Terms & conditions
1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over who are able to take the major prize between 27/01/2012 and 29/01/2012. Employees (and their immediate families) of the Promoter, participating Woolworths stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Promotion commences at 9:00am AEDST on 04/01/2012 and ends at 5pm AEDST on 23/01/2012 (“Promotional Period”).
4. To be eligible to enter, individuals must purchase, in a single transaction, 1 female and 1 male Dove product from participating Woolworths stores nationally during the Promotional Period. To enter, individuals must then visit
www.mydove.com.au/austopen, follow the prompts to the promotion entry page, input the requested details including the last 4 digits of the purchase receipt and submit the fully completed entry form during the Promotional Period. Each entrant will be notified instantly online whether or not they are an instant winner. All valid entries received from winners and non-winners of an instant prize will be automatically placed in the major prize draw.
5. Individuals who enter their Everyday Rewards card number at the time of entry will receive an additional two (2) entries into the major prize draw.
6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) only two (2) additional entries per specified purchase requirement when a valid Everyday Rewards card number is entered at the time of entry; and (c) each entry must be submitted separately and in accordance with entry requirements.
8. Entrants must retain a photocopy of their original Woolworths purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.
9. The major prize draw will take place at Handling Matters, 1/3 Green Street Brookvale NSW 2100 on 24/01/2012 at 3:00pm AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The major prize winner will be notified in writing with two (2) working days of the draw and their name will be published in The Australian on 26/01/2012. Instant winners will be notified immediately online upon entry submission and winners of prizes valued at over $250 will be published in The Australian on 26/01/2012. The Promoter’s decision is final and no correspondence will be entered into.
10. There are one hundred and eighty (180) instant win prizes to be won during the Promotional Period for this promotion. There will be nine (9) random instant win prizes to be won for each day of the Promotional Period. The instant win prizes include: 40 x framed and signed Pat Rafter T-Shirts with photographs valued at $400 each; 40 x signed Pat Rafter Australian Open 2012 caps valued at $200 each; and 100 x Woolworths WISH Gift Cards valued at $100 each.
11. Any ancillary costs associated with redeeming the Woolworths WISH Gift Cards are not included. Any unused balance of the Woolworths WISH Gift Cards will not be awarded as cash. Redemption of the Woolworths WISH Gift Cards is subject to any terms and conditions of the issuer including those specified on the Woolworths WISH Gift Cards.
12. Woolworths Limited is the issuer of the WISH Gift Card but is not the Promoter and is therefore not responsible for the prizes, products, or services under the promotion or the fulfilment of these Terms and Conditions. Woolworths Limited is responsible for the fulfilment of the terms and conditions of the WISH Gift Card. WISH Gift Cards are redeemable at participating stores only. 13. The first valid entry drawn in the major prize draw will win the major prize. The major prize is a trip for four (4) people to the 2012 Australian Open on 27/01/2012 to the 29/01/2012 valued at up to AUD$51,000 depending on point of departure. Prize includes two (2) nights twin share accommodation at The Swanston (or similar), four (4) Women’s Final tickets for Rod Laver Arena on 28/01/2012, a behind the scenes tour (subject to availability, where winners visit players facilities, Tennis Australia, Media Workroom, Player Beauty Bar, Tournament Administration Corridors and The Champions Walk), VIP treatment in the ‘Dove Ground Activation’, a food and beverage allowance of $50 per person, a meet and greet opportunity with Pat Rafter, $1,000 spending money for the winner only and four (4) Dove pamper bags (1 per person). If the winner is not from VIC, the prize also includes return economy airfares from the winner's nearest capital city to Melbourne, VIC for four (4) people and return hotel to airport transfers. If the winner is from VIC, then the prize does not include airfares or transfers and the airfare and transfers component of the prize is not redeemable for cash. Additional spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
14. The major prize must be taken to coincide with the 2012 Australian Open with flights departing on 27/01/2012 (if required) and is subject to booking and flight availability.
15. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
16. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the major prize. The major prize is subject to the standard terms and conditions of individual prize and service providers. The major prize winner may be required to present their credit card at time of accommodation check in.
17. If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. The Women’s Grand Final ticket element of the major prize is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
20. The “Meet & Greet” opportunity awarded as part of the major prize provides the winner (and his/her companion/s) with an opportunity to meet Pat Rafter and an opportunity to have a photograph taken with Pat Rafter. This element of the prize is not guaranteed and is subject to the goodwill of Pat Rafter on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that this element of the prize cannot be offered for any reason.
21. Total prize pool value is up to $85,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
22. A draw for any unclaimed prizes (major or instant win) may take place on 24/04/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners (if any) will be notified in writing within two (2) business days of the draw and their names (for prizes over $250) will be published in The Australian on 08/05/2012. In the event the major prize is awarded in the unclaimed prize draw, a different prize to the equal value of the original major prize will be awarded. The major prize will be a similar trip to Melbourne, VIC excluding the tennis related elements where cash will be awarded in lieu.
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
26. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 200 online instant win notifications for this promotion.
27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2012 Australian Open or the Woman’s Grand Final event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
29. As a condition of accepting the major prize, the winner (and his/her companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
30. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
