at the Promoter's discretion, in all of the entrant's entries being invalid). Upon request, a photocopy of the purchase receipt must be supplied for each entry submitted in order to claim a prize (regardless of whether the entrant has entered via mail or online). Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
10.Only one (1) entry is permitted for every three (3) participating Arnott's Biscuit Products purchased in a single transaction. Multiple mail entries will be accepted but each entry MUST be on a separate official original entry form, posted in a separate stamped envelope, and must include three (3) original Participating Arnott's Biscuit Product barcodes. Multiple online entries will be accepted but each entry MUST include the details of three (3) Participating Arnott's Biscuit product barcodes.
11.Photocopied entry forms will not be accepted. Any entry that does not comply with these Conditions of Entry will be invalid.
12.All website entries are deemed to be received at the time of receipt into the Promoter's database NOT the time of transmission by the entrant.
13.The Promoter's decision is final and no correspondence will be entered into.
14.The prize draw will be conducted at Greeneagle Distribution and Fulfilment, Unit 10, 20 Ricketty Street, Mascott NSW 2020 on 16/12/2011 at 11am AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
15.Winners will be notified via email and mail.
16.The first 1,000 valid entries drawn will each win a Baking Set consisting of a Joseph Joseph Nest 8 Set valued at $99.00, a Miniamo Decorating Set valued at $24.95, a Miniamo Chef's Tool Set valued at $24.95, a Miniamo Non Slip Chopping Board valued at $9.95, a Children's Chef's Hat valued at $9.95, a Minamo Pastry Brush valued at $6.95 and a Wooden Spoon valued at $3.50. Each Baking Set is valued at $179.25 (RRP).
17.The total prize pool is $179,250 (including GST).
18.No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed or misdirected entries.
19.Prizes are not transferable or exchangeable and cannot be taken as cash.
20.Subject to the unclaimed prize draw clause, in the event that for any reason a winner does not take the prize then the prize will be forfeited by the winner and cash will not be supplied in lieu of that prize. The Promoter accepts no responsibility for any variation in the prize values. Where a prize is unavailable for any reason, the Promoter may substitute the prize for a prize of equal or higher value and/or specifications, as determined by the Promoter, subject to any written directions from a regulatory authority.
21.The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation by technical malfunctions or failures.
22.The Promoter is not responsible for any technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, or any other technical failures, including any injury or damage to participants' or any other person's computer related to or resulting from participation in or downloading any materials in this competition.
23.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24.If for any reason this competition is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, subject to the written directions of any relevant authority, in its sole discretion to cancel, terminate, suspend, postpone or amend the competition, as appropriate.
25.The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry or any instructions or directions on this web site, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
26.Any costs associated with accessing the promotional website are the entrant's responsibility and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website will deem the entry to be invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
27.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
28.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
29.In the event of a prize not being accepted or claimed within 3 months of the draw, the relevant winner's entry will be deemed invalid and the Promoter reserves the right to conduct a further draw at the same time and place as the original draw as is necessary on 16/03/2012 to distribute any unclaimed prize(s), subject to the written directions given by any relevant authority. Winners, if any, in the unclaimed prize draw will be notified via email and mail.
30.Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.
31.Each entrant agrees to participate and co-operate in any publicity activities organized by the Promoter (or its nominate representative) connected with the promotion should he/she be a winner. This may include having photographs taken of him/her (and his/her prize) and having his/her name and picture appear in advertising, marketing and publicity material within Australia at the Promoter's sole discretion. Each entrant acknowledges that he/she will not receive any compensation in this regard, and the Promoter will determine, in its absolute discretion, the content, format and style of any material to appear in such publications.
32.The information in the entries is collected to conduct this promotion and to publicise the details of the winners. If an entrant does not provide the information requested, that entry will not be eligible for the prize draw.
33.The Promoter may require the winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter's absolute discretion. If there is a dispute as to the identity of an entrant, the Promoter reserves to right to determine the identity of the entrant.
34.The Promoter, through its agent, 31ST:SECOND, is collecting personal information contained in the entry form for the purposes of conducting this promotion, (including conducting the draw, notifying the winners, and as required, Australian regulatory authorities) and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
