AEDT means Australian Eastern Daylight Time.
1.2
Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
1.3
Nissan means Nissan Motor Co. (Australia) Pty Ltd (ABN 54 004 663 156) of 260-284 Frankston Dandenong Road, Dandenong, Victoria.
1.4
Promoter means CatchOfTheDay.com.au Pty Ltd (ABN 22 149 779 939) of 64-70 Cochranes Road, Moorabbin, Victoria.
1.5
Promotional Period means the period starting on 15 January 2012 at 12:00pm AEDT and ending on 13 February 2012 at 11:59pm AEDT.
2 Who May Enter2.1
Entry is only open to Australian residents aged eighteen (18) years or over who hold a current valid Australian driver's licence.2.2
Employees and their Immediate Families of the Promoter and Nissan as well as agencies associated with this promotion are ineligible to enter.
3 Requirements for Entrants3.1
Participation in this promotion is deemed acceptance of these Terms and Conditions.
3.2
It is compulsory for entrants to provide their full name, telephone number and email address to enter the promotion as the winner may be notified either by email and/or by phone.
4 Validity4.1
To enter, entrants must, during the Promotional Period submit the fully completed entry form on the CatchOfTheDay.com.au website.
4.2
Only one (1) entry permitted per person.4.3
Incomplete entries will be deemed invalid.
4.4
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's sole and unfettered discretion.
5 The Prize5.1
The prize for the winner will be a Nissan Micra Ti with automatic transmission and metallic paint. Total prize value is up to AUD$22,276 including all on road costs, registration, stamp duty and dealer delivery charges (which may vary State by State).
5.2
Compulsory third party insurance (or any other insurance), options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion, accommodate the winner's colour preference, subject to availability. The winner must collect the prize from their nearest authorised Nissan dealership within one month from day the draw takes place.
5.3
The prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
5.4
If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
6 Details of Draw6.1
The Draw will commence at the CatchOfTheDay.com.au Braeside office located at 198 Boundary Road, Braeside, Victoria on 14 February 2012 at 10:00am AEDT. The winner of the promotion will be drawn at this time.
6.2
The Winner:
(a)
will be notified via email and a phone call and the result will be published on
www.catchoftheday.com.au as well as published in The Australian on 16/02/2012; and
(b)
must sign any release form(s) as may be required by the Promoter (and its associated agencies and companies), and/or any other third party directly or indirectly involved in and with the prize and refusal to sign such form(s) shall result in the immediate forfeiture of the prize and that person shall have no claim, action or recourse at law or otherwise against the Promoter in respect of the forfeiture.
6.3
If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded.
6.4
A draw for the prize, if unclaimed, will take place at the CatchOfTheDay.com.au Braeside office located at 198 Boundary Road, Braeside, Victoria on 14 May 2012 at 10:00am AEDT. The winner will be notified via email and a phone call and the result will be published on
www.catchoftheday.com.au as well as published in The Australian on 16/05/2012.
7 Method of Claiming Prize7.1
The winner is not required to be on-site at the draw. Once the winner is announced, the Promoter will contact the winner to make arrangements for vehicle registration and handover of the vehicle.
7.2
If for any reason the winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.
8 Database8.1
All entries will be entered into a database for future advertisement and marketing.
8.2
The Promoter and Nissan may use entrants' names and addresses for future marketing and promotional purposes unless notified otherwise in writing by the entrant.
8.3
Subject to clause 9.4, the Promoter will classify all entries as confidential and will not disclose any entrant’s details to any other parties, and by entering the competition the entrants to accept email communications from the Promoter until the entrant opts out to receive the email communications from the Promoter.
8.4
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
9 General9.1
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9.2
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
9.3
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
(a)
to disqualify any entrant; or
(b)
subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
9.4
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
9.5
All entries become the property of the Promoter.
9.6
The Promoter reserves the right to alter or amend these Terms and Conditions, and conditions of operation of the Promotion, subject to the approval of the gaming authorities in each State or Territory, where required.
9.7
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a)
any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
(b)
any theft, unauthorised access or third party interference;
(c)
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d)
any variation in prize value to that stated in these Terms and Conditions;
(e)
any tax liability incurred by the winner or any entrant; or
(f)
use of the prize.
