Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
2 Entry to the promotion is open to all eligible entrants aged 14 years and over who fulfil the entry requirements. (Entrants aged under 18 years must obtain permission from their parent/guardian to enter the promotion). Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this promotion are ineligible. “Immediate families” means spouse, parent, guardian, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.
3 The promotion begins on 01/01/2012 and closes at close of business on 29/02/2012 (Promotion Period).
4 This promotion will be conducted at Alchemy Bar & Restaurant – 90 George St Launceston Tasmania 7250 (Venue).
5 To enter, consumers must, during the Promotion Period, purchase any Schweppes product (bottled or poured; no alcoholic/mixed drinks allowed) (Eligible Purchase) from the Venue for on-premise consumption to receive a scratch card (Scratch Card) (subject to stocks of Scratch Cards remaining in the Venue). Entrants will need to scratch the panel on the Scratch Card to see if they have won a prize.
Multiple entries are allowed, however all entries must be supported by a separate qualifying purchase. If not, all entries by the entrant may be declared invalid by the Promoter at its absolute discretion. A maximum of 5 entries per day per person is allowed.
6 To claim a prize, the winner must, before the end of the Promotion Period, present their winning Scratch Card to Venue staff at the Venue.
7 The instant win prizes available to be won are:
• 40 X t-shirts (Schweppes/Pepsi or Solo designs/size as specified by Promoter) valued at $49.95 each(inc GST);
• 60 X Pepsi trucker caps (as specified by Promoter) valued at $19.95 each (inc GST);
• 100 X yoyos (Schweppes, Passiona, Solo, Pepsi as specified by Promoter) valued at $5.00 each (inc GST); and
• 200 X Schweppes soft drinks (pint; flavour as specified by Promoter) valued at $3.00 each (inc GST).
8 The total prize pool is valued at $4,295 (inc GST). There are in total 400 prizes to be won during the Promotion Period.
9 Winners will be notified in writing (on the Scratch Card).
10 At the Promoter’s request, winners must participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
11 The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
12 The Promoter, its associated agencies and companies, and the agencies and companies associated with this promotion, will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
13 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes.
14 If there are any unclaimed or un-won instant win prizes at the Venue at the close of the Promotion Period, these prizes will be randomly distributed to patrons at the Venue at the Venue’s discretion.
15 The Promoter and/or Venue may require winners to provide proof of age, proof of identity and proof of residency. Identification considered suitable for verification is at the Promoter’s/Venue’s discretion.
16 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person.
17 Prizes are not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. In the event for any reason a winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. The value of each prize is accurate as at the date of application for permits for this promotion. The Promoter accepts no responsibility for any variation in the value of a prize after that date. If for any reason the prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value, subject to the approval of the gaming authorities in each State/Territory, where relevant.
18 If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory, where required.
19 There will be a total of 4,000 Scratch Cards printed.
20 Scratch Cards from any other promotion are not valid for this promotion.
21 Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid prize claim. Every prize claim in excess of the advertised prize pool will be honoured, unless such claim is rejected due to fraud or ineligibility under these conditions. Scratch Cards are void if stolen, forged, mutilated or tampered with in any way.
22 The Promoter is not liable for any tax implications arising from the prize winnings. Independent financial advice should be sought. Where the operation of this promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
23 All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this promotion and for the other purposes of collection as set out in the Promoter’s privacy policy. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants and to State and Territory lottery departments and winners’ names may be published as required under the relevant legislation. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
