1. Information on how to enter and the prize(s) form part of these Terms and Conditions.
Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over. Employees (and their
immediate families) of the Promoter and agencies associated with this promotion are
ineligible to enter. Immediate family means any of the following: spouse, ex-spouse,
de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister,
step-brother, step-sister or first cousin.
3. Promotion commences 17 January 2012 and entries close 11.59pm AEDST on 28th
February 2012 (âPromotional Periodâ).
4. To enter, individuals must visit
www.mcguiganwines.com.au, follow the prompts to the
promotion entry page, input the requested details including their first and last name,
phone number, address, date of birth and email address. Individuals will then be
presented with the promotional question, âWhich rock band is Mike Patton the front
man for?â and must correctly answer âFaith No Moreâ and submit the fully completed
entry form during the Promotional Period.
5. Every individual who enters and correctly answers the promotional question (as above)
during the Promotional Period will be eligible for a printable $10 off voucher for any
purchase of any six (6) x 750ml bottles of McGuigan Wine, redeemable at participating
Bayfields, Camperdown Cellars, Chambers Cellars and Porters stores. The full list of
participating stores is available at
www.mcguiganwines.com.au. Any ancillary costs
associated with redeeming a voucher are not included. Any unused balance of a
voucher will not be awarded as cash. Voucher must be produced and handed over at
time of purchase and is only valid for one (1) transaction. Limit of one (1) redemption
per person. Redemption of the voucher is subject to any terms and conditions of the
issuer including those specified on the voucher. Vouchers are valid for redemption
until 11:59pm AEDST on 31 March 2012.
6. The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrantâs identity, age and place of residence) and to disqualify
any entrant who submits an entry that is not in accordance with these Terms and
Conditions or who tampers with the entry process. Errors and omissions may be
accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its
rights at any stage does not constitute a waiver of those rights.
7. Incomplete or indecipherable entries will be deemed invalid.
8. Only one (1) entry permitted per person.
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in
its sole discretion, to determine the identity of the entrant.

10. The draw will take place at Message Media, Level 22, 385 Bourke Street, Melbourne
VIC 3000 at 10.00am AEST on 1 March 2012.
11. Winners will be notified in writing by email and telephone within two (2) business days
of the draw and their names will be published in The Australian on 15 March 2012. The
Promoterâs decision is final and no correspondence will be entered into.
The first valid and correct entry drawn will be deemed the major prize winner and will
win the major prize of a two (2) night stay at the Heart of McGuigan, Hunter Valley,
NSW for up to six (6) people in a three (3) bedroom villa. Prize includes a guided tour
of McGuigan cellar door for up to six (6) people and six (6) Sydney Festival CDâs
valued together at up to $2,000. Spending money, meals, insurance, transport to and
from Hunter Valley, transfers, items of a personal nature, in-room charges and all other
ancillary costs are not included. Major prize must be taken between 30 March 2012
and 30 March 2013 and is subject to booking and availability. Major prize cannot be
taken during Australian school holidays, public holidays or other peak periods.
12. The next valid and correct entry drawn will be deemed the minor prize winner and will
win four (4) x cases (750mL x 24 bottles) of mixed McGuigan Wine valued at up to
$400, delivered to the minor prize winnerâs home.
13. Major prize is subject to the standard terms and conditions of individual prize and
service providers. The winner of the major prize may be required to present their credit
card at time of accommodation check in.
14. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers
are advised to consider the safe drinking levels recommended in the National Health &
Medical Research Council Australian Alcohol Guidelines that are available at
www.nhmrc.gov.au/.
15. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves
the right to substitute a prize (or that part of a prize) with a prize to the equal value
and/or specification, subject to any written directions from a regulatory authority.
16. Total prize pool value is up to $2,400.00. Prizes, or any unused portion of a prize, are
not transferable or exchangeable and cannot be taken as cash, unless otherwise
specified.
17. A draw for any unclaimed prizes may take place on 1 June 2012 at the same time and
place as the original draw, subject to any directions from a regulatory authority.
Winners will be notified in writing by email and telephone within two (2) business days
of the draw and their names will be published in The Australian on 15 June 2012.
18. If this promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to technical difficulties, unauthorised intervention or
fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent
permitted by law (a) to disqualify any entrant; or (b) subject to any written directions

from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as
appropriate.
19. Any cost associated with accessing the promotional website is the entrantâs
responsibility and is dependent on the Internet service provider used.
20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under
the Competition and Consumer Act, as well as any other implied warranties under the
ASIC Act or similar consumer protection laws in the State and Territories of Australia
(âNon-Excludable Guaranteesâ). Except for any liability that cannot by law be excluded,
including the Non-Excludable Guarantees, the Promoter (including its respective
officers, employees and agents) excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct,
indirect, special or consequential, arising in any way out of the promotion.
21. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is
not responsible for and excludes all liability (including negligence), for any personal
injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoterâs control); (b) any theft,
unauthorised access or third party interference; (c) any entry or prize claim that is late,
lost, altered, damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any
variation in prize value to that stated in these Terms and Conditions; (e) any tax liability
incurred by a winner or entrant; or (f) use of a prize.
22. The Promoter collects personal information in order to conduct the promotion and may,
for this purpose, disclose such information to third parties, including but not limited to
agents, contractors, service providers, prize suppliers and, as required, to Australian
regulatory authorities. Entry is conditional on providing this information. The Promoter
may, for an indefinite period, unless otherwise advised, use the information for
promotional, marketing, publicity, research and profiling purposes, including sending
electronic messages or telephoning the entrant. Entrants should direct any request to
opt out, access, update or correct information to the Promoter. All entries become the
property of the Promoter.
