Summer Giveaway - Skull Candy
Terms and Conditions of Entry
1. Information on how to enter and the prize details form part of these terms and conditions
of entry. By participating, entrants agree to be bound by these terms and conditions.
2. The Promoters are The Herald & Weekly Times Pty Ltd (HWT), of 40 City Road,
Southbank, VIC,  3006, ABN 49 004 113 937 and the Australian Broadcasting Corporation
(ABC), of 700 Harris Street, Ultimo, NSW, 2007, ABN 52 429 278 345.
3. Entry is open to legal residents of Australia aged eighteen (18) years of age or over at
the time of entry. The Promoters reserve the right to request the prize-winner to provide
proof of age, identity and residency prior to awarding the prize. Identification considered
suitable for verification is at the discretion of the Promoters. Employees and immediate
family of the Promoters and their agencies associated with this promotion are ineligible to
enter.
4. Competition opens on Wednesday 30
th
November 2011 at 12.00am AEDT and closes on
Wednesday 1
st
February 2012 at 11.59pm AEDT. To enter, tell us in 25 words or less,
which band will be candy to your ears this summer and why?  Entries must not contain
any offensive or defamatory material.  The most creative entry will win.
5. Only entries that comply with these terms and conditions will be eligible to enter.
Entrants can enter as many times as they wish.  Send your entries to
triplejmagcomps@newsltd.com.au with  “Summer Giveaway” in the subject line. Include
your full name,  residential  address, age, mobile number and nominate the prize you
would like to win.

6. The entries will be judged at the triple j magazine office, 60 City Road, Southbank, VIC,
3006, on Friday 3
rd
February 2012 at 12.00 Noon AEDT. The winner will be notified by
phone  and  email and  his or her name printed in the Public Notice section of  The
Australian newspaper on Saturday 11
th
February 2012.
7. Upon receipt of entries, they become the property of the Promoters and will not be
returned to the entrants. The entrants irrevocably consent to the Promoters publishing
the winning entrant’s name and entry in  triple j magazine, The Australian newspaper
and/or internet, for an unlimited period of time without remuneration for the purpose of
promoting this promotion (including any outcome) and the entrants grant the Promoters
a non-exclusive licence for that purpose.
8. There will be one (1) winner.
9. The winner will receive one (1) Skull Candy, DJ Headphones and Mixer Mike valued  at
$380.00.
10. The Promoters’ decision is final and binding. No correspondence will be entered into.
Judging will be by suitably qualified judges (from within triple j magazine) able to assess
the quality and creativity of the entries and each entry will be  judged on its merits.
Chance plays no part in determining the winner.
11. The Promoters take no responsibility for any lost, stolen or misdirected prizes which are
not as a result of fault of the Promoters.  Where any prize is unavailable for any reason,
the Promoters reserve the right to substitute that prize for a prize of equal value at the
publishing date.
12. The prize is strictly as above. The prize is not transferable or exchangeable and cannot
be taken as cash.  The Promoters accept no responsibility for any variation in the prize
value. The Promoters may in their discretion refuse to award any prize to any entrant
who fails to comply with these terms and conditions. If for any reason any aspect of this
competition is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or
any cause beyond the control of the Promoters which  corrupts or affects the
administration, security, fairness, integrity or proper conduct of this competition, the
Promoters may in their sole discretion cancel, terminate, modify or suspend the
competition, or invalidate any affected entries, subject to the approval of the relevant
gaming authorities where required
13. The Promoters do not exclude any rights and remedies in respect of goods or services
under the  Competition and Consumer Act 2010 (Cth) or equivalent State or Territory
legislation which cannot be excluded, restricted or modified.  However, the Promoters
exclude all rights, remedies, conditions and warranties in respect of goods or services
from your use of this site, your entry into this competition or your enjoyment of the prize
whether based in statute, common law or otherwise to the extent permitted by law.  To
the extent permitted by law, the winning entrant must exclude, release and forever
discharge the Promoters, and all other persons involved in the conduct, promotion and
organisation of this promotion, and their respective employees, officers, agents and
contractors from all liability for claims, loss, damage, cost or expenses (whether arising
under statute, from negligence, personal injury, death, property damage, infringement of
third party rights or otherwise) arising from or in connection with the participation in the
prize or otherwise howsoever arising.
14. The  Promoters collect your personal information to assist us in providing the goods or
services you have requested, to process your competition entries, and to improve our
products and services. We or any of our Australian related companies may be in touch by
any means (including by SMS or email) at any time in the future to let you know about
goods, services or promotions which may be of interest to you. We may also share your
information with other persons or entities that assist us in providing our services, running
competitions or with other companies who provide prizes for competitions or reader
offers.  HWT is part of a global media and entertainment company. We would like to
share your information with these overseas-related companies so that they can contact
you with offers. If you would prefer us not to, please write to our privacy officer at:

15. The Promoters accept no responsibility for any tax implications that may arise from the
prize winnings.  Independent financial advice should be sought.  Where the operation of
this competition results in, for GST purposes, supplies being made for non-monetary
consideration, entrants agree to follow the Australian Taxation Office’s stated view that
where the parties are at arm’s length, goods and services exchanged are of equal GST
inclusive market values.
16. The maximum total value of the prize is $380.00
